WAIVER FORM* This field is required.This is a Waiver, Release of Liability, and Indemnification Agreement (the “Agreement”). Please read carefully before signing. In consideration of Off-Leash Dog Bar, LLC, a Nebraska limited liability company (“Off-Leash”) allowing me (and my dog(s), if applicable) access to and use of the premises located at 1975 M Street, Lincoln, Nebraska (the “Premises”) I, the undersigned, intending to be legally bound hereby, represent, warrant, covenant and agree as follows:1. RISKS TO PERSONS. I am aware and understand that interacting with dogs in an open-play environment, whether such dogs are on-leash or off-leash, involves a risk of physical injury, death, and property damage to any individual engaging in such activities including, but not limited to, personal injuries arising from a dog biting, jumping, or running into an individual. I am aware and understand that dogs, irrespective of their training, past behavior, and characteristics may act or react unpredictably at times which is an inherent risk assumed by the undersigned.2. RISKS TO DOGS. In the event I bring my dog(s) to the Premises, I am aware and understand that allowing my dog(s) to interact with other dogs in an open-play environment, whether those dogs are on-leash or off-leash, involves a risk of transferring communicable illness and physical injuries to my dog including, but not limited to, bites, lacerations, and other wounds.3. CERTIFICATION. In the event I bring my dog(s) to the Premises, I hereby certify that (a) my dog(s) does not have a history of aggression towards people or other dogs and that they are properly socialized for group play, (b) my dog(s) is current on all vaccinations including Rabies, DHLPP/Da2PP and Bordetella, and (c) my dog(s) is in compliance with the City of Lincoln Municipal Code.4. ACKNOWLEDGEMENT. I AM FULLY AWARE OF THE RISKS AND DANGERS INVOLVED AND HEREBY ACCEPT AND ASSUME ANY AND ALL RISKS OF PERSONAL INJURY, DEATH, AND PROPERTY DAMAGE TO MYSELF, MY DOG (IF APPLICABLE), MY PROPERTY, OR TO ANY OTHER PERSON AND/OR DOG WHICH RESULTS FROM MY PRESENCE OR MY DOG’S PRESENCE (IF APPLICABLE) AT THE PREMISES. In the event I bring my dog(s) to the Premises, I am aware and understand that I will be in sole control and possession of my dog(s) and that the Off Leash staff is not ultimately responsible for my dog(s). 5. HOUSE RULES. By affixing my signature below, I am acknowledging my agreement to comply with all rules and regulations whether posted on Off-Leash’s website or on signage in the Premises, as the same may be amended from time to time (collectively, the “House Rules”). I acknowledge Off-Leash reserves the right to refuse admittance to any person or dog that does not comply with the House Rules or exhibits behavior that is deemed inappropriate or dangerous to other patrons or dog(s) by Off-Leash in its sole discretion.6. RELEASE. To the fullest extent permitted by law, the undersigned (and on behalf of the undersigned’s personal representatives, heirs, next of kin, and assigns) RELEASES, WAIVES AND DISCHARGES, AND COVENANTS NOT TO SUE, Off-Leash and its members, managers, representatives, agents, employees, lessors, successors, and assigns(collectively, the “Releasees”) from any and all damages, losses, penalties, liabilities, costs, attorney’s fees and expenses of any nature, the cost of pursuing any insurance providers, and any demands, claims, suits, and causes of action therefor, arising out of or resulting from my presence or my dog’s presence (if applicable) at the Premises even if the damages, injuries or death are caused in whole or in part by the Releasees. The undersigned covenants not to make or bring any such claim against any of the Releasees, and forever releases and discharges all of the Releasees from liability under such claims.7. INDEMNIFICATION. I hereby agree to indemnify, save and hold harmless Off-Leash from any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind of any kind and character including reasonable attorney’s fees, fees, the costs of enforcing any right to indemnification under this Agreement, and the cost of pursuing any insurance providers, which may be presented or initiated by any other person or organization relating directly or indirectly to my presence or my dog’s presence (if applicable) in and/or around the Premises, or which results from the undersigned’s access or use of the Premises in violation of the House Rules. If any term or provision of this Agreement is determined to be invalid, illegal, or unenforceable, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement.8. VENUE. All matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the laws of the State of Nebraska. Any claim or cause of action arising under this Agreement may be brought only in the federal and state courts located in Lincoln, Lancaster County, Nebraska, and I hereby consent to the exclusive jurisdiction of such courts.9. OPPORTUNITY TO REVIEW. The undersigned represents and warrants that he or she has had sufficient opportunity to review this Agreement and the House Rules, understands the content of all of its sections, and seeks independent professional legal advice or has chosen voluntarily not to do so before entering into this Agreement.I ACKNOWLEDGE THAT I HAVE READ AND THAT I UNDERSTAND EACH AND EVERY ONE OF THE ABOVE PROVISIONS IN THIS WAIVER, RELEASE OF LIABILITY AND INDEMNIFICATION AGREEMENT AND VOLUNTARILY AGREE TO ABIDE BY THEM.
