  • PARTNERSHIP ACKNOWLEDGEMENT, RELEASE, AND WAIVER

    1. Kings Way International aims to assist in creating safe, healthy, self-sufficient lives for families and empower then to reach their potential and purpose. Kings Way International provides opportunities for individuals to engage in our community in service to our mission. Individuals partnering with Kings Way International is on a volunteer basis without compensation.
    2. For purposes of this application partnership or partners are referred to as "Volunteers"
    3. The Volunteer (“Volunteer”) desires to participate in one or more volunteer activities (the “Volunteer Activities”) being organized by the Kings Way International.
    4. Kings Way International desires to allow Volunteer to participate in such Volunteer Activities under the terms and conditions set forth in this Release.
  • Acknowledgement, Release, and Waiver

  • NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of which the parties acknowledge, the parties agree as follows:

    1.Supervision and Training. Volunteer agrees that, while participating in the Volunteer Activities, Volunteer will be subject to the supervision and will follow the instructions of the Kings Way International, its employees, officers, and agents. Volunteer agrees to receive any and all training required by the Kings Way International prior to participating in the Volunteer Activities.

    2.Participation is in Kings Way International's Sole Discretion. Volunteer acknowledges that Volunteer’s participation in the Volunteer Activities is a privilege, not a right, and that Kings Way International, its employees, officers, or agents, may, in their sole discretion, decline to allow Volunteer to participate in any of the Volunteer Activities for any reason.

    3.No Employment or Compensation. Volunteer acknowledges and agrees that this Release does not constitute an employment contract and does not entitle or guarantee Volunteer to later employment with Kings Way International. Volunteer acknowledges that his/her services rendered in connection with the Volunteer Activities are being donated and that Volunteer is not and will not be entitled to, and Volunteer does not expect, any present or future salary, wages, reimbursement, compensation, or employee benefits as a result of providing such services.

    4.Confidentiality. I agree to protect the confidentiality of Kings Way International clients, volunteers and employees. Information given to me by a client, volunteer or staff member will not be given to any agency or person without the expressed written consent of the person or guardian of the person to which the information pertains. Where it is deemed necessary to give an agency, client or other person the name of any Kings Way International volunteer, I agree to use the first name only. The release of phone numbers, social media or addresses should be cleared by the owner of such numbers or the Executive Director. We expect you to abide by Kings Way International rules and regulations, and by signing this document you acknowledge that you agree to refrain from the unauthorized use or disclosure of any proprietary information. 

    5.Privacy in General Whatever you put on a Kings Way International computer, including email you send and receive, and software you install, could have been seen/read by someone other than yourself or your intended receiver. Emails and anything else generated or stored on Kings Way International computers are company property. We understand that you may need to conduct personal business while using a Kings Way International computer, but we ask that you do not abuse this access.

    6.Email and Voicemail Usage The Kings Way International email system is intended for business use only. Personal correspondence should not be conducted through this email address, and Kings Way International reserves the right to monitor your email activity. Like email, voicemail can be listened to by someone other than yourself or your intended receiver. Anything you put or receive on Kings Way International voicemail is also company property.

    7.Volunteer Workstation, Virtual and Email Access All volunteers will be given a unique login to access the volunteer workstations, if applicable. This will allow you to access the internet and your own unique desktop from each workstation, and will give you access to the Volunteer folder on a Google Drive to share and save documents. You will also be given a Kings Way International email address – usually first initial last name @kingswayint.org. This email address will be available both through your unique login as well as from a web platform. This email address will also allow you to access the Kings Way International Google Drive.

    8.Grant of Right to Use Image, Audio, and Video. Volunteer acknowledges that one or more of Kings Way International, its employees, officers, and agents, may cause still photographs, audio recordings, and/or audio-video recordings (collectively, the “Recordings”) to be made of Volunteer’s participation in the Volunteer Activities. Volunteer grants to Kings Way International and their assigns, licensees, and successors the right to use the Recordings, including without limitation any Recordings containing Volunteer’s voice, image, picture, portrait or likeness, throughout the world and in perpetuity, but only for purposes of promoting Kings Way International nonprofit and/or charitable activities. The grant contained in the immediately preceding sentence applies to all forms and media, including composite or modified representations, and Volunteer waives the right to inspect or approve any version of Volunteer’s voice, image, picture, portrait or likeness prior to publication.

  • 6.Volunteer’s Representations and Warranties regarding Criminal Conduct. Volunteer represents and warrants that he/she has never been convicted of or plead no contest to, and is not currently under investigation for, a crime of violence, including, but not limited to assault, child abuse or neglect, child abduction, or kidnapping, nor has Volunteer been ordered by a court to receive mental health treatment in connection with any of the foregoing.

    7.Release of Kings Way International: Volunteer acknowledges that the Volunteer Activities include a diverse range of activities that could result in harm or injury to Volunteer, whether physical or mental, loss or damage to Volunteer’s personal property, or Volunteer’s death. Volunteer, on behalf of himself/herself and anyone who obtains any rights from Volunteer, hereby forever releases and discharges Kings Way International and/or its parents, subsidiaries, affiliates, directors, officers, employees, agents, partners, administrators, volunteers, insurers, or successors, or the assigns of any of the foregoing (each a “Releasee”), from, and agrees not to sue any of the Releasees for, any kind of liability, claims, demands, losses, damages, costs, or expenses (including, without limitation, attorney’s fees and costs) arising out of or in any way related to Volunteer’s participation in the Event and related activities, including without limitation the Volunteer Activities.

    8.Governing Law. This Release shall be governed by and construed in accordance with the laws of the State of New Jersey. Exclusive jurisdiction and venue for any dispute concerning this Release shall be in the federal or state courts located in the Camden County, New Jersey.

    9.Signatures. Volunteer agrees further that if Volunteer is under the age of 18, Volunteer’s parent or legal guardian will also sign this Release.

    IN WITNESS WHEREOF, Volunteer and Volunteer’s parent or legal guardian, if Volunteer is under the age of 18, have executed this Acknowledgement, Release, and Waiver to be effective as of the date signed. By signing this Acknowledgement, Release, and Waiver, Volunteer and Volunteer’s parent or legal guardian, if applicable, acknowledge that he/she/they have read, understand, and voluntarily agree to its terms.
