You agree that you are a guest of the Club and you may only use the Club’s premises, equipment and services for the number of days specified above (starting from the date of this form), under the supervision of a Jetts employee or fitness professional contracted by Jetts. This form incorporates the terms of the Jetts membership policies which are located at www.jetts.com.au and the club rules which are located at the Club.
Minimum age: All casual users of Jetts must be a minimum of 14 years of age. All people under the age of 18 must have a parent or guardian co-sign the form.
Minors aged between 14-15 years of age must comply with the following restrictions:
a. Access to the Club as stated on this casual usage form;
b. Access to the Club can only be during staffed hours;
c. A pre-exercise questionnaire must be completed by the parent or guardian; and
d. A suitably qualified personal trainer undertakes a pre-exercise assessment and then provides an exercise program for the minor prior to the commencement of exercise.
Minors aged 16 years of age must comply with the following restrictions:
a. A pre-exercise questionnaire must be completed by the parent or guardian prior to the commencement of exercise; and
b. A suitably qualified personal trainer to undertake a pre-exercise assessment and then provide an exercise program for the minor prior to the commencement of exercise.
Disability: All disabled casual users of Jetts must comply with the terms of the policies which are located at www.jetts.com.au or at the Club.
Orientation: You agree to participate in a scheduled casual user orientation program, focusing on the safe and correct use of the Club’s facilities provided at the Club. You must fill in the Fighting-Fit Pre-Workout Questionnaire prior to using the Club’s facilities.
Video and Audio Surveillance: For security purposes, Jetts uses video and audio surveillance equipment to monitor the Club on a 24 hour basis. By signing this form you acknowledge that by accessing any “Jetts” branded club you will be subject to video and audio surveillance and recording. Video and audio surveillance is limited to the floor area only, and is not within the walls of the bathrooms or assessment rooms.
Liability for Property: Jetts is not liable to you for any personal property that is damaged, lost, or stolen while on or around the Club including, but not limited to, a vehicle or its contents or any property left in a locker. If you cause damage to the Club or any equipment you are liable to Jetts for its cost of repair or replacement.
Equipment: You understand and acknowledge that:
a. Jetts purchases or leases the equipment from a third party and therefore does not manufacture any of the fitness or other equipment used in the Club; and
b. Jetts is providing recreational services and may not be held liable for defective products or equipment.
Phsyical Condition: It is your responsibility not to use any equipment which may adversely affect any medical condition. You hereby represent to the Club and Jetts, and their directors, officers, employees, contractors and agents that, to the best of your knowledge, you do not have any physical, medical or other disability or condition which may be affected or aggravated by, or which may result in any sickness, injury or death to you as a result of, your use of the Club’s facilities. If you have any health or medical concerns you must discuss them with your doctor before using the equipment or the Club. You acknowledge that Jetts did not give you any medical advice before you used the equipment, and cannot give you any medical advice after you use the equipment.
Risk Warning: Jetts warns that whilst you are using our equipment or on our premises using our Club and recreational services, you are at risk of suffering physical harm or personal injury including broken bones, soft tissue injuries, joint injuries, permanent disability or death. You acknowledge that any such injury may result not only from your actions but from the actions, omissions or negligence of others. You acknowledge that whilst every attempt is made to ensure that the recreational services and the Club provided by Jetts are safe, there are some significant and inherent risks involved, and you agree that you are participating voluntarily at your own risk and responsibility, thereby exposing yourself to certain risks.
Entire Agreement and Enforcement: You acknowledge that neither Jetts nor any other party has made any representations or promises upon which you have relied when entering this Agreement. This document contains the entire Agreement between you and Jetts and replaces any oral or other written Agreement. Any manual or hand written changes to this Agreement are not valid unless initialed by both parties. If a court declares any part of this Agreement invalid, it will not invalidate the remaining parts, which continue unaffected. If Jetts does not enforce any rights in this Agreement for any reason, Jetts does not waive its right to enforce it later.
Release and Indemnity: You acknowledge and agree that you use the facilities or equipment provided by Jetts at the club or at any location at your own risk and that the use of the facilities may involve risk of injury, whether caused by you or another party. By signing below, you agree that Jetts will not be liable for any loss of, damage to, or theft of property, belonging to you, or for any death, personal injury or illness suffered on club premises or from using our facilities or equipment at any location.
Note that this waiver does not apply if your death or injury is as a result from gross negligence on the part of Jetts.
