Response to Electronic Communication
Crissp will make its best effort to provide a timely response to electronic inquiries. In some cases, those clinic practitioners or staff who need to respond to an electronic inquiry or other communication may not be immediately available so a patient or patient representative should allow at least two (2) business days for a response. Per above, emergency situations requiring immediate attention must not be submitted electronically, nor do we recommend submitting highly important requests, and these should be handled by phone call or during appointments with the physician.
Furthermore, with respect to any electronic communications sent by the patient, we are only able to respond to such communications based on the information provided by the patient. If there is insufficient information provided, we will be unable to provide accurate and reliable services.
OneTouch EMR Revisions
We may revise the information on OneTouch EMR or Crissp website or otherwise change or update OneTouch EMR, including these Terms and Conditions, without notice to you. OneTouch EMR and Crissp website may also make improvements and/or changes in products and/or services described on OneTouch EMR or Crissp website and add new features at any time without notice. We encourage you to periodically read these Terms and Conditions to see if there have been any changes to our policies that may affect you. Your continued use of OneTouch EMR and Crissp website will signify your continued agreement to these Terms and Conditions as they may be revised.

Access to My Family’s Health Info
An individual must be age 18 or older to be accepted as a proxy for a patient. In order to secure proxy access, you need to contact the patient’s practice in order to secure proxy rights. Proxy access will only be granted to parties with parental rights, legal guardianship, or surrogate decision-making responsibilities over the OneTouch EMR account holder and only to the extent that the party requesting access can demonstrate the legal right to that access.
If the legal relationship with the patient changes, you must inform the patient’s practice immediately. Crissp reserves the right to revoke access to a patient’s OneTouch EMR account at any time for any reason.
Pediatric Patients - Parents or guardians of minor children age 0-11 may request access to the minor child’s account by following the terms outlined in the ‘Access to My Family’s Health Info’ section of this Terms and Conditions statement. For patients age 0-11, Crissp requires signed approval from the parent or guardian in order for the parent/guardian to view the child’s health information on OneTouch EMR.
Parents or guardians of minor children age 12-17 may request access to the child’s account by following the terms outlined in the ‘Access to My Family’s Health Info’ section of this Terms and Conditions statement. For patients ages 12-17, Crissp requires signed approval from the parent or guardian in order for the parent/guardian to view some of the child’s health information on Onetouch EMR. Proxies would have access to adolescent test results, allergies, and immunizations; they can message their adolescent’s providers and request appointments on their adolescent’s behalf. Parents/guardians will not have access to information related to sensitive services, such as reproductive health (i.e. pregnancy testing, contraception, testing and treatment for sexually transmitted diseases), and certain mental health and substance use screening and treatments. Because certain sections may contain sensitive information, parent proxy access will be limited as follows:
*Teens and Teen Proxy can see only non-sensitive future and past appointments. For non-sensitive past appointments, the teen and proxy will be able to see notes, including patient instructions, but not the AVS.
Parent proxies of adolescents will not be able to change demographic information in Onetouch EMR as a proxy on behalf of the adolescent. Adolescent patients cannot create a OnetouchEMR account without the parent/guardian signing the appropriate consent and authorization forms.
Disabled Patients over the age of 18 –- Surrogates with decision-making responsibilities for disabled patients 18 or older may request access to the patient’s account by following the terms outlined in the ‘Access to My Family’s Health Info’ section of this Terms and Conditions statement.
In order to secure access to the disabled patient’s OneTouch EMR account, surrogates need to contact the patient’s practice in order to secure proxy rights for the patient. Access will only be granted to parties with surrogate decision-making responsibilities over the OneTouch EMR account holder and only to the extent that the party requesting access can demonstrate the legal right to that access.
If the legal relationship with the patient changes, you must inform the patient’s practice immediately. Crissp reserves the right to revoke access to a patient’s UCSF MyChart account at any time for any reason.
User participation in OneTouch EMR
Patients may use this OneTouch EMR to view certain information displayed from their medical records, including some lab results. Your use of the lab result feature is considered to be a request by you to receive your lab results online.
In addition and per above, although OneTouch EMR displays certain information from your health information, it does not necessarily display all information found in your medical record. If you think that your health information displayed in OneTouch EMR is inaccurate, you can request that Crissp amend your OneTouch EMR health information by messaging your provider within OneTouch EMR.

OneTouch EMR provides you with a number of interactive online services to help you better manage your health. These services may include (but are not limited to):
Secure messaging, which may include:
Message your healthcare provider
Request an appointment or referral
View some past visit information and upcoming appointments
Check some lab results and graph your trends
Refill a prescription
Some of your electronic health information
You agree that you will not upload or transmit any communications or content of any type (including secure messaging) that infringe upon, misappropriate or violate any rights of any party. In general, we recommend that you contact the clinic by phone or at your appointment for any queries that are urgent or important rather than relying solely on secure communications through OneTouch EMR, as this method of communication may not result in timely care. In consideration of being allowed to use OneTouch EMR, you agree that the following actions shall constitute a material breach of these Terms and Conditions:
Signing on as or pretending to be another person (Note: this does not restrict authorized use of OneTouch EMR)
Using secure messaging for any purpose in violation of local, state, national, international laws or posted Crissp policies
Transmitting material that infringes or violates the intellectual property rights of others or the privacy or publicity rights of others
Transmitting material that is unlawful, obscene, defamatory, predatory of minors, threatening, harassing, abusive, slanderous, or hateful to any person (including Crissp personnel) or entity as determined by Crissp in its sole discretion
Using interactive services in a way that is intended to harm, or a reasonable person would understand would likely result in harm, to the user or others
Collecting information about others, including e-mail addresses
Intentionally distributing viruses or other harmful computer code
Any conduct that violates any Crissp policy, procedure, or the Crissp Patient Rights and Responsibilities
Crissp expressly reserves the right, in its sole discretion, to terminate a user's access to any interactive services and/or to any or all other areas of OneTouch EMR due to any act delineated above, or any act that would constitute a violation of these Terms and Conditions.

Crissp Authentication for Third-Party Applications
You may be asked to provide your OneTouch EMR login credentials to connect third-party applications to information available in your OneTouch EMR. These applications may leverage your personal health information to deliver goods and services to you. The information accessed by these applications may include some or all of the following information:
Allergies
Demographics
Health Goals
Implants
Medications
Problems
Immunizations
Care Team
Documents
Health History
Lab Results
Plan of Care
Procedures
Vitals
These applications are not created or managed by OneTouch EMR. Whether you grant or deny access to these applications will not impact your ability to receive medical care at Crissp. If you approve requests by these applications, you allow third parties (the applications, their developers and their associates) to access your personal health information. Note that these third parties may not be obligated to protect your health information under the same privacy regulations as Crissp and your health care providers. Some applications may use your personal health data for advertising or secondary purposes.
When granting access to these applications, you may be providing access to information that could potentially reveal your diagnosis or treatment for drug and alcohol abuse, your mental health status, your HIV status, and/or results of your genetic testing, if applicable. By authorizing access to these third-party applications, you assume the risks of disclosure of such information.
We advise that you carefully review each application’s Terms and Conditions and be sure that you are comfortable with how each application will use your data before granting access.
Security and Confidentiality
We afford the same degree of confidentiality to medical information stored on OneTouch EMR as is given to health information stored by Crissp in any other medium. Crissp is committed to protecting the confidentiality of your health information. We limit Crissp employees’ access and ability to enter or view health information based upon their role in your care. We have taken steps to make all health information received from our online visitors as secure as possible against unauthorized access, use, or disclosure.
You can tell when you are on a secure site by looking at the URL location field. If the URL begins with https:// (instead of http://), then the document comes from a secure server. This means your health information cannot be read or deciphered by unauthorized individuals. You can tell whether you are truly connected to Crissp by viewing the digital certificate. This certificate verifies the connection between the Crissp server’s public key and their server’s identification.
Crissp and many other organizations and individuals such as physicians, hospitals and health plans are required by law to keep your health information private and confidential. If you have authorized the disclosure of your health information or your family’s health information to someone who is not legally required to keep it private and confidential, it may no longer be protected by state or federal privacy and confidentiality laws.
Passwords
Crissp has several tools that allow you to record and store information. You are responsible for taking all reasonable steps to ensure that no unauthorized person shall have access to your OneTouch EMR online password or account. It is your sole responsibility to (1) control the disclosure and use of your activation codes, username and password; (2) authorize, monitor, and control access to and use of your OneTouch account and password; and (3) promptly change your password in OneTouch EMR if it has been compromised.

Crissp allows you to view or download a single copy of the material on OneTouch EMR solely for your personal, noncommercial use.
The compilation of all content on OneTouch EMR and Crissp website is the exclusive property of Crissp and is protected by United States and international copyright laws. Unless specifically authorized in writing by Crissp, any use of these materials, or of any materials contributed to OneTouch EMR by entities other than Crissp, on any other Web site or networked computer environment for any purpose is prohibited.
Any rights not expressly granted by these Terms and Conditions or any applicable end-user license agreements are reserved by Crissp. Content and features are subject to change or termination without notice in the editorial discretion of Crissp.
