TROPHYLITE WAIVER FORM

I understand that there is no insurance to claim against if I am injured or killed in this event.  I understand that the insurance TrophyLite has purchased, if any, excludes any and all liability claims that could conceivably be made by race participants who are participating in the event. TrophyLite has not purchased insurance for this event. Racers are to rely on event promoter’s insurance, if any.

RELEASE AND INDEMNITY AGREEMENT – READ IT BEFORE SIGNING! INITIAL TO INDICATE YOUR UNDERSTANDING AND ACCEPTANCE.

I, THE UNDERSIGNED, DO HEREBY DECLARE THAT THE DRIVER AND/OR CO-DRIVERS LISTED ON THIS FORM POSSESS THE STANDARD OF COMPETENCE NECESSARY AND ARE PHYSICALLY FIT FOR AN EVENT OF THIS TYPE FOR WHICH THIS ENTRY RELATES AND THAT THE VEHICLE ENTERED IS TECHNICALLY LEGAL FOR ITS CLASS AND SAFE FOR THIS EVENT.

I understand that as a condition to my participation in the above event I am releasing 3C Motorsports, LLC, dba TrophyLite and its staff or any members, managers, sponsors, race promoters, participants, and or any other organization connected with these events, from all responsibilities to me, my heirs, executors and assigns for anything that occurs during this event.  It is my intention that this release extends to my use of any and all related facilities including, but not limited to, my use of the course and related facilities for pre-running, chasing and racing of the course.

I, the undersigned, do hereby for myself, my heirs, executors and assigns, agree with 3C Motorsports LLC, dba TrophyLite as follows:

I UNDERSTAND THAT OFF-ROAD RACING IS A DANGEROUS ACTIVITY.  I ALSO UNDERSTAND THAT BY PARTICIPATING IN THE EVENT AND IN PRE-RUNNING AND RACING ACTIVITIES I AM EXPOSING MYSLEF TO THE POSSIBLITY OF SERIOUS INJURY TO MY PERSON AND MY PROPERTY.  I VOLUNTARILY ACCEPT THOSE RISKS OF INJURY.  I UNDERSTAND THAT LIABILITY INSURANCE DOES NOT COVER INJURIES OR DAMAGE TO MY PROPERTY.

I HEREBY REMISE, RELEASE AND FOREVER DISCHARGE 3C MOTORSPORTS LLC, DBA TROPHYLITE, THEIR OFFICERS, AGENTS, OFFICIALS, EMPLOYEES, AFFILIATED ENTITIES, AND VOLUNTEERS FROM ALL ACTION, CAUSES OF ACTION, CLAIMS AND DEMANDS WHATSOEVER, WHICH MIGHT ARISE OUT OF OR RESULT FROM MY PARTICIPATION IN THIS EVENT AND MY USE OF ANY AND ALL RELATED FACILITIES INCLUDING, BUT NOT LIMITED TO, THE USE OF THE COURSES AND SUCH RELATED FACTILITIES FOR PRE-RUNNING, CHASING AND RACING ACTIVITIES.  I ALSO AGREE TO INDEMNIFY AND HOLD HARMLESS 3C MOTORSPORTS LLC, DBA TROPHYLITE AND RELATED PARTIES MENTIONED ABOVE FROM ALL SUCH CLAIMS OR RIGHT OF ACTION.

I intend that the release, indemnification and hold harmless described in the previous paragraph shall cover any claim or demand for injury to or death of any person.  The release shall also apply to any damage to or destruction of property including but not limited to, injury to me or my property. My release, indemnity and hold harmless SPECIFICALLY INCLUDES INJURY, DAMAGE, AND DESTRUCTION TO ANY PERSONS OR PROPERTIES WHICH MAY ARISE OUT OF ANY NEGLIGENT ACTS OR OMISSION OF their individuals, officers, agents, officials and volunteers. 

I know the risks of danger to myself and my property while preparing for and participating in the event and while upon the event premises and relying upon my own judgement, skill and ability, I assume all such risks of loss and hereby agree to reimburse all costs to those persons or organizations connected with this event for damages incurred as a result of my negligence.

I understand and agree that neither the off road personnel of TrophyLite conducting these activities, nor the facility through which the off road racing activities are offered, 3C Motorsports LLC, nor any of their respective staff personnel and volunteer personnel may be held liable or responsible in any way for any injury, death, or other damages to me or my family, heirs or assigns that may occur as a result of my participation in these off road activities as a result of the negligence of any party, including the released parties, whether passive or active.

I understand that off road racing locations are sometimes remote, either by time or distance or both, from a medical facility. I still choose to proceed with such off road racing activities, in spite of the possible absence of immediate medical attention in proximity to the off road racing activity.

ADVERTISING RELEASE

I understand that there will be media, private, public and commercial photography, audio and videography at and around the Event and Related Activities. In consideration for allowing me to attend and/or enter the location(s) of the Event and Related Activities, which the parties agree is adequate consideration, I and all persons and entities associated with me agree to permit TROPHYLITE their successors, licensees and assigns, for no fee whatsoever, payable now or at any time in the future, to use my and their names, images, voices, likenesses and pictures of myself and any and all subjects which I may have covered and obtained for publicity, advertising and endorsements (including without limitation publications, television and movies) as well as other footage or property which came into my possession both before and after the Event and Related Activities and do hereby relinquish all rights to the Recordings and give their permission to publish, sell or otherwise dispose of the Recordings, whether obtained directly or indirectly, from on-board, ground or aerial cameras or otherwise as any and all of TROPHYLITE desires, with all advertising rights reserved for those entities and their assigns as they see fit.

6Knowing Voluntary Execution, Severability, Governing Law, Jurisdiction. I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. WE ARE AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN OURSELVES AND RELEASEES TO INCLUDE 3C MOTORSPORTS LLC DBA TROPHYLITE AND SIGN IT OF OUR OWN FREE WILL. If any provision herein, or part thereof, is found to be unenforceable or illegal, the remaining provisions, or parts thereof, shall remain in full force and effect. Any and all claims, disputes or actions arising out of, connected with or related to this Waiver, the Event and Related Activities shall be governed exclusively by the laws of Arizona and the Parties hereto submit to the exclusive jurisdiction of Arizona even though the EVENT may take place outside of Arizona.

INDEMNIFICATION AND RELEASE

I, the undersigned, do hereby for myself, my heirs, executors and assigns, release, remiss and forever discharge and agree to indemnify and hold harmless individuals, manager, members, officers, agents, sponsors, sanctioners, co-sanctioners, servants, volunteers and employees of and from any and every claim, demand, action or right of action of whatsoever kind or nature and any cost, loss or expense in connection wherewith arising from or any person or any damage to or destruction of any property resulting from or claim to result from or arise out of accident or occurrence during or in connection with said use, including specifically such as may arise out of a claim of negligence on the part of said 3C Motorsports LLC dba TrophyLite, its individuals, officers, agents, sponsors, co-sponsors, sanctioners, co-sanctioners, servants, affiliated entities, volunteers and employees.

This Waiver and Indemnification and Release is given and this agreement is made in consideration and as a condition permitting the undersigned to use the course or circuit facilities or act as an official or spectator or participant or to be present in any other capacity whatsoever at said event.  I have read the foregoing Waiver and Indemnification and Release and fully understand that no officer or agent or employee of 3C Motorsports LLC dba TrophyLite is authorized to vary the terms or provisions of this instrument or to make any representations contrary to the provisions hereof.

I have completely read the foregoing Waiver, Indemnification and Release and fully understand that no officer, volunteer or any other agent of 3C Motorsports LLC dba TrophyLite is authorized to vary any term or provision of the release contrary to its provisions and I should not rely on any such variance or representation.  I hereby certify that I have completely read the Rules and Regulations of 3C Motorsports LLC dba TrophyLite and that I agree with and shall comply with all the Rules and Regulations of TrophyLite.

I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS LIABILITY RELEASE AND EXPRESS ASSUMPTION OF RISK BY READING IT BEFORE I SIGNED IT ON BEHALF OF MY HEIRS AND MYSELF.

“I declare that the driver or co-drivers listed on this entry application possess the standard of competence necessary and are physically fit for an event of this type for which this entry relates and that the vehicle entered is road worthy and suitable for this event.”
