Release, Covenant Not to Sue & Consent

I acknowledge that

Colorado Beef Council

together with its:

directors, employees, representatives, successors, agents and assigns called here, the Council) is conducting and/or associated with an activity called Team Beef. I understand that participation as a member of Team Beef (Member) involves rigorous physical exertion including running and training to run and may be hazardous and expose me and others to risks of injury (and death), loss of or damage to property and other harms (Risks).

In consideration of being permitted to be a Member and to participate in Team Beef activities, including training and workout sessions, races, associated social events and pre- and post-race activities, for myself and my heirs, executors, successors and assigns:

(a) I expressly assume all Risks, known and unknown, associated with being a Member and participating in Team Beef and I represent that I am fit and able, physically, mentally and otherwise, to be a Member and participate in Team Beef.

(b) I waive all rights, claims and causes of action I have or may have in the future against the Council as a result of being a Member or participating in Team Beef (Claims).

(c) I agree to indemnify the Council for all Claims for losses and harms, including attorney's fees and court costs which the Council suffers as a result of my being a Member or participating in Team Beef (Harms).

(d) I release and covenant not to sue the Council for any Claims I now have or may have in the future against the Council for Harms.

(e) I consent, in connection with my status as a Member or participant in Team Beef activities, to being interviewed, videotaped, recorded and photographed by or through the Council by any audio and/or visual recording technique (including electronic/digital) now in existence or in the future invented.

I grant full permission to the Council to store, use and/or reproduce my image, likeness and/or voice, in whole or part, so videotaped, recorded or photographed, for commercial and marketing purposes or any other purpose the Council reasonably determines.

I have carefully read this document, fully understand it and by signing it consent to its terms. If I am under 18 years of age at the time of becoming a Member or participating in Team Beef, my parent(s) or legal guardian(s) have carefully read this document, fully understand it, and by signing it consent to its terms on my behalf.
