Crew agreement, conduct, rules and expectations
1. Your position on the vessel is on an unpaid voluntary basis and does not create any employment/ employee relationship of any sort.
2. You must follow the instructions of the Skipper at all times.
3. Sailing is an inherently hazardous activity and although Hornblower Ltd and the Skipper will use their best endeavours to ensure your safety, neither they nor their clients can be held liable for any loss or damage to your personal possessions or property, or injury or death, however caused.
4. In the event of scheduling or routing delays, Hornblower Ltd will not be responsible for any associated costs incurred by the crew.
5. Delays en route can occur for weather, technical or other reasons. In the event of delays, whatever the cause crew undertake to remain with the vessel until completion of the trip. Failure to remain with the vessel until completion of the voyage or to join at the start of the voyage as arranged, for any reason, may at the sole discretion of Hornblower Ltd, lead to a charge being made to the crew member concerned for additional costs incurred.
6. Should crew leave or be dismissed from the vessel en route they will be responsible for their own repatriation costs and all related expenditure.
7. All the direct expenses of running the vessel and feeding the crew whilst onboard the vessel are the responsibility of the Skipper. Crew are responsible for all their own living costs and any other expenditure when not on board the vessel.
8. Your conduct, appearance and dress must always be consistent with the high standards required by Hornblower Ltd and its clients. If you are issued with branded jacket, it is expected that it is worn in and around marinas when representing the company.
9. You are responsible for providing your own personal safety and other equipment, which must include a life jacket, harness and safety line, appropriate foul weather clothing and sleeping bag. You must also bring a large double sheet to protect your berth.
10. The use or possession of any illegal substances is strictly forbidden. Anyone found to be, or suspected of being in breach of this requirement will be dismissed from the vessel and reported to the authorities at the first available opportunity.
11. The consumption of alcohol whilst on board the vessel is forbidden whilst underway. Under no circumstances may crew smoke anywhere on the vessel other than in the cockpit or on deck and with the permission of the Skipper or Owner.
12. You must notify Hornblower Ltd of any current, chronic or recurring medical conditions and of the appropriate medication/treatment. You must also confirm these details to the Skipper on joining the vessel. You are responsible for your own medical requirements, treatment and costs, including repatriation if necessary.
13. Any agreement relating to Hornblower Ltd paying travel costs will be nullified if crew are dismissed from the vessel, leave the vessel for any reason before completion of the voyage or fail to join at the commencement of the voyage.
14. Crew must purchase their own medical and travel insurance. Please note that following 31 December 2020 the EHIC will no longer be valid for health insurance within the EU.
15. You are responsible for ensuring you have the necessary passport, visa and immunisation documents for the voyage.
16. All documents referred to in the agreement and any certificates of qualification must be provided, on request, for inspection by Hornblower Ltd or the Skipper.
17. On arrival at the final destination, you will be required to participate in the cleaning of the vessel and any other maintenance work at the Skipper’s discretion. Crew will generally be expected to leave the vessel within 24 hours of arrival at the final destination.
18. All information a Hornblower Ltd, its clients, the vessel and its owners is confidential. You must not at any time use or disclose this information to any other person.
19. You may not at any time make any statement to the press or other form of public media without the written consent of Hornblower Ltd.
20. This crew agreement will apply to the first, and all subsequent voyages with Hornblower Ltd and it represents the whole agreement between the parties. Any agreed variations with regard to specific voyages must be in writing.
