Friends of Kootenay Lake Stewardship Society and Living Lakes Canada Parental/Guardian Release & Waiver of Claims, Assumption of Risks and Indemnity Agreement for Minors (the "Indemnity Agreement")
This Indemnity Agreement executed on (date) Date* by First Name* Last Name* (the "Parent") releases Friends of Kootenay Lake Stewardship Society and Living Lakes Canada, nonprofit corporations organized and existing under the Societies Act of British Columbia and each of its directors, officers, employees, agents, funders, and constituents (all of whom are hereinafter referred as the, "Releasees"). The Parent/Guardian's child First Name Last Name desires to participate in the Creek Cleanup* (the "Event") hosted by the Releasee on Date
Parent/Guardian Indemnity Agreement, Release & Waiver of Claims:

I, the Parent, in consideration for my child's participation in the Event, indemnify, release, forever discharge, and hold harmless the Releasees and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, that are made against the Releasees by or on behalf of my child which may arise from the events hosted by the Releasees that my child participates in, whether the claim is based on negligence or fault of the Releasee or otherwise. I understand and acknowledge that this Indemnity Agreement discharges the Releasees from any liability or claim that my child may have against the Releasees with respect to bodily injury, personal injury, illness (including COVID-19), death, or property damage that may result from my child's participation in the Event.

Insurance:

Further I understand that the Releasees do not assume any responsibility for or obligation to provide me or my child with financial or other assistance, including but not limited to medical, health or disability benefits or insurance of any nature in the event of my injury, illness, death or damage to my property. I expressly waive any such claim for compensation on the part of the Resleasees beyond what may be offered freely by the Releasees in the event of such injury or medical expenses incurred by my child.

I hereby release and forever discharge the Releasees from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my child's tenure as a participant in the Event hosted by the Releasees.

Acknowledgment and Assumption of Risk:

I understand that the Event hosted by the Releasees that my child participates in may include activities that may be hazardous to them, including, but not limited to, walking, using observation equipment, boat travel, changes in weather, wildlife, working with others, exposure, work in and around water, transport to the location by vehicle, slips, trips and falls and similar inherently dangerous activities. As the Parent I hereby expressly assume the risk of injury or harm to my child from these activities and release the Releasees from all liability for injury, illness, death or property damage occurring while my child is participating in the Event.

As the Parent, I expressly agree that this Indemnity Agreement is intended to be as broad and inclusive as permitted by the law of British Columbia. I acknowledge that I have the right to seek independent legal advice regarding this Release and Waiver of Liability. I agree that in the event that any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected.

Media Release:

In consideration for my child's participation in the Event, I also grant the Releasees
permission to take photos or digital recordings of my child during the Event listed
above. The releasees will retain exclusive rights to use these photos or digital recordings in publications, both print and electronic. I further consent that my child's name and identity may be revealed therein or by descriptive text or commentary. I understand that there will be no financial or other remuneration for recording my child, either for initial or subsequent transmission or playback. I represent that I am at least 19 years of age, have read and understand the foregoing statement, and am competent to execute this agreement.
