RELEASE, WAIVER AND INDEMNITY AGREEMENT

I understand that observing and/or participating in the work related and/or recreational related activities described below on the premises owned or leased by any of the following parties, namely, Creating Pathways, LLC and its owners, and Lifeline Solutions, LLC and its owners (hereafter referred to collectively as “CP-LS”), is dangerous. I am willing to assume all of the risks associated with these activities in which I observe or participate on the premises owned or leased by CP-LS (“Premises”). I shall be subject to all rules and regulations of CP-LS now in force or adopted in the future, including those governing use of the facilities and equipment located on the Premises and the use of firearms and recreational vehicles on the Premises.

Work Related: If I render or perform services on the Premises, such as, but not limited to, farming, building, maintaining and improving real and personal property and any other work related activity in which I may be involved in furtherance of rendering or performing services on the Premises, I understand that rendering or performing such services is dangerous. I understand that operating machinery and tools and use of the facilities on the Premises is also dangerous and involves risks. I am willing to assume these risks while participating in such work related activities on the Premises. I understand that CP-LS is not responsible for any bodily injury to me resulting from my rendering or performing services on the Premises.

Recreational Related: If I observe and/or participate in recreational related activities, such as, but not limited to, fishing, boating, hiking, biking, driving or riding recreational vehicles, hunting, any type of shooting, or any outdoors related activity taking place on the Premises, I understand that observing and/or participating in such outdoor activities is dangerous. I understand that operating weapons or participating in any way in shooting, handling and/or carrying weapons is also dangerous and involves substantial risks.  I am willing to assume these risks while participating in hunting, shooting or any other outdoor activity on the Premises.  I further understand that deer and other hunting on the Premises may involve the risk of using stands, some elevated and some not elevated, stands both in trees and free-standing.  I take full responsibility to inspect the condition of any stand before use and to use a proper safety harness while in a stand as well as while climbing into a stand and while climbing down from a stand.  I understand that CP-LS is not responsible for any bodily injury to me resulting from my use of any stand on the Premises.

I further understand that the Premises pose certain natural dangers.  The terrain itself poses hidden dangers and obvious dangers of which I am aware including but not limited to dangers such as holes, cracks or hidden ground openings, fence wire, swamps, brush and other growth, ponds, harmful plants, unauthorized or careless persons on the land, other hunters or other risks that may be dangerous and cause injury and/or death.  I also understand that there are natural and domestic animals that may pose additional dangers.  I understand that I may come in contact with the following animals, among others, while on the Premises:  deer, ticks, snakes, spiders, hunting dogs, wild dogs, coyotes, cats, insects, birds, rodents, bees and other wild animals.  I am willing to assume the risks of any injury and/or disease that I may contract from being associated with the foregoing animals and natural hazards present at the Premises. I also understand that if I have a medical condition of any type, it is my responsibility to advise other guests of the hazards and that I will take responsibility for them and myself.  I understand that appropriate eye protection must be worn at all times.  I fully understand that CP-LS is not required to provide security on the Premises at any time during my presence there.

I also understand that although CP-LS may possess knowledge of the Premises, that it is impracticable and virtually impossible for CP-LS to list and/or to physically show me each and every potential hazard on the Premises.  I voluntarily waive, release and discharge CP-LS and its owners, partners, agents, and employees from and against any and all actions, claims, demands, expenses, liabilities and losses of any kind for damage to or destruction of personal property on the Premises, which are based in whole or in part, or which arise from or relate to my presence on the Premises, regardless of the cause, and whether or not caused in whole or in part by: (a) the condition of the Premises; or (b) the negligence of CP-LS owners, partners, agents, or employees. I agree that this Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement extends to all acts of negligence by CP-LS, including negligent rescue operations and is intended to be as broad and inclusive as is permitted by the laws of the State of Alabama and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and legal effect. 

In consideration of being allowed to visit and utilize the Premises or render or perform services on the Premises, either today or at any future time, I hereby voluntarily agree and covenant to release, indemnify and hold harmless CP-LS, including all its owners, partners, employees, heirs, successors, agents, servants or assigns from and against any and all liability, claims, fines, settlements, damages, demands, suits or causes of action of whatsoever nature, including but not limited to reasonable attorney’s fees, arising out of bodily injury to, illness or death of any person, damage to property of any person, legal entity or third party, in any occurrence incident to or arising out of or relating to this agreement or any activities occurring upon the Premises, whether by me or any of my invitees; or any violation of laws, regulations or ordinances related to my obligations or performance hereunder. I understand and agree that this Release, Waiver and Indemnity Agreement will be binding on me, my spouse, my heirs, my personal representatives, my assignees, my children and any guardian ad litem for said children. I understand and agree that this agreement shall be governed by and interpreted in accordance with the laws of the State of Alabama.

I acknowledge that I have read the above and foregoing RELEASE, WAIVER AND INDEMNITY AGREEMENT and fully understand its contents and binding effect and agree to accept the terms.  I acknowledge that I have had the opportunity to have this Agreement reviewed by an attorney prior to the time I signed it. I represent that I am signing this agreement knowingly, voluntarily and of my own free will on behalf of myself and, if applicable, as the parent or legal guardian of an observer and/or participant under the age of 19 years. I consent to receive and sign this Agreement electronically.
