Relating to Coronavirus/COVID-19
I am aware of the contagious nature of COVID-19 and voluntarily choose to allow my child(ren)to participate in programs operated by EDU Learning Center, Elite Tae Kwon Do Academy | San Diego Tae Kwon Do Center.
I acknowledge that EDU Learning Center, Elite Tae Kwon Do Academy | San Diego Tae Kwon Do Center employees come into contact with multiple individuals, and might become exposed to COVID-19. I also acknowledge that although EDU Learning Center, Elite Tae Kwon Do Academy | San Diego Tae Kwon Do Center takes precautions to reduce the likelihood of transmission of COVID-19 by its employees and participants, EDU Learning Center, Elite Tae Kwon Do Academy | San Diego Tae Kwon Do Center cannot guarantee that my child(ren) will not become infected with COVID-19.
I knowingly acknowledge that by allowing my child(ren) to participate in EDU Learning Center, Elite Tae Kwon Do Academy | San Diego Tae Kwon Do Center's programs, I am exposing my child(ren) and myself to the risk of becoming infected with COVID-19, which may result in serious personal injury, illness, permanent disability, and death. I understand the risk of becoming exposed to or infected by COVID-19 may result from the actions, negligence, and failure to act myself and others, including, but not limited to, EDU Learning Center, Elite Tae Kwon Do Academy | San Diego Tae Kwon Do Center employees, and other program participants and parents.
I agree to assume all of the foregoing risks, and accept personal responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability or expense, of any kind of nature, that I may suffer arising out of or in connection with my child(ren) or myself becoming exposed to or infected by COVID-19 while my child(ren) is/are participating in any EDU Learning Center, Elite Tae Kwon Do Academy | San Diego Tae Kwon Do Center programs. On my own behalf, and on behalf of my child(ren), I hereby release, covenant not to sue, and forever discharge the EDU Learning Center, Elite Tae Kwon Do Academy | San Diego Tae Kwon Do Center, its employees, agents and representatives, of and from all liabilities, claims, actions, damages, costs or expenses of any nature ("Claims") arising out of or in any way connected with my child(ren) or myself becoming exposed to or infected by COVID-19. I understand that release includes any Claims based on negligence, action or inaction of any EDU Learning Center, Elite Tae Kwon Do Academy | San Diego Tae Kwon Do Center, its employees, agents, and representatives, and covers bodily injury (including death) due to COVID-19, whether a COVID-19 infection occurs before, during or after participation in any EDU Learning Center, Elite Tae Kwon Do Academy | San Diego Tae Kwon Do Center program.
In consideration of being permitted to participate in any way in martial arts program indicated below and/or being permitted to enter for any purposes, any restricted area (here in defined as any area where in admittance to the general pubils is prohibited), the parent(s) and/or legal guardian(s) of minor participant named above agree:
1. I/We fully understand and the parent(s) and/or legal guardian(s) will instruct the minor participant that prior to participating in the below martial arts activity or event, he or she should inspect the facilities and equipment to be used, and if he or she believes anything is unsafe, the participant should immediately advise officials and refuse to participate. I understand that, if at any time, I feel anything to be unsafe, I will immediately take all precautions to avoid the unsafe area and refuse to participate further.
2. Acknowledge that:
a. There are risks and dangers associated with participation in martial art events and activity which could result in bodily injury partial and/or total disability, paralysis or death.
b. The social and economic losses and/or damages, which could result from the risks and dangers above, could be severe.
c. These risks and dangers may be cause by the action, inaction or negligence of the participant or the action including/but not limited to, releases named below.
d. There may be other risks not known to us or are not reasonably foreseeable at this time.
3. I/We accept and assume such risk and responsibility for losses and/or damage following such injury, disability, paralysis or death, however caused in whole or in part by the negligence of releases name below. I hereby agree my consent to receive first aid treatment from the volunteers and medical staff.
4. I/We hereby release, waive, discharge and covenant not to sue the martial arts facility used by the participant, including its owners, managers, promoters, leases of premises used to conduct the martial arts event or program, premises and event inspectors, underwriters, consultants and others who give recommendations, direction or instruction to engage in risk evaluation or loss control activities regarding the martial arts facility or events held at such facility and each of them, their director, officers, agents, employees, all for the purposes herein referred to as "referee"...From all liability to undersign, my/our personal representatives, assigns, executors, heirs, and next kin for any and all claims, demands losses or damages and any claim or demand therefore on account of any injury, including but not limited to the death of participant or damaged property arising out of or relating to event caused alleged to be caused in whole or in part by the negligence of release or otherwise.
5. I/We here by acknowledge that the activities are very dangerous and involve risk of injury and/or death and/or property damage.
