TENTATIVE BOOKING: The availability calendar on the booking form is tentative and may not fully reflect the photographer's current availability. Final confirmation depends on potential overlaps with other sessions, including travel time considerations. The photographer will contact the client to confirm the requested date and time. If the requested slot is not available, the photographer will work with the client to find an alternative date or time that suits both parties.

RETAINER & SESSION PAYMENT AGREEMENT: I have read and agree to the following statement: I understand that my session is not confirmed until a non-refundable retainer of $100 is paid. Retainer is paid only via Zelle to 832-963-3925 registered under Dennis Davila. When I "submit" this form I will complete my retainer payment. I understand that my remaining session balance is due at the time of my session. Should the remaining/final balance not be paid my images will not be released. By choosing "I Agree" I understand and agree to the terms and conditions set forth by Captured by Dee HTX as stated.*

STUDIO/LOCATION FEE: If the Client selects a session at a studio or outdoor location that requires a rental fee, both the $100 retainer AND the full rental fee must be paid at the time of booking to confirm the session.

BOOKING CONFIRMATION & RETAINER POLICY: A confirmation text will be sent after receiving the booking form. Clients must send the retainer within 24 hours of booking (unless otherwise agreed in writing for special promotions). If a different method of payment is needed, please inform the Photographer upon receiving the confirmation text. Failure to send the retainer within 24 hours will result in automatic cancellation of the session.

CANCELLATION & RESCHEDULE POLICY:You may cancel or reschedule your photography session up to 5 days before your scheduled session by messaging us directly via social media or text. Please note, no refunds will be issued for cancellations or changes, but you will receive a credit for the retainer paid, which can be applied toward a future session. This credit will expire 90 days from the date it was paid. Cancellations or rescheduling requests received less than 3 days before the session start time will result in the forfeiture of your retainer and no credit will be given, unless an exception is made at the photographer’s discretion for reasons beyond control, such as weather. NO REFUNDS WILL BE GIVEN. You are permitted to reschedule your session only once using your retainer credit. Any further rescheduling will require a new retainer to be paid. Exceptions to rescheduling may be made at the photographer’s discretion in cases of factors beyond control. Sessions booked using a reschedule credit may be canceled but will not be eligible for a new credit.

STUDIO/LOCATION FEE/ RESCHEDULING POLICY: If a session is scheduled at a studio or outdoor location that requires an additional fee, the Client understands that rescheduling may result in forfeiture of those fees. The Photographer cannot guarantee a refund for location fees, as this is subject to the policies of the venue. The Client accepts the risk of losing the fee if rescheduling occurs and agrees to pay any new fees required by the venue. The Photographer is not responsible for the policies or fees of rented studios or locations.

WEATHER POLICY: Cancellations due to weather will be made at the Photographer's discretion. If inclement weather is expected to interfere with the quality or safety of the session, the Photographer will communicate the need for rescheduling. Every effort will be made to reschedule as soon as possible.

TARDINESS POLICY: Tardiness on the part of the Client will not delay the session. The session will remain within the originally scheduled time frame, and no additional time will be granted. The Client is only guaranteed the time between the original start and end time as agreed upon.

TURNAROUND TIME: Delivery is guaranteed within 2-3 weeks from the date of the session. Galleries are delivered on business days only and not on weekends, unless explicitly stated otherwise in written communication with the Client. The Photographer will communicate the exact delivery date to the Client in written form (via text, email, or social media message) after the session. The Client can expect to receive the gallery before/by 11:59 PM on the communicated date. The Photographer will notify the Client if there are any changes or delays to the delivery date

SNEAK PEEKS & EARLY PHOTO REQUESTS: Photographer does not provide “sneak peek” images prior to gallery delivery. If Client wishes to receive specific images early, a fee of $20 per photo will apply. On occasion, if discussed and approved prior to booking, Photographer may be able to provide 1–3 images in advance at no additional fee due to a special event, urgent need, or if Photographer’s schedule allows. All early image requests must be discussed with and approved by Photographer before the booking form is submitted. Requests made after booking are not guaranteed and remain subject to Photographer’s availability and discretion.

IMAGE SELECTION: Depending on the package selected, Clients will choose a designated number of images from the online gallery. Clients must make their selection within 5 business days from the date the gallery link is sent.The Photographer will send up to 1 notice to the Client reminding them to make their selections. If, after the first notice, no images are chosen within 48 hours by the Client, the Photographer will proceed to select the images on their behalf. The final selection will be based on the Photographer's discretion and may differ from the Client's preferences.

ARTISTIC RIGHTS & CLIENT REVIEW: The Photographer retains full discretion in selecting the photographic materials released to the client. Clients understand that no RAW (unedited) images will be released under any circumstances. By signing this agreement, the client affirms that they have reviewed the photographer's previous work and portfolio, acknowledging the style and quality of the photography they can expect.

UNCOOPERATIVE BEHAVIOR/RE-SHOOTS: All sessions are non-refundable. Re-shoots will be considered at the sole discretion of the photographer and will not be granted for reasons including, but not limited to, poor choices of clothing, makeup, or hair, or failure to follow the photographer's recommendations. Additionally, uncooperative behavior by any individual being photographed—such as lack of participation, unwillingness to follow directions, or disruptive actions—does not warrant a re-shoot, refund, or additional services. The session time allocated is final, and all photos taken during that time will be delivered as captured. The photographer will make every effort to encourage cooperation; however, specific results cannot be guaranteed in such circumstances.

RESPONSIBILITY FOR MISSED PHOTOS: The photographer is not responsible for any photos not taken during the session. Throughout the session, the photographer will ask the client if they are satisfied with the shots and if additional images are needed. Due to time limitations, not capturing certain photos is not considered the photographer's fault. Clients are responsible for booking the appropriate amount of time to meet their family’s needs. If assistance is needed in determining the ideal session duration, please let us know, and we will be happy to recommend the best options to ensure your session meets your expectations.

MODEL RELEASE: I have read and agree to the following statement: I commission Captured by Dee HTX, the photographer, to photograph myself and/or my spouse and/or underage children. I grant Captured by Dee HTX permission to use these images for purposes including, but not limited to, social media, advertisements, and other promotional materials. This usage is without compensation. If I choose "Disagree" but later wish to allow the use of specific images, I will provide written permission via text, email, or social media messages. Without such written permission, Captured by Dee HTX will not use any images for public purposes.

COPYRIGHT & POLICIES: As a client of Captured by Dee HTX, I acknowledge that all images taken by Captured by Dee HTX (the photographer) are protected by Federal Copyright Laws. I understand it is illegal to scan, copy, print, or reproduce these images in any way for commercial use without the photographer's explicit permission. Violations of this law may result in civil and criminal penalties. A limited PRINT RELEASE is provided with the purchase of a session, which includes high-resolution digital files. This release allows personal printing at chain photo labs (e.g., Walgreens, CVS), downloading, saving to a hard drive, and posting on personal websites or social media, as long as it is not for commercial use. The images cannot be altered in any manner, and they cannot be used for resale, advertising, or other commercial purposes without the photographer's permission. By selecting "I Agree," I confirm that I will honor and comply with the terms outlined above.
