BOUNCE HOUSE & INFLATABLE SAFETY AGREEMENT AND WAIVER 

 

This Bounce House & Inflatable Safety Agreement and Waiver ("Agreement") applies to all bounce houses and inflatable equipment rented or provided by Shevelle & Co. ("Company").

This Agreement supplements the Shevelle & Co. Master Rental, Decor & Equipment Agreement and any applicable proposal or invoice.

 

1. ADULT SUPERVISION REQUIRED

The Client understands and agrees that a responsible adult must supervise the inflatable at all times while it is in use.

The inflatable must never be left operational and accessible to children without appropriate adult supervision.

The Client is responsible for communicating and enforcing all safety rules with participants and guests.

2. SAFE USE

The Client agrees that participatns will:

• Remove shoes before entering when required.
• Remove jewelry, eyeglasses, sharp objects, and other items that could cause injury or damage.
• Enter and exit only through the designated entrance.
• Avoid rough play, wrestling, pushing, flips, or other dangerous activities.
• Keep hands away from blowers, electrical components, anchoring equipment, and other mechanical components.
• Follow applicable occupancy, height, age, and weight restrictions.
• Follow all instructios provided by Shevelle & Co., and the equipment manufacturer.

Children of significantly different sizes and ages should not use the inflatable together when doing so could create an unsafe condition.

3. PROHIBITED ITEMS & ACTIVITIES

Unless specifically designed and approved for such use, the following are prohibited inside or on inflatable equipment:

• Food
• Drinks
• Gum
• Candy
• Confetti
• Silly string
• Face paint
• Sharp objects
• Toys
• Pets
• Smoking or vaping
• Alcohol
• Climbing on exterior walls or netting
• Unauthorized equipment or attachments

Additonal cleaning, repair, or replacement fees may be assessed when prohibited substances or activities damage Company equipment.

4. WEATHER CONDITIONS

Inflatable equipment must not be used during unsafe weather conditions, including but not limited to:

• Lighting
• Thunderstorms
• Heavy rain
• Excessive winds
• Standing water
• Severe weather warnings
• Other conditions Shevelle & Co.m determines may create an unreasonable safety risk

If unsafe conditions develop during the rental period, use must stop immediately.

Shevelle & Co., reserves the right to refuse installation, discontinue operation, deflate, or remove equipment when conditions are unsafe.

Safety decisions regarding Shevelle & Co. equipment are final.

5. EQUIPMENT LOCATION & MOVEMENT

Once Shevelle & Co., has installed an inflatable, the Client, guests, venue personnel, and other vendors may not move, reposition, disconnect, re-anchor, modify, or relocate the inflatable without authorization from Shevelle & Co.

The Client must prevent participants from tampering with stakes, sandbags, blowers, electrical cords, anchoring systems, or other equipment.

6. POWER & ELECTRICAL REQUIREMENTS

The Client must provide acces to an appropriate electrical source when required.

Electrical cords, blowers, generators, and related equipment must remain unobstructed and protected from unauthorized access.

The Client may not disconnect or alter electrical equipment except when instructed to do so by Shevelle & Co. or when necessary to address an immediate safety emergency.

7. EQUIPMENT CONDITION

The Client agrees to notify Shevelle & Co. immediately if the inflatable:

• Begins losing air unexpectedly
• Becomes unstable
• Shifts from its installed position
• Develops visible damange
• Experiences blower or electrical problems
• Becomes wet or otherwise unsafe

Participants must immediately exit the inflatable if any unsafe condition develops.

8. DAMANGE & CLEANING RESPONSIBILITY

The Client is responsible for damage beyond ordinary wear resulting from misuse, prohibited activities, unauthorized movement, lack of supervision, or failure to follow company instructions.

The Client may be charged for reasonable cleaning, repair, or replacement expenses results from such damage.

9. ASSUMPTION OF RISK

The Client understands that participation in inflatable activities involves inherent risks, including falls, collisions, physical contact between participants, and other potential injuries. 

The Client agrees to follow all safety requirements and assumes responsibility for ensuring that participants under the Client's supervision follow those requirements.

10. RELEASE & LIMITATION OF LIABILITY

To the extent permitted by Louisiana law, the Client agrees that Shevelle & Co., its owners, employees, representatives, and contractors will not be responsible for injuries or damages resulting from:

• Participant misconduct or misuse
• Failure to provide appropriate supervision
• Violation of safety rules
• Unauthorized modification or movement of equipment
• Continued use during unsafe conditions
• Failure to follow company or manufacturer instructions.

Nothing in this Agreement is intended to waive liability that cannot legally be waived under applicable law.

11. INDEMNIFICATION

To the extent permitted by applicable law, the Client agrees to indemnify and hold harmless Shevelle & Co. its owners, employees, representatives, and contractors from third party claims arising from the Client's or participants' misuse of equipment, violation of safety requirements, or conduct outside the reasonable control of Shevelle & Co.

12. RIGHT TO TERMINATE USE

Shevelle & Co., reserves the right to immediately discontinue use of any inflatable when:

• Safety rules are repeatedly ignored
• Weather becomes unsafe
• Equipment is being misused
• Required adult supervision is not being provided
• Conditions threaten participants or company property

Termination for a safety violation does not automatically entitle the Client to a refund.

13.  CLIENT SAFETY ACKNOWLEDGMENT

By signing below, I acknowledge that:

• I have received and reviewed the inflatable safety requirements.
• I understand that responsible adult supervision is required at all times.
• I agree to enforce the safety rules with all participants.
• I will immediately discontinue use if unsafe conditions develop.
• I will not move, modify, or alter the inflatable after installation.
• I accept responsibility for damage caused by misuse or failure to follow the provided instructions.
• I understand that inflatable activities involve inherent risks.
• I have had an opportunity to ask questions before signing.
