Luxe Booth Rental Agreement

This Luxe Booth Rental Agreement (the "Agreement") is entered into by and between {name} (hereinafter referred to as "Client") and Move Mountains Co. LLC DBA Luxe Booth Co. (hereinafter referred to as "Luxe Booth Provider") collectively referred to as "Parties."

RENTAL SERVICES
Luxe Booth Provider agrees to provide the following services to the Client for the specified event:

A premium Luxe Booth with state-of-the-art photo booth equipment.
A wide range of fun and interactive props for use during the event.
Unlimited photo sessions for the duration of the rental period.
Instant high-quality photo prints for guests.

Digital copies of all photos taken during the event provided after the event.
On-site Luxe Booth attendant to assist guests and ensure smooth operation.
Customized photo templates or branding options (if requested).
Delivery, setup, and breakdown of the Luxe Booth at the event venue.

RENTAL PERIOD
The rental period shall be for number of hours in agreement. Any additional hours required by the Client beyond the agreed rental period will be subject to additional charges at the rate specified in Section 4.

RENTAL FEES AND PAYMENT TERMS
The total rental fee for the Luxe Booth services is listed in invoice. A deposit of the total is required upon signing this Agreement to secure the Luxe Booth for the event. The deposit is non-refundable and non-transferable.

Additional fees:

a. Early Setup Fee: If the venue or client requests an earlier setup time apart from the standard 1.5-hour setup time, an additional fee of $250 USD will be charged. The early setup fee must be paid in full along with the remaining balance.

b. Travel Fee: The rental package includes travel within a 120-mile radius from the studio location. For events located beyond this distance, a travel fee of $0.56 USD per mile will be charged. The travel fee will be calculated based on the round trip distance from the studio to the event venue and must be paid along with the remaining balance.

CANCELLATION POLICY
All payments made by the Client are non-transferable and non-refundable. In the event of cancellation by the Client, the deposit paid will be forfeited. If the cancellation occurs within 90 days before the event date, the Client will be liable to pay the full rental fee.

CLIENT'S OBLIGATIONS
The Client shall provide Luxe Booth Provider with all necessary event details, including the event venue, setup location, and any special requirements, at least 90 days before the event date.

The Client shall ensure that suitable space and power supply are available for the setup of the Luxe Booth.

LIABILITY
Luxe Booth Provider shall not be liable for any injury, loss, damage, or claim arising from the use of the Luxe Booth during the event, except in the case of gross negligence or willful misconduct on the part of Luxe Booth Provider.

The Client agrees to be responsible for any loss or damage to the Luxe Booth Provider's props, equipment, or any other materials caused by the Client, the Client's guests, or any third parties during the event. The Client will be billed for the repair or replacement costs of any damaged items.

WAIVER OF IMAGE USAGE
The Client acknowledges that during the event, photos taken by the Luxe Booth may include images of the Client, the Client's guests, and other individuals present at the event. The Client hereby grants Luxe Booth Provider the right to use and publish these photos for promotional and marketing purposes, including but not limited to website content, social media, and print materials. However, Luxe Booth Provider agrees not to use these images in any way that would be considered defamatory, offensive, or inappropriate.

If the Client wishes to restrict the usage of specific images, the Client must notify Luxe Booth Provider in writing before or during the event. Luxe Booth Provider will make reasonable efforts to comply with the Client's request, but it is understood that such restrictions may limit Luxe Booth Provider's ability to promote and showcase their services effectively.

INTELLECTUAL PROPERTY
All intellectual property rights, including but not limited to copyrights, trademarks, or other proprietary rights, in the photos taken by the Luxe Booth during the event, shall belong to the Client.

GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of Rhode Island, without regard to its conflict of laws principles.

ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between the Parties concerning the subject matter hereof and supersedes all prior and contemporaneous agreements, whether oral or written.

IN WITNESS WHEREOF, the Parties have executed this Luxe Booth Rental Agreement as of the date first above written.
Property Damage Liability Agreement*

Travel and Accommodation Clause for Distant Events*

By clicking here, I understand for events located beyond a 120-mile round trip from our studio, a travel fee will be applied to cover additional transportation costs. Furthermore, for events exceeding a 150-mile round trip, accommodations for an overnight stay may be required for the attendant to ensure optimal service and performance at the event
Cancellation Policy*

By clicking here, I agree to the following Cancellation Policy: All payments made by the Client, including but not limited to the initial deposit, are non-refundable. In the event of a cancellation by the Client, the deposit already paid will be retained by the Luxe Booth Provider as liquidated damages. Further, if the cancellation occurs within 90 days before the event date, the Client will be held liable for the entire rental fee, payable immediately upon cancellation.
