RELEASE WAIVER: INDEMNIFICATION of LIABILITY

AND EXPRESS ASSUMPTION OF RISK

WMCC ADOPT a CRAG - TRAIL & CLEANUP PROJECT

THIS IS A LEGALLY BINDING RELEASE WAIVER. Please read it carefully before signing. Minors (under 18 years of age) are not allowed to participate unless this waiver is signed by a parent/s or legal guardian/s. Participation by institutional groups, such as colleges and universities, must be formally sanctioned by the institution. These activities include inherent and other risks including hazards and dangers that can cause or lead to serious personal injury, property damage, illness, mental or emotional trauma, paralysis, disability or death to participant or others.

I agree to release, indemnify and hold harmless WMCC (Western Massachusetts Climbers' Coalition), its officers, directors, members, agents, volunteers, affiliates and all Landowners and/or Land Management Agencies on whose property the project takes place (collectivelt, the "Released Parties") from and against any and all claims, demands, liabilities, damages, suits, losses, costs or expenses (including reasonable attorney's fees), including claim/s resulting from WMCC's negligence, or those of any other party or participant, arising out or resulting from my participation in the event, including but not limited to personal injury, property damage, or wrongful death, wether caused by negligence or otherwise. This indemnification obligation shall survive the completion of the activity and/or termination of the agreement. I agree that the laws of Massachusetts govern this Document and all aspects of my relationship with WMCC, and that any mediation, suit, or other proceeding must be filed or entered into only in Massachusetts.

I hereby affirm that I have read and understand this liability release and express assumption of risk and agree to every term and condition. I sign this document below on behalf of myself my family members, my heirs, executors, representatives and estate.
