Winterville Market on the Square Vendor Application

Every Market is free for Winterville Chamber of Commerce members, $15 for non-members. Members and non-members alike must submit this application. Fees can be paid via Square or check no later than 3 business days prior to the next event.

 

Market is for businesses, non-profits, and other organizations to sell their products or services to the community, as well as show the community their dedication to Winterville. Yard sale style vendors or duplicate vendors of the same craft or brand may be rejected. Priority is given to Winterville Chamber of Commerce members, then on a first come, first served basis.

*Certificate of Registration #: The State of NC Department of Revenue requires persons selling at markets to collect and remit sales tax. The DoR requires vendors to obtain a Certificate of Registration before beginning sales. This form, also known as a Sales & Use Tax form, is free to file. Because of this regulation, all vendors must submit a Certificate of Registration Number to be approved for the Market.  RULES:

1. All participants are required to operate throughout the vendor advertised hours (4-7pm Participants that close and/or depart early on may not be eligible to participate in future events.

2. All participants must only take up their designated 10x10 allotted space. If additional space is needed you may be required to pay for the extra spot. Please contact us with special requests.

3. The following items should not be sold or given away by vendors: Snap-N-Pops, Crazy Foam, Silly String, Fireworks, Stink Bombs, Disappearing Ink, Water Guns, Cap Guns, Knives, and any other weapons. The Chamber, Town, or police have the authority to ban any other items they deem unsafe or a nuisance. Violation of this policy would result in the vendor being ejected from the event and banned from returning, without refund.

4. Only one (1) specialty item vendor (ex. Thirty-One Gifts, Mary Kay, Avon, Tupperware, Scentsy, etc for each company will be allowed to display/sell at the event. This is a first come, first serve basis.

5. REFUNDS: By applying for the market, the vendor acknowledges and agrees that the Winterville Chamber of Commerce shall not be obliged to issue refunds under any circumstances on vendor space rental. The Winterville Chamber of Commerce is not liable or responsible for delays, cancellations, or postponements of the market due to inclement weather, war, government actions, strikes, or other matters beyond our control. It is up to the discretion of the Winterville Chamber of Commerce to hold a make-up date and honor paid vendor fees or not.

6. Vendors are responsible for informing themselves of and complying to all City, State, and Federal laws, health and safety regulations, and are responsible for any sales tax due. Vendors are also responsible for obtaining any certifications or permits that are required for their respective products.

Waiver:

I (we) hereby relieve the Winterville Chamber of Commerce and the Town of Winterville, and their agents and employees from any and all liability for any damage, loss, injury or costs associated with or arising from the applicant's use and presence at the market; and furthermore, I (we) agree to indemnify and hold the Winterville Chamber of Commerce and Town of Winterville harmless from all claims, costs, and actions occasioned by me for the use and presence at these market events.

 

I (we) have spoken to and obtained all permits and inspections required by the Town of Winterville, Pitt County, North Carolina, and the United States of America to legally and safely sell these products to the public for the intended use inwhich I (we) advertise and sell our goods. We understand that we must adhere to all regulations of this agreement and those of the Town of Winterville (parking, ordinances, fire regulations, tent, etc I (we) understand that I (we) must comply with any regulations or requirements of the Town of Winterville and/or the Winterville Chamber of Commerce and manager of the market. I (we) understand that by not abiding by the regulations or requirements of the Winterville Chamber of Commerce, Town of Winterville, Pitt County, North Carolina, the United States of America orthe Market Manager, I (we) will forfeit participation as a vendor, with no refund of pre-paid fees. I (we) agreeto allow the market manager or any government agency visit/tour your booth, farm, or business.

We do not expect our event space to reach vendor capacity, however if it appears that we are running out of vendor space, we will award spaces based on those who plan on attending the entirety of events and on a first come first serve basis - determined by the date in which we receive the vendor's completed application submission.
