Release and Waiver of Liability
With my signature, herein this document/form, I agree to participate in the event/program corresponding with this form hosted by iRef Big Balls Up, Inc. and its affiliates, a business organized and existing under the laws of the State of Texas and each of its directors, officers, and agents, under the following conditions:
I understand a Participant is defined as any community member who completes this form, meets iRef Big Balls Up, Inc. and its affiliates' participant qualifications, including and not limited to payment and/or age requirements.
As a Participant, I desire and agree to engage in activities relevant to the event/program described herein this form and hosted by iRef Big Balls Up, Inc. and its affiliates. I understand that the scope of my Participant relationship with iRef Big Balls Up, Inc. and its affiliates is limited to the event participant guidelines, safety regulations and any other procedures explained to me during the duration of this event/program by iRef Big Balls Up, Inc. and its affiliates.
I, the participant acknowledge that I am responsible for my own insurance coverage in the event of personal injury or illness as a result of participating in the event/program described herein this form that is hosted by iRef Big Balls Up, Inc. and its affiliates.
(1) Waiver and Release
I, the Participant, release and forever discharge and hold harmless iRef Big Balls Up, Inc. and its affiliates and assigns form any and all liability, claims, demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise during my participation in the event/program described herein this form.I understand and acknowledge that this Waiver and Release discharges iRef Big Balls Up, Inc. and its affiliates from any liability or claims that I may have against iRef Big Balls Up, Inc. and its affiliates with respect to bodily injury, illness, death, or property damage that may result from or occur during my participation in the event/program described herein this form.
(2) Insurance
Further, I understand that iRef Big Balls Up, Inc. and its affiliates does not assume any responsibility for or obligation to provide me, the Participant, with financial or other assistance, including but not limited to medical health or disability benefits or insurance of any nature in the event of such injury or medical expenses incurred by me, the Participant.
(3) Medical Treatment
I hereby release and forever discharge iRef Big Balls Up, Inc. and its affiliates from any claim whatsoever which may arise or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with any emergency during my tenure as a Participant in the event/program hosted by iRef Big Balls Up, Inc. and its affiliates.
(4) Assumption and Risk
I understand that being a Participant with iRef Big Balls Up, Inc. and its affiliates may include activities that may be hazardous to me, including and not limited to running, walking, changing weather conditions and using iRef Big Balls Up, Inc. and its affiliates' supplies and/or equipment. I hereby expressly assume the risk of injury or harm from these activities and release iRef Big Balls Up, Inc. and its affiliates from all liability for injury, illness, death or property damage resulting from my participation or occurring while I am Participant in the event/program hosted by iRef Big Balls Up, Inc. and its affiliates.
(5) Photographic Release
I grant and convey to iRef Big Balls Up, Inc. and its affiliates all the right, title, and interests in any and all photographs, images, video, or audio recordings of me or my likeness or voice made by iRef Big Balls Up, Inc. and its affiliates in connections with my choice to be a Participant in the event/program hosted by iRef Big Balls Up, Inc. and it's affiliates.
(6) Validity
As a Participant of iRef Big Balls Up, Inc. and its affiliates, I expressly agree that this Waiver and Release is intended to be as broad and inclusive as permitted by the laws of the state of Texas and that this Release shall be governed by and interpreted in accordance with the laws of the state of Texas. I agree that in the event that any clause or provision of this Waiver and Release is deemed invalid, the enforceability of the remaining provisions of this release shall not be affected.
