I ** by participating in any class, session, or activity hosted by Coach Cheryl's Fit Camp. I have read and agree to the terms below. *(If you do not agree, do not participate.)
1) Scope of Activities & Specific Risks.
All Activities include Fit Camp classes, Community Pop Up Events, Cardio Kickboxing, Group Training, Personal Training, fast-paced group exercise; HIIT; cardio and strength circuits; use of dumbbells, kettlebells, resistance bands, TRX suspension trainers, medicine balls, and punching/kicking bags and focus mitts; floor work; dynamic movements; and indoor/outdoor conditioning. Risks include slips/trips/falls; dropped weights; impact with bags/equipment/floors/participants; overexertion, dehydration, heat illness; musculoskeletal injury (sprains/strains/tears/fractures), hand/wrist/shoulder injury from striking; cardiovascular events; and aggravation of pre-existing conditions.
2) Assumption of Risk & Release for Negligence. I knowingly and voluntarily assume all risks, whether inherent or arising from the ordinary negligence of Coach Cheryl's Fit Camp, Benicia Community Health & Fitness, and their owners, officers, employees, volunteers, independent contractors, and agents (collectively, 'Released Parties'). I release and discharge the Released Parties
from any and all claims for injury, illness, death, or property damage arising from participation in the Activities or presence on the premises, including claims based on ordinary negligence (excluding gross negligence or willful misconduct where not permitted by law).
3) Equipment Use & Participant Duties. I will use equipment properly and only as instructed; wear appropriate protective gear when striking (e.g., hand wraps and gloves); remove jewelry and secure long hair; keep nails trimmed; and promptly report unsafe conditions or equipment issues. I accept responsibility for damage I cause by misuse.
4) Contact & Safety Rules. No person-to-person sparring or contact unless expressly authorized in a separate written consent by staff. Striking is limited to bags and pads held by staff/partners following instructions.
5) Health Screening & Medical Disclosure. I certify that I am physically able to participate; I will not participate while ill, dizzy, or injured; and I will disclose relevant medical conditions (cardiac, respiratory, orthopedic, neurologic, pregnancy/post-partum). Staff are not medical providers; I should seek medical clearance as needed.
6) Hydration, Heat, and Pace Acknowledgment. Classes may be high-intensity. I will self-pace, hydrate adequately, and may opt out of any movement at any time.
7) Emergency Medical Care Authorization. In the event of injury or medical emergency, I authorize first aid and emergency medical care, including transport, and agree to be financially responsible for associated costs.
8) Communicable Disease & Hygiene. Participation may expose me to communicable diseases (including viral/bacterial illnesses). I accept these risks and agree to follow hygiene and facility rules.
9) Personal Property. I am solely responsible for my personal property; the Released Parties are not responsible for loss, theft, damage. including automobile and its contents.
10) Indemnification (defend/hold harmless). I agree to indemnify, defend, and hold harmless the Released Parties from claims, damages, and expenses (including reasonable attorneys' fees) brought by or on behalf of me or any third party arising from my participation, except to the extent caused by gross negligence or willful misconduct.
11) Minors. If the Participant is under 18, a parent/legal guardian must sign. The parent/guardian agrees to all terms above on the minor's behalf, including assumption of risk, release, emergency care authorization, and indemnity.
12) Photo/Video. Unless I opt out on the signature page, I grant permission for photo/video of me during Activities to be used for promotional purposes without compensation.
13) Independent Contractors. Some instructors may be independent contractors; all protections, releases, and indemnities extend to them.
14) Governing Law; Venue; Severability. This agreement is governed by California law, and any action shall be brought in Solano County, CA. If any provision is held invalid, the remainder remains enforceable.
15) Optional Dispute Resolution. You may opt in to resolve disputes by binding arbitration in Solano County under applicable California rules (waiver of jury trial to the extent permitted by law) by signature page.
