The Release and Waiver of Liability excuted on:

Releases Delmarva Discovery Center & Museum Inc. a non-profit corporation organized and existing under the laws of the State of Maryland and each of its directors, officers, and agents.  The volunteer desires to provide services for Delmarva Discovery Center & Museum Inc.   and engage in activities related to serving as a volunteer by performing associated duties.  A Volunteer is defined as, someone who participates in humanitarian, charitable or civic service without compensation.

Volunteers understand that the scope of a volunteers’ relationship with Delmarva Discovery Center & Museum Inc. is someone who participates in humanitarian, charitable or civic service  is limited to a volunteer position at Delmarva Discovery Center & Museum Inc.    that no compensation is expected in return for services provided by volunteer.  That Delmarva Discovery Center & Museum Inc.  will not provide any benefits traditionally associated with employment to a volunteer; and that the volunteer is responsible for his/her own insurance coverage in the event of personal injury or illness as a result of volunteer services to Delmarva Discovery Center & Museum Inc..

 (1)  Waiver and Release:  I, the volunteer, release and forever discharge and hold harmless Delmarva Discovery Center & Museum Inc.  and assigns form any and all liability, claims, demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise for the services I, the volunteer/contractor, provide to Delmarva Discovery Center & Museum Inc..  I understand and acknowledge that this Waiver and Release discharges Delmarva Discovery Center & Museum Inc. from and liability or claims that I may have againstDelmarva Discovery Center & Museum Inc. with respect to bodily injury, illness, death, or property damage that may result from the services that I provide to Delmarva Discovery Center & Museum Inc. or occurring while I am providing volunteer services.

 (2)  Insurance:  Further, I understand that Delmarva Discovery Center & Museum Inc.  does NOT assume any responsibility for or obligation to provide me, the volunteer, with financial or other assistance, including  but not limited to medical health or disability benefits or insurance of any nature in the event of such injury or medical expenses incurred by me.

 (3)  Medical Treatment:  I hereby release and forever discharge Delmarva Discovery Center & Museum Inc.  from any claim whatsoever which may arise or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with any emergency during my tenure as a volunteer with Delmarva Discovery Center & Museum Inc. .

 (4)  Assumption and Risk:  I understand that the services that I provide to Delmarva Discovery Center & Museum Inc.  may include activities that may be hazardous to me, including but not limited to any animal related activities, such as handling, feeding, and cleaning up after the animals.  Also, bending and lifting of animal supplies and Delmarva Discovery Center & Museum Inc.supplies and/or equipment.  I hereby expressly assume the risk of injury or harm from these activities and release Delmarva Discovery Center & Museum Inc.   from all liability for injury, illness, death or property damage resulting from the services that I provide as a volunteer or occurring while I am providing volunteer services at Delmarva Discovery Center & Museum Inc..

 (5)  Photographic Release:  I grant and convey to Delmarva Discovery Center & Museum Inc.  all the right, title, and interests in any and all photographs, images, video, or audio recordings of me or my likeness or voice made byDelmarva Discovery Center & Museum Inc.  in connections with my providing volunteer services to Delmarva Discovery Center & Museum Inc.

 (6) Animal Care:  I understand that I will be working with animals that have been rescued and possibly/likely have abuse in their past.  I understand that while volunteering I am not here as a hired trainer or animial handler for these animals to rehabilitate and will not attempt to train nor correct any animal behavior I may encounter.  I understand that I will follow all instructions for the care and handling of the reptiles, aquatics and otters housed here at the museum. I understand that if I do any of these things I could be asked to leave the facility grounds.

 (7)  Dress Code and Professionalism:  As a volunteer with Delmarva Discovery Center & Museum Inc.  you are a representative of the organization and personal cleanliness and good grooming are essential.  Your personal appearance and dress should be clean, neat and professional at all times. Delmarva Discovery Center & Museum Inc.  T-Shirts are encouraged for volunteers. Your conduct should also be professional.  Foul language and rowdiness will NOT be tolerated.  As well, good customer service is expected of you if you are speaking to potential adopters.

(8)  Other:  As a volunteer,  I expressly agree that this Waiver and Release is intended to be as broad and inclusive as permitted by the laws of the state of Maryland and that this Release shall be governed by and interpreted in accordance with the laws of the state of Maryland.  I agree that in the event that any clause or provision of this Waiver and Release is deemed invalid, the enforceability of the remaining provisions of this release shall not be affected.

I hereby agree to accept a position as a volunteer for Delmarva Discovery Center & Museum Inc. I acknowledge I have read and accepted these conditions

If under the age of 18 you must have a parent or legal guardian sign this waiver before you may participate in any activities at or for Delmarva Discovery Center & Museum Inc.

Volunteer Release For Minors (under the age of 18)

Being the parent or legal guardian of the “Minor” hereby consent to and authorize the Minor to act as a volunteer for Delmarva Discovery Museum. I acknowledge and agree that activities performed by the Minor as a volunteer will be performed strictly voluntarily, without any pay, compensation, or benefits. I agree and understand that the Minor must comply with the rules and regulations established from time to time by Delmarva Discovery Museum and that failure to do so may result in the Minor’s immediate removal as a volunteer. 

I am aware of the nature of the activities to be performed by the Minor as a volunteer and recognize that in performing volunteer tasks, a risk of harm or injury exists. I agree that all volunteer activities are to be performed by the Minor at the Minor’s risk and I assume full responsibility therefore.

On behalf of myself, the Minor, and our respective heirs and personal representatives, I agree not to hold or attempt to hold Delmarva Discovery Museum their population served, volunteers, or staff responsible for any injury or damage sustained or incurred by the Minor, arising out of or in any way connected with the Minor’s activities as a volunteer for Delmarva Discovery Museum. I hereby release and discharge Delmarva Discovery Museum, their employees, and their volunteers from any and all claims, demands, and causes of action of any nature or cause, for any such injury or damage incurred or suffered by the Minor.
