In consideration of being permitted to engage in hunting, shooting, and all associated activities, including transportation, with Black Dog Outfitters Ltd. on lands owned by Kyler Harms (Black Dog Outfitters and Kyler Harms are hereinafter collectively referred to as the “Releasee”), the receipt and sufficiency of such consideration is acknowledged by me, I, on behalf of myself, my heirs, next of kin, dependents, executors, administrators, successors and assigns (hereinafter collectively referred to as the “Releasors”), acknowledge and agree that:

I hereby acknowledge that the hunting trip, or other guided tour, that I participate in under the arrangement of the Releasee, its employees, agents, officers, members, volunteers, directors, contractors or associates, involves risks and dangers which are inherent to hunting and wilderness travel. This includes, but is not limited to, hazards of travelling by motorized vehicle, and by boats; hazards of carrying and being in possession of firearms and ammunition and of hunting with others who are in the possession of same; hazards of being exposed to the elements of nature, hazards of being in areas where hunters are likely to be present; hazards of hunting from elevated tree stands; hazards of being and travelling in remote wilderness areas and hazards arising from accidents, acts of God, illness, and forces of nature. 

I accept and assume all risks of personal injury, death, and loss or damage
to property while participating in the said guided hunting excursion, whether caused by my actions, the actions of other hunters, or the negligence of Black Dog Outfitters Ltd.’s employees, agents, officers, members, volunteers, directors, contractors or associates. I accept and assume the aforementioned
risks voluntarily, having chosen to participate in the guided hunting excursion with Black Dog Outfitters Ltd., notwithstanding the risks involved with participating in a guided hunting excursion. I further agree that the Releasee shall not be held responsible for any loss, damage or injury suffered by me while participating in any activity, using any facilities, being transported to or from any activities related to hunting or shooting, or being transported by the Releasee for any reason whatsoever.

I acknowledge that if I choose to hunt from an elevated tree stand that I do
so voluntarily and that I will bring and use an approved safety harness to be used at all times while in the tree stand.

I acknowledge and agree that this Agreement constitutes a waiver and
release of the Releasee, its insurers, subsidiaries, successors, directors, officers, employees, and assigns, from liability for any common law or statutory duty of care, including, but not limited to, any duties arising under the Occupiers’ Liability Act, R.S.A. 2000, c.O-4, and any amendments or regulations thereto. 

I acknowledge and agree that this Agreement constitutes a waiver and
release of the Releasee, its insurers, subsidiaries, successors, directors, officers, employees, and assigns, from liability pursuant to the Fatal Accidents Act, R.S.A. 2000, c. F-8, and any amendments or
regulations thereto.

I acknowledge and do hereby agree to indemnify and hold harmless Black
Dog Outfitters Ltd., its insurers, subsidiaries, successors, directors, officers, employees, and assigns, from and against any and all claims, actions, causes of action, liabilities, losses, damages, damage to property, costs, charges, expenses, legal fees and disbursements on a solicitor-client full indemnity basis, fines and penalties for which Black Dog Outfitters Ltd. may suffer, incur, or be liable for, directly, or indirectly, in consequence of my actions or omissions while participating in a guided hunting excursion with Black Dog Outfitters Ltd., and any associated activities during the course of my time with Black Dog Outfitters Ltd.

I acknowledge and do hereby agree to indemnify and hold harmless Black
Dog Outfitters Ltd., its insurers, subsidiaries, successors, directors, officers, employees, and assigns, from and against any and all claims, actions, causes of action, liabilities, losses, damages, damage to property, costs, charges, expenses, legal fees and disbursements on a solicitor-client full indemnity basis, fines and penalties for which Black Dog Outfitters Ltd. may suffer, incur, or be liable for, directly or indirectly, in consequence of the actions or omissions of my dependent while participating in a guided hunting excursion with Black Dog Outfitters Ltd., and any associated activities during the course of our time with Black Dog Outfitters Ltd.

I acknowledge and agree that in order for Black Dog Outfitters Ltd. to provide
its hunters with the highest quality wing shooting experience in this competitive market the locations from which Black Dog Outfitters Ltd. operates should be kept confidential. I hereby covenant and agree not to make any social media posts that identify the location from which Black Dog Outfitters Ltd. operates including, but not limited to, expressly naming locations in social media postings, posting images to any social media platform that contains geotagging, and posting images to any social media platform which would serve to identify the locations from which Black Dog Outfitters Ltd. operates.

I acknowledge that in entering into this Agreement, I am not relying on any
oral or written representations or statements made by Black Dog Outfitters Ltd., its employees, agents, or associates. This Agreement contains the entire agreement between me and the Releasee, and the terms of this Agreement are contractual and not a mere recital. 

I acknowledge that this Agreement, and any rights, duties, and obligations as
between the parties to this Agreement shall be governed solely in accordance with the laws of the Province of Alberta, Canada and no other jurisdiction; and any litigation involving the parties to this Agreement shall be brought solely within Alberta, and shall be within the exclusive jurisdiction of the
their Courts. 

I acknowledge and agree that this Agreement is intended to be interpreted
as broad and inclusive as is permitted by the laws of the Province of Alberta.

I acknowledge and agree that the parties to this Agreement, being myself
and Black Dog Outfitters Ltd., are of equal bargaining strength, and agree that the doctrine of contra preferentum shall not apply to this Agreement.

 

I HAVE READ, AND I UNDERSTAND THIS AGREEMENT. I UNDERSTAND THAT BY SIGNING THIS AGREEMENT, I AM WAIVING CERTAIN LEGAL RIGHTS INCLUDING THE RIGHT TO SUE, WHICH I, MY HEIRS, NEXT OF KIN, DEPENDENTS, EXECUTORS, SUCCESSORS, ADMINISTRATORS, 2 AND/OR ASSIGNS, MAY HAVE AGAINST THE RELEASEE, ITS INSURERS, SUBSIDIARIES, SUCCESSORS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, REPRESENTATIVES OR CONTRACTORS, FOR OR BY REASON OF ANY CLAIMS FOR DAMAGES INCLUDING ANY LOSSES AND EXPENSES WHICH I, MY HEIRS, NEXT OF KIN, DEPENDENTS, EXECUTORS, ADMINISTRATORS, SUCCESSORS OR ASSIGNS MAY HAVE, OR HEREAFTER HAVE, ARISING OUT OF, OR TO ARISE OUT OF, OR IN ANY WAY CONNECTED WITH, THE PROVISION OF SERVICES BY THE RELEASEE.

I HEREBY GRANT and give the Black Dog Outfitters Ltd. the absolute and irrevocable right and permission, with respect to any photographs, videos, taped interviews or digital images that it has taken of me to use, re-use, publish and re-publish the same in whole or in part, individually or in conjunction with other photographs, interviews or images in a publication, print ad, electronic media (e.g. internet websites, DVD, social media networking websites, television
programming) or other form of promotion.This permission is unconditionally granted to Black Dog Outfitters Ltd. for any purpose deemed appropriate by Black Dog Outfitters Ltd., both internal and external to the company, and including distribution by Black Dog Outfitters Ltd. to any third party deemed appropriate by Black Dog Outfitters Ltd. for publication or use by that third party.
I HEREBY WAIVE any right that I may have to inspect and approve the finished product or copy that may be used in connection with the information contained in the interview or the image that has been reproduced. I further understand that Black Dog Outfitters shall not be required to pay any consideration to myself for the unlimited usage of the photograph, video and/or digital image and contents of any taped interview.

 

I AM of legal age and have read the foregoing and fully understand the contents thereof. THIS CONSENT AND RELEASE is granted to Black Dog Outfitters Ltd.

Single WATERFOWL HUNTS = $8,000.00 USD + GST and Gratuities per hunter.

We prefer parties of 8 hunters and can accommodate up to 16 hunters at time. 

Tips and Gratuity are at your discretion and depend on the quality of service you were provided by the Black Dog staff. 

Tip average: 

- $1,500 usd per hunter

1. For the purposes of our own records, we require additional information. If you have an allergy, food restrictions, or medical conditions we need to know about them. Please list details on the “Client Info” document attached. 

2. Linked is a “Checklist” of anything, and everything you may need to have a successful hunting experience with us. We recommended printing off your completed forms, so you have these documents to reference for yourself and customs if needed.

We have 12 (and 20) Gauge Benelli, Beretta, and Franchi semi-auto shotguns available.

 

Everyone in your party requires updated and accurate licensing, waivers, and hunter information forms completed before arrival.

 

LICENSING 

All provincial and federal hunting licenses have moved to online purchasing. 

We will no longer offer Migratory Bird Permits (Stamps) on site. 

All licenses required are listed below with the appropriate website links to obtain your licenses. 

To legally hunt in the province of Alberta you will need 4 licenses AlbertaRELM.

Flying Commercial 

 

We will no longer receive your party at the airport due liability issues. Instead we will pick you and your luggage up at Coast Nisku Inn 

Once you have landed please call 1-(780)-955-7744 Press 3 to call for a shuttle. Request a pickup at the “International Arrival Flights Gate” 

Below is a picture of your shuttle for the 2 mile drive to the Costa Nisku Inn.

Once you have taken the shuttle to the Coast Nisku, we will receive your party in our shuttle and drive you to the hunting lodge. Please Text 780-603-7950 when land at YEG. Note your party members' names in text.

(There are two restaurants in the Nisku Inn, feel free to grab a drink and some food while you wait for one of our drivers to receive your team. There is a gas station, liquor store, and Cannabis store across the street from the hotel. We advise you and your party to walk over and shop before our drivers arrive)

ITINERARY 

• After arrival at the lodge you will have a chance to get settled into your room, have a drink, and meal. 
• We will have food prepared for you at the lodge. 
• Bird hunts average 12-16 birds, per hunter, per day; and (or) 75 rounds fired per day.
• Goose species harvested include: White Front (Specklebelly), Greater/Lesser Canada, and Snow Geese 
• Duck Species harvested include: Mallards and Pintails

If you are arriving before the designated pick up times or staying an additional night after your hunt with us, we recommend staying at the Coast Nisku Inn 

(If you choose a different hotel, please inform us immediately so we have the correct information to either pick up or drop off.)
