Dog or Puppy Adoption

This Animal Adoption Agreement (the "Agreement") is between "Adopter" (the "Adoptive Owner") and All 4 Paws (“A4P”). The parties agree as follows with respect to adoption of the above rescue animal:1. Adoptive Owner agrees that this animal shall be treated as a family pet. This means the pet shall have extensive house privileges, sleep inside the house, and not be kept solely AS A FREE ROAM ANIMAL. Adoptive Owner shall provide this animal with proper food, water, shelter and necessary veterinary treatment.2. This animal has been examined by A4P’s veterinarian prior to adoption and has received a rabies and FVRCP vaccination, however, Adoptive Owner agrees that A4P is not making any representations or warranties regarding the animal’s health, physical condition, or age. Adoptive Owner agrees that veterinary problems may arise with this animal, including serious illnesses requiring emergency care or surgery. The parties agree that said problems are Adoptive Owner's financial responsibility who shall bear all related costs and provide necessary timely veterinary care to the animal.3. If the animal has not yet been spayed or neutered, the parties agree that the Adoptive Owner shall have the animal spayed or neutered, and the adoption fee shall include this operation by the A4P veterinarian. Adoptive Owner shall make an appointment with A4P to have this animal so altered. A4P shall not pay for this expense should Adoptive Owner elect to have a different veterinarian perform the operation. If the animal is spayed or neutered by someone other than A4P’s veterinarian, Adoptive Owner shall give A4P a copy of the spay/neuter certificate within 10 days of said operation.4. Adoptive Owner agrees that A4P may visit the animal at a mutually convenient time to certify that this Agreement isbeing satisfied. Adoptive Owner shall make a good faith effort to return A4P 's call within three days.5. Adoptive Owner shall notify A4P within two weeks of changing an address or telephone number. Because your animal is micro-chipped, Adoptive Owner shall change the microchip information in order to assist in tracking a lost animal.6. Adoptive Owner shall notify A4P IMMEDIATELY if unable to keep the animal as a pet as required under this Agreement, and shall work with A4P to place the animal in an A4P approved home. Adoptive Owner agrees that the adoption fee shall be non-refundable. Adoptive Owner shall not give the animal to a 3rd party or take the animal to an animal shelter without express approval from A4P. The parties agree that All 4 Paws has the right to sue Adoptive Owner for all damages, in equity or at law, for any breach of this Agreement, and Adoptive Owner shall additionally pay A4P for all legal fees in connection with enforcing this Agreement.7. Adoptive Owner agrees that A4P shall have the right to reclaim and take possession of the animal if, in its sole opinion, any of the above terms, conditions or requirements are not being met by Adoptive Owner, and no additional legal or other action is required by A4P prior to taking possession. Adoptive Owner hereby expressly waives its rights to any action required under this Agreement, or notice required under law, prior to A4P reclaiming the animal hereunder.8. Adoptive Owner agrees that CATS SHALL NOT BE DECLAWED.9. Adoptive Owner agrees that A4P is not making any representations or warranties about the animal’s temperament or behavior and agrees that A4P is not responsible for any injury, damage, or harm caused by this animal, and releases and forever discharges A4P from all liability for any injury, damage, harm, or expense incurred relating to this animal. Adoptive Owner shall indemnify and hold harmless A4P from all such claims and shall pay, without limitation, any costs related to such injury, damage, or liability, including, in the case of litigation, any attorneys’ fees incurred by A4P in its defense.10. Adoptive Owner shall pay a non-refundable adoption fee in the amount stated above. This Agreement is intended to be a complete statement of the understanding between A4P and Adoptive Owner, and may not be modified unless agreed to in writing by both parties.
