  • R. E. Harrington Plumbing, Heating & Utilities welcomes our association with your company, this agreement outlines your responsibility as a subcontractor, Please sign and return to info@reharrington.com and/or fax to (410) 466-0700.

    1. As a subcontractor, you’ve become part of an organization that promotes communication and team work. We depend on your assistance in assuring that our projects are completed on time and within the agreed budget. If you anticipate a problem not addressed in our plans, or encounter any technical problem please notify the site superintendent immediately

    2. All your personnel, when reporting to work, should be, prompt, properly dressed and have all the necessary tools and safety equipment to complete their assignment, minus any items that are agreed to be provided by R. E. Harrington Plumbing, Heating & Utilities Please ensure your employee’s act and speak in a professional manner at all times.

    3. Referrals: If any clients request works directly from you, such as, work outside your scope, please refer them to the site superintendent or our office.

    4. Change Orders: All change orders must be approved by an Authorized Agent of R. E. Harrington Plumbing, Heating & Utilities of our office, NO EXCEPTIONS.

    5. Insurance: All subcontractors shall provide our office with workers’ Compensation and general liability certificates, listing R. E. Harrington Plumbing, Heating & Utilities as additional insured prior to commencement of work. Also provide a copy of an occupational license, completed W-9, and Federal ID # if you’re a corporation.

    6. Hold Harmless: To the fullest extent by law, the Subcontractor shall indemnify the Contractor, Owner and their agents from and against claims, damages, losses, expenses and fees arising out of resulting from performance of the subcontractor’s work.

    7. Job Schedule: For any reason you go to a job and additional work is needed before you can precede, please contact an Authorized Agent of R. E. Harrington Plumbing, Heating & Utilities immediately.

    8. Client Relations: Be cordial: refer all questions and or problems to an Authorized Agent of R. E. Harrington Plumbing, Heating & Utilities.

    INDEPENDENT CONTRACTOR ACKNOWLEDGEMENT

  • enters into a certain arrangement or affiliation with R. E. Harrington Plumbing, Heating & Utilities, as of this date. In accordance therewith the Undersigned confirms:

    1-The Undersigned is an independent contractor and is not an employee, agent, partner or joint venture of or with the Company.

    2-The Undersigned shall not be entitled to participate in any vacation, medical or other fringe benefit or retirement program of the Company and shall not make claim of entitlement to any such employee program or benefit.

    3- The Undersigned shall be solely responsible for the payment of withholding taxes, FICA and other such tax deductions on any earnings or payments made, and the Company shall withhold no such payroll tax deductions from any payments due. The Undersigned agrees to indemnify and reimburse the Company from any claim or assessment by any taxing authority arising from this paragraph.

    4- The Undersigned and Company acknowledge that the Undersigned shall not be subject to the provisions of any personnel policy or rules and regulations applicable to employees as the Undersigned shall fulfill its responsibility independent of and without supervisory control by the Company.

  • SUBCONTRACTOR'S INSURANCE

    SUBCONTRACTOR'S INSURANCE

  • Before commencing the Subcontract work, and as a condition precedent to any payment, the Subcontractor shall purchase and maintain insurance in conformance with the provisions contained in this Exhibit. This insurance will provide a defense and indemnify the Contractor, but only with respect to liability for bodily injury, property damage and personal and advertising injury caused in whole or in part by the Subcontractor’s acts or omissions or the acts or omissions of those acting on the Subcontractor’s behalf.


    Proof of this insurance shall be provided to the Contractor before the work commences, as set forth below. To the extent that the Subcontractors subcontracts with any other entity or individual to perform all or part of the Subcontractor’s work, the Subcontractor shall require the other Sub-Subcontractors to furnish evidence of equivalent insurance, in all respects, terms and conditions as set forth herein, prior to the commencement of work by the Sub-Subcontractor. In no event shall the failure to provide this proof, prior to the commencement of the work, be deemed a waiver by the Contractor of Subcontractor’s or the Sub-Subcontractor’s insurance obligations set forth herein.


    In the event that the insurance company(ies) issuing the policy(ies) required by this exhibit deny coverage to the Contractor, the Subcontractor or the Sub-Subcontractor will, upon demand by the Contractor, defend and indemnify the Contractor at the Subcontractor’s or Sub-Subcontractor’s expense.


    Minimum Limits of Liability
    The Subcontractor must maintain the required insurance with a carrier rated A- or better by A.M. Best. The Subcontractor shall maintain at least the limits of liability as set forth below:

    POLICY ON HARASSMENT

  • Consistent with our policy of equal employment opportunity, harassment in the workplace based on a person's race, sex, religion, national origin, age, height, weight, marital status or disability will not be tolerated concerning employees or applicants for employment.

    One aspect of our policy requiring some clarification is the prohibition of any form of sexual harassment in the workplace. The following describes the type of conduct that is prohibited as well as the complaint provisions to investigate and remedy any problems that may arise.

    Sexual harassment includes unwelcome sexual advances, requests for sexual favors, and other verbal, visual or physical conduct of a sexual nature. No employee shall threaten or insinuate, either explicitly or implicitly, that another employee's or applicant's refusal to submit to sexual advances will adversely affect that person's employment, work status evaluation, wages, advancement, assigned duties, or any other condition of employment or career development. Similarly, no employee shall promise, imply or grant any preferential treatment in connection with another employee or applicant engaging in sexual conduct.

    Sexual harassment also includes unwelcome sexual flirtations, advances or propositions, verbal abuse of a sexual nature, subtle pressure or requests for sexual activities, unnecessary touching of an individual, graphic or verbal commentaries about an individual's body, sexually degrading words used to describe an individual, a display of sexually suggestive objects or pictures in the workplace, sexually explicit or offensive jokes, or physical assault.

    Any employee who feels that he/she is a victim of sexual harassment, including but not limited to, any of the conduct listed previously, by any supervisor, management official, other employee, customer, client or any other person in connection with employment at      R. E. Harrington Plumbing, Heating & Utilities should bring the matter to the immediate attention of Human Resource Department.

    If that would prove to be uncomfortable, an employee may directly contact any other member of management. Every effort will be made to promptly investigate all allegations of harassment in as confidential a manner as possible and appropriate corrective action taken if warranted.

    After an investigation, any employee determined to have engaged in sexual harrassment in violation of this policy will be subject to appropriate disciplinary action up to and including termination of emplyment.

    SUBCONTRACTOR SAFE WORK PRACTICES GUIDELINES

  • Scope: This document applies to all subcontractors performing work for R. E. Harrington Plumbing, Heating & Utilities.

    1. Responsibilities

    a) Subcontractor shall comply with all OSHA regulations as well as state and federal laws applicable to the job.

    b) Subcontractor shall cooperate in the conducting of inspections by personnel of the Company, our insurance carriers, representatives of the Owner, or of any government agency.

    c) Subcontractor shall ensure that all subcontractor personnel are properly trained and instructed on all tasks, which require specific training, certifications, and/or competency to meet all applicable EPA, DOT, OSHA, MSHA, or other governmental regulations and all applicable sites Owner, General Contractor, or Company requirements. Subcontractor shall be able to provide documentation of such training to the Company upon request

    d) Where the Company’s personnel are overseeing a jobsite on a day to day basis, he/she will monitor the work practices for all workers on a regular basis to ensure these practices meet OSHA requirements, these guidelines, and any other applicable laws or owner requirements regarding safety.

    e) Subcontractor shall ensure that the work environment is free from any unwelcome or offensive behavior that could constitute harassment based on race, religion, color, sex, or any other characteristic protected by law.

     

    2. Safety Violation

    a) The Company’s personnel have the right to observe and stop work until safety violations are corrected

    b) An initial infraction will result in an oral notification from the subcontractor’s supervisory personnel and to that individual.

    c) A second infraction will result by a subcontractor’s employee meeting with the management of the Company. Written records will be made of such violations.

    d) Subcontractor’s entire workforce may be removed from the jobsite where violation of safety regulations is widespread.

    e) Subcontractors that are uncooperative or that have unsatisfactory safety evaluations can be removed from bid lists.

    f) Horseplay and practical jokes or abusive and aggressive behavior are forbidden and can lead to immediate expulsion from the site.

     

    3. Reporting of Injuries

    a) Subcontractors will immediately notify orally and in writing the Company of any injury or property damage related to the job.

    b) Subcontractor will furnish the Company’s supervisor with a copy of an accident report for any injury or property damage sustained or caused by subcontractor’s employees while working on the Company’s jobsite within 24 hours of the incident.

  • 4. Subcontractor Equipment

    a) All subcontractor equipment on jobsite must be in proper working condition and routinely inspected for defects.

    b) Any equipment found to be defective must be removed and /or repaired before it can be used again on jobsite.

    c) Equipment is not to be used with loads which exceed the recommended rated capacity.

    d) Equipment and tools must be used for their designated purpose.

    e) Tools and equipment are to be used only by qualified personnel.

    f) Proper guards or shield must be installed and used with all power tools.

     

    5. Hazard Commuinication

    a) Subcontractor must provide the Company’s supervisor with or maintain on site Material Safety Data Sheets for any hazardous materials that will be delivered to or used on the jobsite.

    b) All containers on the jobsite must be properly labeled

    c) Subcontractors must have a written Hazard Communication Program.

     

    6. Housekeeping

    a) All subcontractor construction material are to be stored in a neat and orderly manner.

    b) All stairwells, exists, and access ways are to be kept unobstructed.

    c) All scrap and trash must be cleaned up daily.

    d) Dispose of paints, PCB containing ballasts, oil, hazardous chemicals, paints, mercury containing bulbs (includes fluorescent & high intensity discharge-HID), waste oil, and oily rags per state and federal environmental regulations. Do not use site or Company provided container for these wastes.

    e) Store oily rags in a covered container and remove from site daily.

    f) Sweeping and cleaning will be done using methods that minimizes the creation of airborne dust and silica.

    g) Never used compressed air or gasses to blow dust off of any person or surface.

     

    7. Personal Protection Equipment (PPE)

    a) Subcontractor must supply personal protective equipment for subcontractor employees.

    b) ANSI Z87 rated non-prescription safety glasses with permanently affixed side shields or add-on shields providing adequate brow and side protection for employee owned ANSI Z87 rated prescription lenses or ANSI Z87 rated prescriptions lenses or ANSI Z87 rated goggles are required.

    c) Hardhats meeting ANSI Z89.

    d) Protected toe work boots meeting ANSI Z41.

    e) Respiratory, hearing, face, skin, eye, and hand protection are required on jobsite for any applicable tasks requiring such protection.

    f) At the discretion of Company management with concurrence of the Safety Director exemptions to these PPE requirements may be granted depending on the lack of hazard exposure.

  • 8. Fall Protection

    a) Fall protection is required fall all employees working more than 6 feet above the ground or other surface. This includes any employees working on flat or sloped roof edges, suspended platforms, open sided floors or other openings more than 6 feet above the ground or other surface.

    b) When personal fall protection is required, the use of safety belts will not be allowed. Only full body harnesses with shock absorbing lanyards or self retracting lifelines are permitted.

     

    9. Clothing

    a) Shirts with sleeves and long pants should be worn at all times on the jobsites. Clothing that is ripped, torn or with inappropriate or degrading language or art work is prohibited.

    b) Work boots or work shoes must be worn at all times on the jobsite

    c) Avoid loose clothing when working with any power tools or equipment.

    d) At the discretion of Company management with concurrence of the Safety Director clothing requirements may be modified depending on the type of work, hazard exposure, or temperature conditions.

    10. Rigging Equipment

    a) Never rig from a structural member until a determination has been made by the subcontractor qualified representative that it will support the load being raised.

    b) All chain hoists, ropes, hooks shackles, and beam clamps must be inspected visually before use. 

    c) Do not leave an unattended and unsecured load hanging on a hoist.

     

    11. Scaffold Systems

    a) Fall protection is required on all scaffold platforms 10 feet or more above the floor or ground.

    b) Supported scaffolds with a height to base width ratio of more than 4:0 must be restrained by guying, tying bracing, or an equivalent means.

    c) Scaffold is to be erected on a firm base. No unstable objects (wooden blocks, concrete blocks, rocks, ect may be used to support scaffold.

    d) Working platforms on scaffold must be fully planked with planks that meet or exceed OSHA regulations.

    e) All connections, including casters on rolling scaffolds must be pinned.

    f) Wheels on rolling scaffolds must be locked when the scaffold is in use.

     

     12. Main Lifts

    a) Inspect all man lifts and work area before use. Do not use a damaged man lift.

    b) Only trained personnel may use a man lift.

    c) Only use scissors lifts with both feet on the floor and with all safety gates and chains in place.

    d) Man lifts other than scissor lifts require use of fall protection with a full body harness.

    e) Do not use the man lift as a crane.

    f) Do not overload the man lift

    g) If outriggers are required, they must be used.

    h) Maintain adequate clearance from energized lines.

    i) Do not use whwre exposed to high winds or adverse weather conditions.

     

    13. Forklifts
    a) Employees operating a forklift must be trained and certified in its operation.

    b) Inspect before each shift.

    c) Never pick up more than the forklift is rated for.

    d) Use forklifts per manufacturer’s operating and use instructions.

     


    14. Owner Requirements
    a) All subcontractors must comply with any specific Owner or General Contractors safety requirements more stringent than the Company’s OSHA’s or the Subcontractors policies or procedures. Subcontractors will be notified of any such requirements prior to start of project.

     


    15. Job Specific Safety Guidelines
    b) All subcontractors must comply with any Job-Specific Safety Guidelines published by the Company. Subcontractors can obtain said guidelines in the Corporate Office of the Company at 300 W 23rd Street, Baltimore Maryland 21211.
