WARNING:Under North Carolina law, an equine activity sponsor or equine professional is not liable for an injury to or the death of a participant in equine activities resulting exclusively from the inherent risks of equine activities.

Chapter 99E of the North Carolina General Statutes:

DECLARATION: I desire to participate, at my own risk, in an equine activity. I have been informed and fully realize that there are inherent risks and dangers associated with equine activities and that injury, loss, damage or death could result from my participation. However, I knowingly and willingly wish to participate in this activity. In consideration, therefore, for the privilege of riding and/or working around horses at Hidden Springs Stables, located at 9733 Walter Myatt Rd, Fuquay Varina, NC 27526, and for the receipt of other valuable consideration the receipt of which is hereby acknowledged. I hereby covenant and agree, for the express benefit of Hidden Springs Stables and/or Michelle Stephenson, its directors, instructors, shareholders, officers, employees, independent contractors, all 4-H horse club, Saddletree Stables, volunteers, lessors, agents, attorneys, successors, and assigns (the “Benefitted persons”), as follows:

Release and Covenant Not to Sue: I do hereby release the Benefitted Persons from any and all liability or responsibility for accident, damage, injury, or illness to me, my horse(s), any member of my family or his personal representative, or any of my guests arising out of any occurrence on or around the premises of Hidden Springs Stables. I further release any landowner who permits me to use his lands without charge for riding or other activity in accordance with the North Carolina Landowner Liability Act. I hereby covenant not to sue any of the Benefitted Persons and knowingly and voluntarily relinquish any claims, for myself and anyone claiming through me, hereafter existing which I, my personal representative, insurers, assignees, or subrogees may have against them, including claims arising out of negligence of the Benefitted Person.

Hold Harmless and Indemnification: I do hereby covenant and agree to hold harmless and indemnify the Benefitted Persons for any loss, liability, or responsibility for accident, damage, or injury resulting from my acts of omissions, or the actions of my horse(s) or from suits brought by my personal representative, family members, guests, insurers, assignees, subrogee, or other persons claiming through me or who were on the premises at my invitation.

Enforcement: I understand and agree that any of the Benefitted Persons may enforce any terms of this agreement and agree to reimburse any and each of them in the event they are reasonably required to bring an action for enforcement of this agreement for their costs and expenses incurred in such action, including their reasonable attorney’s fees.

Safety Guidelines Section
Hidden Springs Stables Lesson and Safety Guidelines
1. All students under age 18 MUST wear an ASTM approved helmet. While we do have helmets available, we do encourage you to have your own. Riders over age 18 are strongly encouraged to wear a helmet while mounted. We will ask you to sign a waiver if you do not wish to wear a helmet.
2. If the student is unable to groom and tack their own horse, their lesson will include learning how to do so safely.
3. Please be ready for your lesson at the designated time to assist in getting your horse ready for your lesson. If you are late to your lesson you will lose that time from your lesson. We recommend arriving at least 15 minutes before your designated lesson time unless told otherwise by your instructor.
4. Riders must wear a shoe or boot with a heel while riding. Open toed shoes or sandals should not be worn around horses.
5. Riders must wear long pants. Shorts are not acceptable riding attire.
6. Long hair should be secured in a safe manner. Pony tails or hair nets are recommended (but not required) to help keep hair out of the riders eyes.
7. In the event of bad/severe weather, we will contact you prior to your lesson. If in doubt, please contact your instructor prior to your lesson time. Cancellations by your instructor due to weather are not subject to cancellation fees.
8. Payment is due at the time of your lesson. Lessons may be purchased ahead of time. Participation in horse shows, seminars or other events are payable separately from lesson fees and due before the event.
9. Please leave your dogs or other small pets at home.
10. If you must cancel your lesson, please allow 24 hours notice so that your instructor can adjust their schedule. Repeated cancellations will result in the necessity of pre-paying your lessons. Cancellations with less than 6 hours notice are subject to a $20.00 cancellation fee. No Call, No Show are subject to Full Lesson Fee.
11. Payment is due at the beginning of each lesson. There is a $5.00 late payment fee if you do not pay for your lesson at the time of service. Pre-pay options are available for your convenience.
