    Oberer’s Flowers Temporary Driver Agreement

  • Oberer’s Flowers offers a “pay per package” delivery agreement with temporary drivers. Pay per delivery is determined by our routing software and follows the following breakdown:

  • Delivery Pay
    0 to 5 miles $5.00
    5.1 to 10 miles $8.00
    10.1+ miles $10.00
    Unsuccessful Delivery $3.00
  • Unsuccessful delivery is defined as any item that is not delivered and needs to be brought back to the store. For any customers that are not home items can be left with a neighbor with an Oberer’s delivery tag left at their door letting them know where it can be picked up.

    A breakdown can be printed at the end of the day listing each item and the total of what you will be paid for the day. Any questions or disputes must be discussed prior to the end of the week. Checks will be available one week following your last day of employment and you will receive a phone call when it is ready to be picked up or mailed.

  • INDEPENDENT CONTRACTOR AGREEMENT

  • This Contract made and entered into by and between Oberer’s Flowers, Inc. 1448 Troy St Dayton, OH 45404 (“COMPANY”), and Independent Contractor as defined below upon execuon (“Contractor").

  • Services

  • 1. Contractor will perform the requested services as may be designated from time to time by COMPANY pursuant to this Contract. Contractor shall act, at all times, as an independent contractor.

  • Compensation

  • 2. COMPANY will pay Contractor $5 per successful delivery under 5 miles from pickup location, $8 per successful delivery between 5-10 miles from pickup location, $10 per successful delivery over 10 miles, and $3 per unsuccessful delivery, for the services performed by Contractor pursuant to this Contract. Payment will be made on Wednesday for the previous week’s deliveries.

  • Terms of Contract

  • 3. This Contract shall become effective upon signing by all parties and shall continue in force indefinitely unless terminated by either party as herein provided.

  • Independent Contractor

  • 4. Both COMPANY and Contractor agree that the relationship created by this Contract is that of independent contractor and not that of employer and employee. Contractor is solely responsible for the means of performance of the services being provided hereunder but is accountable to COMPANY for the satisfactory completion of each service. Contractor may select its own route and order of delivery. Contractor is responsible to provide its own motor vehicle and ensure proper functioning of same. Contractor is not covered under COMPANY’s workers’ compensation insurance. Contractor is responsible for the payment of any taxes, including without limitation, all Federal, State and local personal and business income taxes, sales and use taxes, other business taxes and license fees arising out of his activities.

  • Insurance and Indemnification

  • 5. Contractor shall carry motor vehicle liability insurance with limits as required by state law. Contractor shall ensure its insurance policy provides liability coverage when Contractor is delivering goods for hire. Other than claims for payments due, Contractor hereby agrees to release, discharge, waive all claims against, and defend and indemnify COMPANY, its directors, officers and employees, from and against any and all claims, costs, demands, expenses, liabilities, damages and attorneys’ fees, including but not limited to claims of bodily injury (including death), arising out of the services provided by Contractor under this Agreement or Contractor’s presence at COMPANY facilies. This release is further intended to cover all derivative claims which arise or may arise out of any events, losses or claims which may arise hereunder.

  • Right to Terminate Contract

  • 6. Either party may terminate this Contract by giving the other party written notice at least 5 days before the effective date of termination.

  • Effect of Termination on Compensation

  • 7. If this Contract is terminated prior to completion of the term specified in this Contract, Contractor will be entled to compensation earned prior to the date of termination as provided for in this Contract. Contractor shall be entled to no further compensation as of the effective date of termination.

  • No Assignment

  • 8. Neither party hereto can delegate or assign any of its rights or dues hereunder to anyone else without the express written consent of the other party.

  • Complete Agreement

  • 9. This Contract supersedes all prior contracts and understandings between the parties and may not be modified, changed or altered except by a writing signed by both parties.

  • Governing Law

  • 10. This Contract is governed by the law of the State of Ohio.

    Certification instructions.
