Place termination and notice period rules
“Term” refers to school terms. Term dates are available on the nursery website.
3. Termination day and times
Below are listed the times during the academic year that you can terminate your place and those that you cannot. The correct notice must be given to end your place at one of the allowed times.
The earliest point in the academic year that a place can terminate is the final day of Autumn 1 (the first half term of the academic year). The correct notice must be given.
End of Autumn 1 to the end of Spring 2
Places can terminate at any time from the final day of Autumn 1 to the final day of Spring 2, IF the correct notice is given.
End of Spring 2 through to the end of Summer 2
Places cannot terminate during this period.
End of Summer 2 through to the end of Autumn 1
Places cannot terminate during this period.
4. Giving notice of termination
Please read carefully. The notice period varies through year
A. SEPTEMBER STARTERS
This section applies only to places commencing in September.
Before starting in September, payment for Autumn 1 is required in advance to secure your child’s place. An invoice will be issued once you have completed enrolment.
Once your Autumn 1 fees have been paid, if you wish to terminate your child’s place you must do so in writing to admin@intothewoodsnursery.co.uk.
If you terminate the place:
Within 14 days of payment (cooling-off period):
A full refund will be issued (less the enrolment fee of £120)
After the 14-day cooling-off period and before 1 June:
A 50% refund of the Autumn 1 payment will be made
After the 14-day cooling-off period and on or after 1 June (including non-attendance):
The full Autumn 1 fees remain payable and are non-refundable, as the place has been reserved and is unlikely to be reallocated
B. ALL OTHER NEW STARTERS (NON-SEPTEMBER START DATES)
This section applies to all places commencing October–July.
By submitting the enrolment form, you are committing to taking up the place.
Once your enrolment is completed, if you wish to terminate your child’s place you must do so in writing to admin@intothewoodsnursery.co.uk.
If you terminate your place:
– during the enrolment period (after submitting your enrolment form but before your child attends), OR
– during your child’s first half term of attendance
you must pay whichever is greater of:
– the first half term’s fees in full (at the non-funded rate), OR
– the fees (at the non-funded rate) payable for 6 weeks from the date notice is given.
C. STANDARD NOTICE PERIOD
A minimum of SIX WEEKS’ NOTICE IN WRITING, or payment in lieu of notice, must be given to withdraw your child.
Notice can be given at any time during the academic year from 15 September up to and including 1 March.
The six weeks notice period will start the day after notice is given, with the place terminating 6 weeks from that start date.
1 March is the final date in the academic year on which it is possible to give notice to leave before the end of the academic year. Notice given on or before 1 March will allow your child to leave at the end of the Spring term.
Notice given after this date will fall within the Summer term rules set out here.
D. SUMMER TERM RULES
– A place cannot be terminated part-way through the full Summer term, including Summer 1, Summer 2 and the Summer half term break.
– The latest date for a place to terminate before the end of Summer 2 is the last day of Spring 2.
– To terminate at the end of Spring 2 notice must be given by 1 March at the latest.
– Notice given after 1 March means your child is committed to the full Summer term.
If a child leaves during the Summer term:
fees at the full non-funded rate will be payable for any part of the Summer term not attended, regardless of attendance.
This is because vacated places cannot be filled once September allocations have been finalised.
Exception – Summer 1 starters
Children who take up a new place at the start of Summer 1 may give the standard six weeks’ notice, even if this falls within the Summer term.
E. TERMINATION AT THE END OF THE ACADEMIC YEAR (END OF SUMMER TERM)
Notice can be given to terminate at the end of an academic year up to and including 31 May.
If notice is not received by this date:
– the place will automatically continue into the following academic year, and
– fees for Autumn 1 will be payable in full
Notice given on or after 1 June will not take effect at the end of the Summer term, and the place will continue until at least the end of Autumn 1 in the following academic year.
This is because it is very difficult to fill Autumn 1 places during the period June to August.
F. FUNDED PLACES
If you terminate a funded place (Government 15/30 hours funding) and your child does not attend during the notice period, you must pay the notice period fees at the full non-funded rate, as funding cannot be claimed.
G. HOW TO TERMINATE YOUR PLACE
Notice must be given in writing by email to:
admin@intothewoodsnursery.co.uk
Notice by any other means – for example given verbally to a member of staff, to a different email, by text or phone call – will not be accepted.
Notice emails must clearly and definitively state that you are giving notice to terminate your child’s place.
Emails discussing or querying termination will not be accepted as giving notice.
H. GENERAL
These terms form part of your agreement with the nursery and apply to all nursery places and Forest School Club places offered and accepted.
