COVID-19 WAIVER AND RELEASE 2023-2024
Bridge Tutorial Ministries (hereinafter collectively referred to as "BTM") adopted the following guidelines and procedures ("General Rules") for the safety and health of students, tutors and families using facilities (hereinafter collectively referred to as "Facilities" Each participant must sign this form and follow the General Rules when using the Facilities. These General Rules are subject to change without notice. BTM reserves the right to terminate privileges for anyone who does not follow the General Rules herein and Rules posted at the Facilities. BTM reserves the right to close the Facilities entirely if it is determined that students are not following the General Rules or if it is determined that the Facilities should be closed due to general health and safety concerns.
A. General Rules for Use of the Facilities
Participants must adhere to the following rules and guidelines when using the Facilities:
-DO NOT enter or use the Facilities if you are feeling sick, have a temperature or have any other symptoms of COVID-19.
-If deemed necessary by the BTM Leadership Team (LT), participants must complete the specified BTM COVID-19 Symptom Checker each day before entering the Facilities. (found on the BTM website when in use)
-Participants must follow the facility and/ or county current mask mandates as informed and updated by the BTM LT.
-Thoroughly wash and/or sanitize your hands upon entering and throughout use of the Facilities.
-Thoroughly wash and/or sanitize all object(s) you bring into the Facilities area.
-Participants LT/DP/ Tutors will be responsible for sanitizing touch surfaces. They will wipe down surfaces prior to another student utilizing the same surface.
-Guests are NOT allowed within the Facilities, unless permitted for specific purposes by the BTM LT. Only current BTM families, Tutors, Designated Parents, Leadership Team members, and minors from the same household as a Tutor, Designated Parent or Leadership Team member may use the Facilities.
-Participants are responsible for maintaining standard restroom cleanliness - toilets flushed, nothing left on floors or sink areas, etc leaving the restrooms in clean condition after use.
-BTM will NOT be maintaining a Lost & Found. All items will be disposed of if not claimed by the end of the day.
B. COVID-19 Inherent Dangers
I acknowledge the contagious nature of COVID-19 and that it can be spread directly between participants using the Facilities. I am aware that frequently touched surfaces allow for the transfer of infected respiratory droplets and that COVID-19 can survive on those surfaces. I also understand that there is a risk of contracting COVID-19 by using the Facilities.
I am aware that frequently touched surfaces include, but are not limited to, the following:
-Light switches, doors and door handles
-Restroom faucets, sinks, soap, paper towel dispensers, toilet flush controls
-Stair railings
-Tables, chairs, lab equipment, writing utensils and electronics
-Drinking fountains (will be off limits)
I understand and acknowledge that in the event of contracting COVID-19 or any other illness or injury, BTM and the host facility do not owe me a legal duty to take any action on my behalf.
C. Assumption of Risk
I certify that I am physically fit and suffer from no condition, impairment, disease, infirmity, or other illness (including COVID-19) that would endanger others or prevent me from using the Facilities. I acknowledge that given the inherent risk of contracting COVID-19, BTM has taken all reasonable and appropriate precautions to limit its transmission, and that despite taking these precautions, BTM cannot guarantee that COVID-19 will not be transmitted in its Facilities. I acknowledge that there will be no enforcers to ensure appropriate social distancing at all times, or to ensure that each person complies with the General Rules stated herein; however, tutors, DP and LT will be there to ensure that guidelines are being followed to the best of their abilities. I acknowledge there may be instances when appropriate social distancing is not being maintained, or other General Rules are not being followed, by those in the facility and that I am responsible to remove myself and/or my minor children if I should become uncomfortable for my/our health or safety.
I hereby assume all risk of loss, danger, property damage or injury (including death) to myself and my minor children from COVID-19 infection or other illnesses or injuries arising from the use of the Facilities, and I hereby agree that I am solely responsible for any resulting illness or personal injury, including death, to myself and my minor children, as a result of using the Facilities.
D. Waiver, Release and Indemnification
In consideration of being able to use the Facilities during this time of the threat of COVID-19, I, for myself, my heirs, personal representatives and assigns, do hereby release, waive, discharge and covenant not to sue BTM its leadership team, tutors, volunteers, no other BTM families, the host facility's staff, church members or contractors (collectively referred to as "Released Parties") from any and all claims or liabilities, including but not limited to, illness, personal injury (including death), and property loss, which may result from my use of the Facilities or arising from the negligence or fault of the Released Parties. I further save and hold harmless and indemnify the Released Parties from any and all claims, actions, lawsuits, damages and liabilities, including attorney's fees, resulting directly or indirectly from my use of the Facilities, whether caused by the negligence of the Released Parties or otherwise, and to reimburse the Released Parties for any such expenses incurred by them from my use of the Facilities.
PARENT/GUARDIAN WAIVER FOR MINORS (Under the age of 18): The undersigned parent(s) or legal guardian(s) do hereby represent that he/she has consented to his/her child's use of the Facilities, and has agreed on behalf of the child, to the terms of this waiver and release of liability and to save and hold harmless and indemnify the Released Parties from any and all claims, actions, lawsuits, damages and liabilities, including attorney's fees, resulting directly or indirectly from the child's use of the Facilities, whether caused by the negligence of the Released Parties or otherwise, and to reimburse the Released Parties for any such expenses incurred by them from the child's use of the Facilities.
I HAVE READ THIS DOCUMENT AND UNDERSTAND ITS TERMS. BY SIGNING THIS DOCUMENT, I AM WAIVING ANY RIGHT I OR MY MINOR CHILDREN OR SUCCESSORS MIGHT HAVE TO BRING A LEGAL ACTION OR ASSERT A CLAIM AGAINST BTM AND ITS RELEASED PARTIES FOR ANY INJURY OR DEATH SUSTAINED. I HAVE SIGNED THIS FREELY AND VOLUNTARILY.
I expressly agree that the foregoing waiver and release of liability, indemnity agreement and assumption of risk is intended to be as broad and inclusive as is permitted by the law of the State of Maryland and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
