Agreement for Shooters Needing to Borrow Equipment from the Studio
This agreement (the "Agreement") is entered into by and between [Studio Name] (the "Studio") and [Shooter Name] (the "Shooter"), collectively referred to as the "Parties".
Equipment Borrowing
The Studio grants the Shooter permission to borrow its equipment, including but not limited to cameras, lenses, lighting equipment, and accessories (the "Equipment"), for the purpose of conducting a photo or video shoot.
Equipment Condition
The Shooter shall take good care of the Equipment and ensure that it is returned to the Studio in the same condition as when it was received. Any damage or loss of the Equipment shall be the responsibility of the Shooter, and they will be liable to pay for the repair or replacement of the Equipment.
Liability
The Shooter shall be solely responsible for any injury, harm, or damage caused to individuals or property during the use of the Equipment or while on the Studio's premises.
Equipment Borrowing and Return
The Shooter shall pick up the Equipment from the Studio on the morning of the event and return it on the same day. The Shooter shall take good care of the Equipment and ensure that it is returned to the Studio in the same condition as when it was received. Any damage or loss of the Equipment shall be the responsibility of the Shooter, and they will be liable to pay for the repair or replacement of the Equipment.
Insurance
The Shooter shall carry insurance that covers any damage or loss to the Equipment while in their possession. The Studio shall be named as an additional insured on the Shooter's insurance policy.
Payment
The Shooter agrees to pay the Studio for the use of the Equipment at the rate agreed upon by the Parties. The payment shall be made prior to the borrowing of the Equipment.
Deposit and Refund Policy
The Renter agrees to pay a deposit of $500 upon renting any gear from the Company. The deposit will be refunded in full at the end of the rental period, provided that all rented gear is returned in the same condition as it was when rented, with no missing or damaged items.
In the event that any gear is lost or damaged during the rental period, the Company reserves the right to use the deposit to cover the cost of replacing or repairing the gear. If the cost of replacement or repair exceeds the amount of the deposit, the Renter's credit card on file will be charged the additional amount.
The Renter agrees to notify the Company immediately if any gear is lost or damaged during the rental period. Failure to do so may result in the loss of the deposit and additional charges.
The Company will conduct a thorough inspection of all gear upon return to determine if any items are missing or damaged. The deposit will be refunded within 10 business days after the inspection has been completed and it has been determined that no items are missing or damaged.
By signing this agreement, the Renter agrees to the terms and conditions stated above regarding the deposit and refund policy.
Indemnification
The Shooter shall indemnify and hold harmless the Studio, its affiliates, and their respective directors, officers, employees, agents, and representatives from any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with the use of the Equipment or the Studio.
Replacement of Damaged or Lost Equipment
In the event that the Equipment is damaged or lost while in the Shooter's possession, the Shooter shall be responsible for the cost of repairing or replacing the Equipment, as determined by the Studio. The Shooter shall pay for the repair or replacement of the Equipment within 30 days of being notified of the damage or loss.
Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of Rhode Island. Any dispute arising out of or in connection with this Agreement shall be resolved through arbitration in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
Entire Agreement This Agreement constitutes the entire agreement between the Parties and supersedes all prior negotiations, understandings, and agreements between them relating to the subject matter hereof.
