Mervyn Lambert Plant Ltd - Terms of Trade
CPA TERMS APPLY

Unless specifically agreed otherwise in writing, by a director of Mervyn Lambert Plant Ltd, all hire contracts are subject to CPA Model conditions without variation, (Copy available upon request). Plant and equipment hired on a self-drive basis is done so on the understanding that the hirer is responsible for ensuring that the operator or driver of the plant is fully competent and holds a proficiency certificate for the particular type of plant being hired.
PAYMENT TERMS

Plant hire payment terms are strictly 30 days from invoice date, (Subject to your total outstanding account being within the Credit Facility specified by Mervyn Lambert Plant Ltd). Plant sales terms are strictly on receipt of invoice unless otherwise specified by a director of Mervyn Lambert Plant Ltd. All disputes must be made in writing to Accounts within 14 days of receipt of invoice. Failure to adhere to payment terms will result in temporary withdrawal of credit facilities, continued failures will result in permanent withdrawal and account closure.
OPERATED HIRES

All hires with operator subject to minimum of 9-hour day. Domestic Reverse Charge VAT will be applied to all applicable customers.
SELF DRIVE HIRE RATES

Rates for Self-Drive hires are quoted on either a daily or weekly basis. Where a contract bearing a weekly hire rate terminates before five days hire; we reserve our right to charge the following percentages to the weekly rate quoted in order to arrive at a charge for the part week;

PLANT & SMALL TOOLS - 1 day 65%, 2 days 75%, 3 days 85%, 4/5 days 100%

ACCESS PLANT - 1 day 75%, 2 days 85%, 3 days 95%, 4/5 days 100%

Minimum hire periods apply; examples include, Fuel Bowsers 1 Week, Portaloo/Welfare 2 Weeks, Containers/Cabins 4 Weeks.
OFF HIRE PROCEDURE

Notwithstanding our right to the period of notice for termination of hire granted under Clause 24 of CPA Model Conditions, we are prepared to accept “off-hiring” of plant on the following basis;

1: All terminations of hire must be addressed directly to the plant office whether by telephone or in writing (Tel No: 01953 688211 or Email: plant@mervynlambert.co.uk)

2: Messages communicated through our plant operators or other third parties are not acceptable as formal notification of “off-hiring”.

3: All notifications of hire termination made by telephone are given an “off-hire” reference number. This reference number must be quoted in the case of any dispute arising over the length of the hire period.

4: Monday to Friday, a minimum of half days notice is necessary, whether given by telephone or in writing, in order for hires to cease on the day of notification.

Communication must be received by the Plant Office before midday.

5: “Off Hires” are not accepted at weekends.

Plant not required on a Monday must be “off-hired by midday on the preceding Friday.

6: Failure to meet the midday deadline will result in hire becoming chargeable in full for the next working day on the following basis; 9 hours for operated plant and 1 day for Self-Drive Hires.
