*** All Persons under 16 Years MUST have a person 18 Years or older. ***

*** Paddleboards NOT Allowed to cross in front of Kingston Ferry Terminal while vessell is coming or going.***

*** Each person MUST Have Valid Driver's License or ID TO RENT PADDLEBOARDS. ***

*** All Paddleboards MUST Be Returned Before Sunset Unless Longterm Rental. ***

*** Each person MUST Complete Liability Waiver. ***

*** All Paddleboards MUST be returned to A Sea the Sound Charters representative. ***

*** No consumption of Alcohol or Drugs while renting equipment. ***

*** Paddleboards have a MAX of ONE person. ***

Terms and Conditions of Paddleboard Rental

II. Responsibilities and Rules

I understand that my Drivers’ License/State issued ID and/or major credit card may be held as a security deposit during the rental duration and will be returned upon return of all rented equipment. Rentals are due back within business operating hours on the same rental date (unless longterm rental agreement)or I will be charged the retail value of the rented equipment. I understand that due to unforeseen inclement weather, I may be required to return the rented equipment IMMEDIATELY (without refund) as required by Sea the Sound Charters LLC. I am responsible for the return of this equipment in the same state in which I received it. I agree to pay in full, retail value, for any repairs or replacement if the equipment is damaged or lost, and/or a retrieval fee if Sea the Sound Charters LLC has to retrieve any rented equipment, this includes rescues. I further agree to make every reasonable effort to return all equipment to the point-of-sale location. I AM AWARE THAT KAYAKING/CANOEING/PADDLEBOARDING IS A DANGEROUS SPORT AND I AM AWARE OF THE DANGERS OF KAYAKING/CANOEING/PADDLEBOARDING. I UNDERSTAND THAT LONESTAR ADVENTURE SPORTS IS IN NO WAY RESPONSIBLE FOR MY SAFETY OR THE SAFETY OF THE EQUIPMENT I AM RENTING.

*I understand that I will need to complete the Waiver and Release of Form Liability prior to commencing my rental agreement with Sea the Sound Charters LLC. I further state that I am of lawful age and legally competent to sign this agreement. I also understand that this is a contract and not a mere recital, and I agree I have signed this contract as my own free act.

I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS AGREEMENT BY READING IT BEFORE I SIGNED.

III. Acknowledgement

In consideration of being allowed to participate in any way in this equipment rental, related events and activities, the participant appreciates and acknowledges: 1) I understant the risk of injury or illness from the activities involved in this equipment rental is significant, including the potential for permanent paralysis and death; and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury or illness does exist; and, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM ALL NEGLIGENCE OF THE RELEASEES or others and assume full responsibility for my participation; and, 2) I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such hazard to the attention of the nearest park staff immediately; and, 3) I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS SEA THE SOUND CHARTERS LLC OF HANSVILLE, WA and the event host/sponsor/location/organization or club named herein; their officers & directors, officials, contractors, agents, and/or employees, other participants, sponsoring agencies, commissions, sponsors, advertisers, volunteers, steerers, and, if applicable, owners and lessors of premises used to conduct club activities/ special event (“RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE. 4) I also acknowledge that photographs and video may be taken of me in my participation in, and attendance at this event or location, and hereby freely agree to allow without restriction all uses of such photos and videos in the reporting of club activities, special event, and/or in the promotion of such, its location, other sporting events, activity in general, and/or related purposes. By signing below I acknowledge that I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY. I ACKNOWLEDGE THAT THE INFORMATION THAT I HAVE PROVIDED IS ACCURATE AND TRUE. I AM OF SOUND MIND, UNDER NO INFLUENCE OF ALCOHOL OR ANY OTHER SUBSTANCE THAT COULD IMPAIR MY JUDGEMENT TO MAKE A DECISION OR DRIVING ABILITY.

** I acknowledge that I am not under the influence of drugs, alcohol, or any other substance that could impair my judgement to make a decision. **

** I acknowledge to keep my Life Jacket (PFD) on at all times and not remove it until I have returned the kayak or paddleboard to Lonestar Adventure Sports. **

By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, that I may be found by a court of law to have waived my right to maintain a lawsuit against Lonestar Adventure Sports on the basis of any claim from which I have released them herein. I have had sufficient opportunity to read this entire document. I have read and understood it and I agree to be bound by its terms.

IV. Authorization

I fully authorize SEA THE SOUND CHARTERS LLC to charge my Debit/Credit Card for the rental equipment, and for any and all damages, fuel surcharges and other expenses that are accrued with this equipment rental activity.

Note to Participant

Participation in any water sport exposes the participant to certain risks and dangers. Accidents and injuries (superficial to fatal) resulting from the forces of Mother Nature, boaters (both power and sail), malfunctioning equipment, unseen obstacles and your own misjudgments are a very real possibility.
Sea The sound Charters LLC considers safety to be its utmost concern. The nature of these sports however, makes it impossible to foresee and protect the participant from all conceivable dangers associated with water and water sports. Once the participant leaves the safety of the shore and enters the water, he/she must be prepared to assume all risks associated therein.

AFFIRMATION AND LIABILITY RELEASE THE UNDERSIGNED CERTIFY THAT THEY HAVE READ THE FOREGOING PRIOR TO THE SIGNING THEREOF AND AGREE AS FOLLOWS:

I hereby affirm that I understand the inherent dangers of Windsurfing, kayaking, Stand-up Paddle Boarding (SUP) and tubing.
I hereby agree to indemnify and hold harmless Sea The sound Charters LLC , its staff, and affiliates , the State of Washington, the Port of Kingston and the City of Kingston from any and all liability for harm, injury, death, or damages (physical, mental/emotional, monetary), regardless of fault or negligence which may befall me while participating in this sport or while using Sea The sound Charters LLCequipment or facilities. This release shall be binding upon my family, heirs, and administrators.
The undersigned certifies that the participant/renter is a proficient swimmer and agrees to be tested by Big Bus Paddle Sports to determine the participant/renter’s level of proficiency if requested. Participant/Renter agrees to wear a life vest.
I hereby agree to heed at all times the advice and instruction of the Sea The Sound Charters LLC staff and to practice common sense water safety procedures.
To the extent provided by State Law, I also freely and voluntarily waive all claims for damages or loss to my person or property, or the person or property of third parties that may be caused by an act or failure to act. I hereby release all third parties from any and all claims.
I CERTIFY THAT THE ABOVE INFORMATION IS CORRECT TO THE BEST OF MY KNOWLEDGE:

*** If under the age of 18 you must have a parent or legal guardian sign this waiver before you may participate in any relation to the equipment rental in the location named herein. NO PERSON UNDER 16 YEARS OLD MAY RENT EQUIPMENT WITHOUT AN ADULT ON THE WATER WITH THEM AT ANY TIME FOR ANY REASON. EACH PERSON MUST HAVE A VALID DRIVERS LICENSE. ***
