1. Terms of Payment. Student agrees to pay the above selected payment option {paymentOption} for YTT on the following terms:
a. Student will pay a deposit of $500.00 or in full to secure a spot in YTT.;
b. All YTT course fees must be paid prior to the start of the YTT;
c. The course fees are nonrefundable, unless Studio agrees to give Student credit for the fees paid toward the cost of a later YTT, if offered by Studio;
d. In the event Student is forced to cease attending YTT and/or cannot successfully complete all requirements due to an unforeseen circumstance which is unavoidable, such as a death to a family member or a disability of the Student, Studio may grant Student a place in a subsequent YTT, if offered by Studio;
e. No cash refunds will be offered.
2. Payment Plans. Studio may, in its discretion, agree to allow Students to submit payment through installments for the cost of YTT. The only exception to the conditions required in Paragraph I is Studio's written agreement to accept payments pursuant to a payment plan under this Paragraph.
3. Attendance and Completion of YTT. Student agrees to attend each YTT session. In the event Student fails to attend YTT sessions at least 90-percent of the time, Student may be removed from the YTT or be required to make up missing requirements in order to successfully complete YTT. Upon written agreement with and at the discretion of Studio, Student may obtain supplemental or makeup session assistance from a Studio representative. Studio may charge additional fees for supplemental or makeup sessions. Student has 3 months after completion of YTT to complete any missed work or exams, or Studio will not certify Student's passage of YTT.
4.Terms for Completion of YTT. Student's completion of YTT will be contingent upon, but not limited to, completion of the following conditions:
a. Student will undergo an intensive assessment period of teaching. This will be assessed and evaluated by Studio representative. Student will also prepare a presentation on one aspect of yogic theory which will be evaluated by a Studio representative and an external assessor if available;
b. In order to receive the yoga teacher training certificate from Studio 4:8 School of Yoga, Student will need to demonstrate they have inculcated the asanas, Biblical philosophy of yoga, and pranayama to standard, whereby Student demonstrates that they can teach with confidence from their own experience of the practice;
c. Student will compose several yoga class plans and lead a class from beginning to end to include, asanas (from one specific group), pranayama, and a relaxation technique. Student will discuss their yoga class plan, including in particular a discussion on how and why they chose that particular structure;
d. Student must demonstrate a yogic attitude through their conduct over the course, their homework, and yogic attitude encompassing the yamas and niyamas, specifically; and e. All other written or oral directives provided by Studio instructors and representatives.
5. No Guarantee of Passage or Certification. Student understands and agrees that taking the Studio's YTT is not a guarantee of passing the course, graduating, or obtaining any subsequent certification. Students who fail to complete YTT successfully may be provided with a foundation level certificate.
6. Representations of Student. Student represents that he or she is physically and mentally able to perform all of the required components of YTT. Student should seek the confirmation of their physical and mental capability with their healthcare provider prior to signing this Agreement, and if not Student agrees that he or she had adequate time to do so prior to signing the Agreement. Student understands all activities required of YTT; has had an opportunity to ask questions and seek additional information about YTT; and has undertaken sufficient investigation of the required activities and hereby assumes them voluntarily. Student hereby agrees to indemnify and hold harmless Studio for any damages or other costs incurred by Student as a result of participating in YTT, to the maximum extent permitted by law. Student represents that Student has adequate insurance coverage for all activities required by YTT, or that Student has elected not to have insurance at his or her own risk.
7. Registration with Representative Agency. Student agrees that Student is required to register with a representative agency, such as Christian Yoga Association, upon successful completion of YTT and that Studio has no obligation to register Student or assist the Student in registering with such agency.
8.Copyright and Ownership of YTT Material and Instruction. Student agrees that all course material and instruction methods are copyrighted works held by Studio, to the maximum extent authorized by law. Student has no rights of duplication, copying, or any other use of YTT works. Student's license to access YTT works is strictly limited to taking and completing YTT. As such, Studio may alter the structure of YTT as it deems appropriate with or without notice to Student.
9. Restrictions on Use of YTT. Student agrees that Student will not actively solicit any current client of Studio's. Student may not utilize the materials from YTT to hold himself or herself out as being in any way endorsed or supported in competition with Studio within a 10 mile radius of Studio.
10. Entirety of Agreement and Amendments. Student certifies that Student has read the foregoing Agreement, fully understands its terms and conditions, and agrees that it constitutes the entire agreement; and that no representations, promises, agreements or undertakings, written or oral, that are not contained herein shall not be of any force or effect. This Agreement may be modified only by a written instrument signed by Student and Studio.
11. Applicable Law. This agreement shall be governed by and construed in accordance with the laws of the State of Nebraska.
