Waiver and Release of Liability

I understand and accept the risks associated with Go Riders activities, including possibility of physical or emotional injury, paralysis, death, and property damage. I understand that this applies to use of any equipment, activities or games offered by Go Riders. By signing this, I acknowledge that I understand that each person (myself included) has a different capacity for participating in physical activities. I am aware that all rides are recreational and/or self-directed in nature. I acknowledge that I must consult with my doctor before taking on any new form of physical activity. I understand that part of the risk involved in undertaking these rides are relative to my own state of fitness or health (physical, mental or emotional) and the awareness, care and skill with which I conduct myself in any of the activities. In addition, I understand that I am free to withdraw from, reduce or modify my involvement in any of the activities and I realize that I should do so on recognition of any signs of physical discomfort. It is understood that Go Riders assumes no liability for any damages unless there is written agreement to the contrary.  Go Riders shall not be liable to the Guest or the Guest's affiliates and/or agents in connection with this Agreement for any indirect or consequential loss or damages, including but not limited to lost revenue, emotional distress, physical injury, in any case, howsoever caused, without limitation. If you are less than the legal age required for consent or require the assent of a care provider, your parent, guardian or care provider must sign this form on your behalf. Go Riders employees are unable to monitor all people at all times, and all minors must be monitored by a parent or guardian at all times.

I hereby release and forever discharge Go Riders, including their agents, employees, successors and assigns, and their respective heirs, personal representatives, affiliates, successors and assigns, and any and all persons, firms or corporations liable or who might be claimed to be liable, whether or not herein named, none of whom admit any liability to the undersigned, but all expressly deny liability for any and all claims, demands, damages, actions, causes of action or suits of any kind or nature whatsoever, which now or may hereafter arise out of or in any way relate to any and all injuries and damages of any and every kind, to both person and property, and also any and all injuries and damages that may develop in the future. I accept responsibility for any injury to me, my children, or others. I acknowledge that Go Riders is not responsible for missing or stolen items.

I agree to give up my right to sue Go Riders for damage, expense, physical injury, paralysis, or death, that I or my family or estate may suffer as a result of my participation in Go Riders activities, due to any cause whatsoever, including Go Riders negligence, breach of contract, breach of duty of care, or breach of the Occupiers' Liability Act R.S.O. 1990, c. O.2. I agree to waive any and all claims that I have or may have in the future againstGo Riders and to release Go Riders from any and all liability for any damage, expense, injury or death.

I hereby grant to Go Riders the right and permission, in respect to any photographs, video or statements which I share on the Internet, to use, reuse, publish and re- publish in the same in whole or in part, in conjunction with any printed matter in any and all media now or hereafter known, and for any purpose whatsoever, for illustration, promotion, art, advertising and trade, or any other purpose.

I agree that if any portion of this Agreement is found to be void, unenforceable, or inapplicable, the remaining portions shall remain in full force and effect.

If I am signing this Agreement on behalf of a child, I confirm that I am the child's parent or legal guardian, or that I otherwise have the required legal authority to sign this Agreement on behalf of the child. 

This Waiver shall be construed and enforced in accordance with the laws of the Province of Ontario and shall be binding upon the undersigned, and their respective heirs, executors, administrators, personal representatives, successors, and assigns.

By signing below you hereby agree to indemnify and save harmless Go Riders for any and all risks of personal injury associated with your participation in Go Riders activities.
