Assumption of Risk
Rock Solid Fitness Club ASSUMPTION OF RISK, WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT The activities at Rock Solid Fitness Club include, but are not limited to, gymnastics instruction, fitness class/workouts, trampoline classes/instruction, These activities provide an opportunity for fun; improved physical fitness; vigorous, healthful exercise; exciting group competition; improved agility and balance; wholesome recreation; and other benefits. Gymnastics is an inherently dangerous activity. The activity and exertion level can range from moderate to very vigorous depending upon your desire. The activity is suitable for those with gymnastics experience as well as those with absolutely no experience who use sufficient caution. Rock Solid Fitness Club regards your safety and the safety of others as a top priority. We take great care to reduce the traditional risks associated with gymnastics by having padded walls, padded rails, padded hard-surface areas, required safety speech or video, safety equipment, harnesses for learning stunts, available instruction, trained supervisors at all areas, trained spotters, foam pits, personnel certified in emergency care, and many other safety features. However, regardless of the care taken to avoid injuries, some risks are inherent in the activity and cannot be totally eliminated. These inherent risks include, but are not limited to, falls, collisions with other participants (hereafter referred to as "CO-PARTICIPANTS"), contacting a hard surface (e.g., an uncovered beam, frame, or rail; exposed springs or hooks), landing incorrectly, catching a foot or other body part under a pad. Inherent risks also include unexpected equipment failure; unknown facility hazards; careless behavior by you or CO-PARTICIPANTS; errors in judgment by an Rock Solid Fitness Club employee; and injuries caused by negligence on the part of Rock Solid Fitness Club, its employees, you or CO-PARTICIPANTS. ASSUMPTION OF INHERENT RISKS I understand that the inherent risks of Rock Solid Fitness Club activities are serious and that some of these activities involve dangers regardless of the care taken by Rock Solid Fitness Club. I realize that Rock Solid Fitness Club activities require some degree of skill, coordination, and physical fitness. I have read the previous paragraphs and I know the nature of the Rock Solid Fitness Club activities; I understand the demands of those activities relative to my physical condition and skill level; and I appreciate the types of injuries that may occur as a result of such activities. I hereby assert that my, and, if applicable, my child's or ward's, participation at Rock Solid Fitness Club is voluntary and that I knowingly assume all inherent risks of the activity on behalf of myself and, if applicable, my child or ward.
Release of Liability
In consideration of participating in programs at Rock Solid Fitness Club I represent that I understand the nature of this Activity and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participation in the activity. I fully understand that this Activity involves risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by my own actions, or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the "releasees" named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, cost, and damages I incur as a result of my participation in the Activity. I hereby release, discharge, and covenant not to sue Rock Solid Fitness Club its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the "RELEASEES" herein) from all liability, claims, demands, losses, or damages, on my account caused or alleged to be caused in whole or in part by the negligence of the "releasees" or otherwise, including negligent rescue operations and future agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any loss, liability, damage, or cost, which any may incur as the result of such claim. I have read the RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect. Rules & Policies
ANNUAL INSURANCE & MEMBERSHIP An annual membership/insurance charge of $60 will be assessed to each student for secondary insurance and administrative costs.This pricing is subject to change without notice.
TUITION: Tuition is based on a 4-week session. Classes are ongoing and enrollment renews each session unless you notify us in writing before the next session of your intent to discontinue or take a break. Students are expected to attend their scheduled class. Monthly tuition will auto draft on the first of each month. This will remind you to notify us if you plan to stop classes. Due to our limited occupancy Rock Solid is not able to offer credits, refunds or make up classes.
PICK UP & DROP OFF Students can arrive up to 10 minutes early if they are with a supervising adult. Students must be picked up promptly at class dismissal. Adults who drop off athletes must wait for the child to be out on the floor before leaving and must be back to pick up 5 minutes before the class ends. Students who are picked up late or dropped off early, without supervision, will be charged a childcare fee of $20 every half hour 10 mins after the class ends.
DRESS CODE: Students should wear a leotard or a t-shirt with leggings, sweatpants, or gym shorts during class. Children's torsos should be completely covered. No jeans, skirts, dresses, zippers, buttons, or snaps should be worn in class. No shoes are allowed on the gym floor, students should have bare feet, with no socks or tights. Street clothes and shoes can be left in the cubbies provided at the entrance to the gym. Hair must be pulled back from the face and secured in a ponytail or braid during class times. No jewelry or hats are allowed while participating in class.
HOLIDAYS: Holidays are fixed into the Session tuition, and Rock Solid will not be open or charge tuition for the following holidays: Thanksgiving, Winter Break, Memorial Day, Independence Day, Labor Day, Spring Break, select dates for staff family vacations.
INJURY AND ILLNESS: Children who are injured should not attend gymnastics without a doctor's clearance. Gymnasts who are injured but can participate with a modified workout must have instructions from their doctor stating what they can and cannot do. Children who are showing signs of illness may not attend gymnastics class. If they did not attend school, they should not attend class. This includes but is not limited to: a runny nose, cough, fever, sore throat, loss of taste or smell, headache, diarrhea, fatigue. The instructor will also make a visual inspection searching for signs of illness. Any children who are ill will be sent home.
BEHAVIOR: Children who participate at Rock Solid must exhibit good behavior at all times. Students displaying disorderly conduct before or during class will first given a warning to stop the undesirable behavior, if the behavior persists the child will be given a time out, if the behavior continues the parent will be notified and finally, if the behavior does not cease, the child will be asked to leave the class if they are interfering with the conduct of the class.
SPECTATOR POLICY: ONE adult is allowed in the gym with children, a seating area will be provided. Space is limited. Please do not photograph or videotape any student unless approved by Rock Solid management. This is to protect the privacy of the other students in class.
FOOD Eating, drinking, smoking, or gum chewing is not allowed in or around the training area. Cubbies are for daily use only. They are not assigned, and personal items should not be left in them overnight. Valuables should be left at home. Rock Solid is not responsible for lost or stolen items.
Medical Emergencies
ACKNOWLEDGEMENTS TO PROMOTE SAFETY AT Rock Solid Fitness CLUB These acknowledgements aid Rock Solid Fitness Club in providing for your safety. Health Status I, on behalf of myself and, if applicable, my child or ward, assert that I and, if applicable, my child or ward, possess sufficient physical fitness and coordination to enable safe participation in Rock Solid Fitness Club activities. I and, if applicable, my child or ward, assume the risks of all medical conditions (e.g., asthma, diabetes, anaphylaxis, epilepsy, heart disease or high blood pressure). Rock Solid Fitness Club encourages me and, if applicable, my child or ward, to get medical clearance prior to participation. I and, if applicable, my child or ward, will cease activity if there is discomfort (e.g., faintness, shortness of breath, high anxiety, or chest pains). Emergency Care I, on behalf of myself and, if applicable, my child or ward, assert that Rock Solid Fitness Club can administer emergency first aid, CPR, and use an AED if deemed necessary. Rock Solid Fitness Club can secure emergency medical care or transportation (i.e., EMS) if deemed necessary. I assume all costs of emergency medical care and transportation.
Payment Policies
Payment Agreement for Rock Solid I authorize Rock Solid Fitness Club to charge my Credit Card or ACH payment from my bank upon enrolling in a Rock Solid class. We accept mastercard, visa, discover, or ACH bank payments only. I will notify Rock Solid Fitness Club in writing of new expiration dates or other changes related to my credit card on file. No refunds or credits for sessions. Please be sure to pay for your enrollments in the Parent Portal. Enrollment is ongoing and you will be automatically enrolled each session unless you notify us in writing before the session starts of your intention to discontinue or take a break. A $30.00 fee will be applied to the account for all declined our returned payments. Students will not participate in classes until the balance is paid in full.
Policy Review
I understand that the Rules and Policies for Rock Solid Fitness Club can be emailed to me upon request.. I understand that Rock Solid Fitness Club's Rules and Policies are subject to change and that the updated policies will be posted on site and published to the Rock Solid Fitness Club website. I am aware that individual and group publicity photos and videos are taken from time to time and in consideration for my children's participation, I hereby grant my permission for my child's likeness to be used in Rock Solid Fitness Club publicity or advertising. Late Pick Up Fee: We love spending time with your kids! However, our staff is quite busy throughout the day and does not have time to watch them after class or camp has ended. Therefore, when students are picked up after their scheduled end time, Rock Solid Fitness Club reserves the right to charge a late pick up fee of $20 every half hour after their class ends. We know things can happen. If you will not be on site for on-time pickup, be sure to call and let us know. We want to be sure we can keep your child(ren) safe until you arrive!
