  • Client and Trip Details

    This is a contract for travel planning services between Brittany Archer, Independent FORA Travel Advisor (hereafter referred to as “AGENT”) and "CLIENT", as indicated in CLIENT NAME below. The trip location and dates listed below will hereafter be referred to as “TRIP”.
  • Client Responsibilities

  • For the purpose of this contract, “Supplier(s)” will refer to all hotels, resorts, excursion companies, vendors, tour companies, and ground transportation providers contained in Agent’s itinerary for Client.

    1. Client has contracted Agent to plan the Trip for a fee and acknowledges that this fee is for the Selected Services outlined in contract.

    2. Client understands that planning fee must be paid in full in order for Agent to begin Trip planning on Client's behalf.

    3. Client serves as the Trip representative for all persons in their travel party and is primary contact for Agent. If Client represents a group of 4 or more, Client is responsible for managing communications between Agent and the rest of Client’s group in order to minimize miscommunication or confusion.

    4. Client will provide Agent with the necessary contact information for each member of their travel party as needed to assist Agent with information required to make the Trip reservation(s).

    5. Client acknowledges that they are responsible for all payments for hotels, vendors, suppliers, activities and transportation as facilitated by the Agent on Client's behalf to secure the Trip reservation(s).

    6. Client acknowledges that supplier pricing is subject to change until the time a booking is confirmed and thus will ensure that credit card authorizations are returned to Agent no later than 24 hours from receipt.

    7. Client acknowledges that payment plans are not always available from Agent’s suppliers and does not expect agent to provide such a service if the supplier does not offer it.

    8. Client understands that Agent is not responsible for any flight delays, cancellations, changes or weather inconveniences that my affect the length of Client's Trip or ability to participate in certain activities.

    9. Client understands they are allowed one date or accomodation change for the Trip where the existing reservation(s) will be modified accordingly; HOWEVER, if client requires an additional date, accomodation, activity or guest change, an additional fee will be charged and is payable immediately at the time of the request. The schedule for those fees is:

         a. $50 per room accomodation change

         b. $75 per date change

         c. $50 per additional person added/removed

         e. $50 for activity change

    10. If Client decides to cancel trip at any time, Client is subject to the cancelation policies of each supplier and will incur/pay supplier penalties according to each supplier’s guidelines. Agent is not responsible for the facilitation of refunds, or issuance of credits between supplier and Client.

    11. If Client decides to cancel trip 30 CALENDAR days or more prior to the first scheduled day of arrival for their planned Trip,

         a. Any travel planning fees paid to Agent will not be refunded

         b. No cancellation penalty will be assessed by Agent

    12. If Client decides to cancel trip WITHIN 30 CALENDAR days of travel, Client will not receive a refund of any travel planning fees paid to Agent and agrees to pay AGENT a cancellation fee of:

         a. $250 for trip itineraries totaling $0- $4,999,

         b. $350 for trip itineraries totaling between $5,000-$7,500.

         c. $450 for trip itineraries totaling between $7,501 and $9,999.

         d. $550 for trip itineraries totaling between $10,000 and $14,999.

         e. $700 for itineraries totaling between in excess of $15,000

  • Agent Responsibilities

  • 1. Agent will research Trip location(s) and prepare a proposal for Client to review lodging recommendations and/or other trip services (i.e. transfers, tours, itinerary options) for modifications and approval. 

    2. Upon Client's approval of lodging or itinerary items, Agent will provide Credit Card Authorization request to Client and/or the members of their group responsible for payment, in order to secure the reservation(s) requested. 

    3. Upon receipt of Credit Card Authorization from Client, Agent will secure Trip accomodations and services as agreed upon from the approved proposal.

    4. Agent will monitor Client’s itinerary for any supplier-related changes and relay required information from the supplier to Client and from Client to the supplier, as well as monitor and manage the reservation process.

    5. Agent will prepare Client’s trip documentation and provide Client all necessary reservation confirmation information prior to travel.

    6. Agent is not responsible for booking ANY of Client's airfare or train transfers, unless otherwise specified in the approved proposal, nor booking of reservations for Clients using Client's loyalty program points (i.e. frequent flyer, credit card, hotel).

     

    • Review Package Options and Add-On Service Descriptions 
    • Package Option Descriptions (refundable/partially refundable upon trip completion):

       

      Accommodation Search ($50) - If you know what city you want to visit and just need a place to stay, 2-3 accommodation options will be provided based on your interests and budget. If you proceed with the booking, and the commissionable booking value (before taxes and fees, excluding airfare) exceeds $1,500, $50 of the fee will be reimbursed 2 weeks after completion of the trip.

      Ready to Go ($150) – This package is for those who have their flight and hotel booked, but they do not know what activities to do while on their stay. After discussion about your budget and interests, you will be provided with an itinerary for all days of travel with activities and restaurants organized by theme and proximity. If you proceed with the booking, and the commissionable booking value (before taxes and fees, excluding airfare) exceeds $4,000, $150 will be reimbursed 2 weeks after completion of the trip.

      Conceirge ($250) – This package is for those who do not know where to start for planning a trip or they simpily do not have the time for planning. After discussion about your budget and interests, you will receive an itinerary for all days of travel with activities and restaurants organized by theme and proximity, a fine-tuned list of available accommodations, coordination of ground transportation, and handling of all reservations and contract management If you proceed with the booking, you will be reimbursed 2 weeks after completion of the trip based on the commissionable booking value (before taxes and fees, excluding airfare) in the bullets below.

      Commissionable Booking Value >$4,000 = $100 reimbursement
      Commissionable Booking Value >$6,000 = $200 reimbursement

      Optional Add-ons (non-refundable):

      Tourist Visa Services (price varies) - If you happen to travel to a destination that requires a tourist visa, we will inform you on how to obtaiin on and/or get the visa for you. Since visas are priced differently, your price will be reviewed during your trip discussion and is non-refundable once completed.

    • Selected Services:

      Based upon Client's understanding of packages as described above and as discussed with Advisor, the following services are requested of Advisor.
    • By signing below, I understand and accept for myself and the travelers included in my party, the Agent's Fee Structure. I understand these fees are separate from the cost of my trip. I acknowledge and accept there are cancellation policies, change fees, and penalties that apply to my travel plans and services. I agree to all fees such as cancellation policies, change fees, and penalties, and understand portions may be non-refundable.

    • Upon receipt of the signed contract, an invoice with a secure online payment feature will be emailed to Client at the email address above or Client may make alternate arrangements to pay in cash. Fee payment is due in full within 7 business days of this contract's dated signature.

  • Additional Client Responsibilities unrelated to Fees

    • Travel documents, including passports, visas, and health/vaccination certificates required are your responsibility. Valid passports are absolutely required for all international destinations and the expiration date should be at least 6 months following the return date of your trip. Some countries require that your passport have two to four blank visa/stamp pages. Some airlines will not allow you to board if this requirement is not met. See this State.gov link for passport support. When travelling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight. (See this link.)

      Examples: DHS designated enhanced driver’s license, USA Passport, a foreign government passport. The name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on airline ticket(s) and booking records.

      Additionally, a visa and vaccinations may be required. Please note that even when a visa is issued, a traveler may be denied entry since each country’s local immigration officials make the final entry decision. Several factors including past criminal record may contribute to the decision of the local immigration official(s). Should a visa not be issued, Travel Advisor is not responsible for lost payments made toward the contemplated trip.

    • If traveling to or through Canada, travelers with a Driving While Intoxicated (DWI) or other conviction record should always check whether current rules exclude admission. Travel Advisor feels it is an invasion of privacy to make such an inquiry of you. The final decision of entry rests with the immigration or border services officer. For more information see Canada's government site and the Canadian Immigration facts.

    • Visit the USA State Department Web site www.travel.state.gov on a regular basis for information regarding incidence of disease, terrorism, safety issues, crime, the need for travel documentation (such as passports, visas, proof of health/vaccination certificates), health hazards, and other restrictions regarding travel to your domestic and/or international destination(s), and re-entry into the United States. Required or advised inoculations you decide to obtain upon the advice of your personal physician may need to be administered in a series of doses months ahead of your planned departure and such time element should be taken into account by you when making deposits and/or nonrefundable final payments.   • Terms and Conditions

    • Availability and price quotes are applicable to the date and time at which they are requested and cannot be guaranteed until payment is made.

    • Quotes in a foreign currency fluctuate with exchange rates and international payments may carry a foreign transaction fee.

    • Agent will make every effort to honor the price as originally quoted, however, under certain circumstances additional costs by a supplier or government may be imposed due to an increase in the cost for one or more of the travel components.

    • Flight confirmation is subject to availability and prices are subject to change after the date of deposit, including price increases in the fee for a seat assignment, fee for baggage, applicable fuel surcharges, or an increase in a government imposed fee or tax.

    • Clients are responsible for adding required passport information to international air reservations after ticketing.

    • Correct legal names that match Client's identification used for travel must be provided by the Client to Agent. Name changes are not permitted on airline tickets. Clients are responsible for providing accurate information on Client Traveler Profile form. Agent is not responsible for costs incurred by incorrect information provided for travel planning including reservations and airline tickets.

    • Certain suppliers reserve the right to increase prices to cover increased costs, fuel surcharges, tariffs and taxes, and to reflect fluctuations in foreign exchange markets.
    • If for any reason my credit card charges are later declined, reversed, or Agent is unable to receive payment for the travel plans and services, I acknowledge that this is a binding contract between myself and Agent shall be entitled to recovery, including reasonable attorneys’ fees in connection with collection.

    • Overnight shipping fees for documents shipped to client from Agent may be billed to client.

    • Agent offers retail travel services to customers, which are provided by separate and independent vendors of travel services. Agent does not operate, control, or otherwise provide the services of the independent travel vendors. Hence, customer agrees that Agent acts only on behalf of Client in acquiring transportation, hotel accommodations, sightseeing and other privileges, or services for the Clients’ benefit, and on the express condition that Agent shall not be responsible for any loss, accident, injury, delay, defect, omission or irregularity which may occur or be occasioned, whether by reason of any act, negligence or default of any company or person engaged in or responsible for carrying out any of the arrangements, or otherwise in connection therewith.

    I have read and agree to Agent's Terms & Conditions and understand and accept the Client Responsibilities on behalf of myself and for all travelers included in my party.
