                            Matrimonial Home

If you have a matrimonial home (or a property that may turn into a matrimonial home), this section outlines how the home will be divided, whether the home will be sold and equity divided, or if one party will be "buying out" the other, or a deferred sale. Most banks require this section for financing a new mortgage if there is to be a spousal title transfer. This is extremely important if one party to the marriage would like to "protect" the property from being equally divided in the future.

Completing these statements for each party and adding them to the agreement can significantly minimize the likelihood that one party can successfully challenge (and overturn) this marriage contract in court at a later date. You must select either this section or the section entitled "schedule of assets and debts" above.
