MALLARD OIL COMPANY
PROPANE SERVICE AGREEMENT
TERMS & CONDITIONS

• Customer agrees to pay to Mallard Oil Company a yearly lease fee of $75.00 plus applicable sales tax if customer fails to purchase a minimum of 300 gallons annually. If you own your own tank. the lease fee does not apply.
• Customer grants Mallard Oil Company the exclusive right to supply all propane at this location and understands that Mallard Oil Company shall retain ownership of all provided equipment if the customer chooses not to purchase this equipment.
• Customer grants Mallard Oil Company an casement and right of way upon customer's property to provide routine delivery, service, maintenance, or removal of Mallard Oil Company equipment.
• Customer will be responsible for charges related to removing all equipment upon termination of service.
• Customer agrees to pay Mallard Oil Company for all services as outlined and shall reimburse Mallard Oil Company all legal or third-party fees incurred for collection of past due accounts.

Delivery - Keep Full

• Mallard Oil Company attempts to serve all accounts on a "KEEP FULL" system. We have found through experience that this is the most cost-effective way to ensure customer convenience and prevent interruption of service (i.e., out of gas This also allows us to build a margin of error to prevent outages during unexpected severe weather conditions that arise from time to time.
• If we are unable to service your tank on the normal route cycle because of a past due balance. refusal of delivery, blocked drive, dog, etc., a service fee will be assessed if a delivery is requested prior to the next scheduled delivery cycle. If this results in an "out of gas" condition, we are required to performa leak test in accordance with NFPA 58 6.17.2. A service fee will be assessed for the required leak test.

Payment

• Mallard Oil Company may require a security deposit and/or require payment before delivery.
• Delivery drivers will leave a priced invoice at the time of delivery. For your convenience, you can view your account and make payments at mallardoil.com or on our mobile app. You may pay the driver or mail your payment in the envelope provided at the time of delivery. Payment may also be made at our office Monday through Friday between the hours of 8 AM and 5 PM. All billing inquiries should be directed to our office during regular business hours.
• All invoices are due on or before the 15th of the month following delivery (i.e., any delivery in March is due in full no later than April 15th.
• A finance charge of 1.5 percent per month will be assessed on past due balances with a minimum charge of .75 per month. Budget payment plans are available.
• Mallard Oil Company reserves the right to terminate service to any customer who fails to meet payment terms outlined in this agreement, or who continuously pays in such a manner as to prevent regular route deliveries.
• Mallard Oil Company reserves the right to make changes to the Terms & Conditions. These changes will be posted on our website, mallardoil.com, 30 days prior to implementation.
