LEGAL PROVISIONS
1. Agreement
By signing below, Vendor agrees to comply with and be bound by all restrictions, procedures, requirements, terms, and conditions set forth in this Vendor Application and Agreement.
2. Compliance with Market Rules
Vendor agrees to follow all Newtown Farmers Market rules and regulations, including the following:
- No smoking in playground areas.
- No destruction or defacing of structures.
- No littering. All trash must be placed in proper receptacles.
- No abusive or foul language.
- All pets must be leashed and cleaned up after.
- No ground fires are permitted.
- No illegal drugs.
- Firearms and fireworks are prohibited.
3. State Licensing Requirements, Important for Food Vendors
Food vendors are responsible for obtaining and submitting all required permits, licenses, insurance certificates, and food safety documentation applicable to their business and booth setup. Requirements may vary depending on the type of food or product being sold and may fall under the Florida Department of Agriculture and Consumer Services, FDACS, the Florida Department of Business and Professional Regulation, DBPR, or another applicable agency.
- Unprocessed Produce: Vendors selling whole, fresh fruits and vegetables may not need a state food permit for direct sales. However, vendors may need to register with FDACS if selling as a wholesale agricultural dealer or under other applicable requirements.
- Cottage Foods: Vendors selling eligible cottage food products, such as certain baked goods, jams, and dried goods, are responsible for following all Florida cottage food requirements, including sales limits, labeling rules, and product restrictions.
- Processed or Prepared Foods: Vendors selling temperature-controlled, potentially hazardous, prepared, or pre-packaged foods are responsible for obtaining the appropriate license or permit through FDACS, DBPR, or another applicable agency.
Applications will not be considered complete until all required vendor documents have been submitted and approved.
4. Waiver and Release
Vendor hereby releases, holds harmless, and agrees to defend Newtown Farmers Market and its directors, employees, representatives, and agents, collectively referred to as the “Released Parties,” from and against any liability, claims, and demands of any kind, whether in law or in equity, arising from Vendor’s participation in the Newtown Farmers Market.
By signing below, Vendor releases the Released Parties from any liability or claim related to bodily injury, personal injury, illness, death, property loss, or property damage that may result from Vendor’s participation in the event.
5. Indemnification
Vendor agrees to indemnify the Released Parties from and against any and all liabilities, losses, damages, costs, claims, expenses, demands, and causes of action of every kind and character arising out of or connected to Vendor’s participation in the event. This includes claims for personal injury, death, or property damage, whether or not caused or contributed to by the negligence, carelessness, or actions of Newtown Farmers Market or the Released Parties.
6. Termination of Privileges
Any violation of this Vendor Application and Agreement, the Newtown Farmers Market rules and regulations, or failure to follow the lawful directions of Newtown Farmers Market personnel may result in immediate termination of Vendor’s privileges and right to participate in the event. Under such circumstances, Vendor must immediately stop all vending booth activities and remove all personnel and materials from the event premises.
Vendor Handbook Requirements
- Tent weights are required.
- Vendors are responsible for cleaning up their booth space.
- Illegal or unsafe items are prohibited.
- Respectful behavior is required at all times.
- Setup must be complete before the market opens.
