These Terms and Conditions ("Agreement") are hereby revised between Dillard's Leadership Alliance, LLC, operating as The Write Business Solutions ("Service Provider"), and the undersigned client ("Client") regarding the services provided by the Service Provider to the Client.
Services: The Service Provider agrees to deliver the following services to the Client in accordnace to their purchase(s):
a) Sponsorship acquisition writing
b) Grant proposal writing
c) Research and reading services
d) Editing services
One, multiple, or all services purchased and fully paid for will be provided by the Service Provider.
Scope of Services: The Service Provider shall execute the services outlined in section 1 of this Agreement in accordance with the Client's specifications, employing reasonable care and skill.
Turnaround Time for Services:
1.) Sponsorship Packages: The Service Provider shall endeavor to complete sponsorship packages within a turnaround time of 4-6 weeks from the date of initial engagement, subject to the complexity of the project and the availability of necessary information from the Client. This timeframe allows for thorough research, strategy development, content creation, review cycles, and finalization of the sponsorship package.
2.) Grant Proposal Creation: Grant proposal creation timelines adhere to industry standards and best practices. The Service Provider aims to deliver grant proposals within a reasonable timeframe, typically ranging from 6-8 weeks from the commencement of work. This timeframe accommodates the comprehensive research, proposal drafting, review processes, and any necessary revisions to ensure the proposal meets the requirements and objectives of the funding opportunity. Please note that specific project requirements and complexity may impact the exact duration of the proposal creation process.
Fees: The Client agrees to remit flat-rate fees to Dillard's Leadership Alliance, LLC, operating as The Write Business Solutions, as follows:
All fees are exclusive of any applicable taxes, duties, or levies.
Payment: The Client agrees to remit the full payment of fees within 1 day of receiving the invoice from The Write Business Solutions. Work shall not commence until the invoice is paid in full. Additionally, any additional fees incurred for last-minute submissions (within 1 week of the due date) will be subject to an expedite fee.
Renewal and Termination: Each service fee shall be valid for one-time payment and does not require annual renewal unless terminated by either party in writing.
Cancellation and Refunds: In the event that the Client wishes to cancel services provided by The Write Business Solutions, they must provide written notice to the Service Provider. Refunds will be handled as outlined below:
1. If work has not commenced on behalf of the client, a full refund will be issued, deducting only a $500 consultation fee included in the price.
2. If services are terminated after work has commenced for the client, the equivalent of $30 per hour of serviced work will be deducted from the balance, with the remaining amount refunded to the Client.
Intellectual Property: The Client acknowledges that any intellectual property generated or utilized in rendering the services remains the property of The Write Business Solutions unless otherwise agreed upon in writing by both parties.
Confidentiality: The Service Provider commits to maintain confidentiality regarding all information shared by the Client and will not disclose it to any third party unless mandated by law.
Limitation of Liability: The Service Provider shall not be liable to the Client or any third party for any damages, including indirect, incidental, special, or consequential damages, arising from the services provided by The Write Business Solutions.
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state or country in which The Write Business Solutions operates.
Entire Agreement: This Agreement constitutes the entire understanding between Dillard's Leadership Alliance, LLC, doing business as The Write Business Solutions, and the Client, superseding all prior agreements, written or oral, pertaining to the services provided.
Amendments: Any modifications or amendments to this Agreement shall be valid only if made in writing and signed by both parties.
Chargebacks: The Client agrees not to initiate fraudulent chargebacks related to fees paid to The Write Business Solutions. In the event of a chargeback initiated by the Client, the Service Provider reserves the right to terminate this Agreement immediately. The Client shall be liable for any fees and costs incurred by The Write Business Solutions due to the chargeback.
Guarantees Disclaimer and Good Faith Clause:
The Service Provider makes no guarantees or assurances regarding the successful acquisition of grants or sponsorships on behalf of the Client. While every effort will be made to diligently pursue funding opportunities, the Service Provider cannot guarantee the outcome of any grant proposal or sponsorship acquisition. All work performed by the Service Provider is conducted in good faith, with the aim of achieving the best possible results for the Client.
By signing below, the Client acknowledges having read and understood this Agreement and agrees to be bound by its terms and conditions.
