Booking Agreement Terms and Conditions
CONFIRMATION, DEPOSIT AND PAYMENT
To confirm a booking, approve the quote via email and return the signed terms and conditions via the JotForm link provided. Upon confirmation of your booking, you will receive an invoice for the Event.
When booking your Event at The Little Bar Cart HQ, a 50% deposit is required at the time of booking to secure your date. Please note, deposits are non-refundable. The remaining amount including a $500 bond is to be paid no later than 7 business days before the Event.
Your booking is deemed confirmed, only once the deposit is received by TLBC.
CANCELLATION AND REFUNDS
Please note that booking deposits are non-refundable. If a cancellation is made 7 days or less prior to the Event date, no refunds will be given, and the full amount of the Event will be payable.
The Little Bar Cart “(TLBC)”, shall not be liable for any interference, disruption, or enforced cancellation of any part of a booking which caused by civil disturbance, terrorism, act of God or any circumstance which is beyond the control of TLBC.
TLBC, at its discretion, may prohibit any performance or function which in its sole opinion is considered objectionable or dangerous or which is contrary to law, or which would be detrimental to the good standing and reputation of TLBC. In any case, the Hirer shall be deemed to have consented to the prohibition and TLBC shall not be liable for any loss or damage suffered by the Hirer in direct or indirect consequences of TLBC’s prohibition of any performance or function of the Hirer.
BOND
A refundable $500 is charged as a bond and refunded after your Event, minus any breakages or damages.
SECURITY
A professional security guard is included in the pricing of all Friday and Saturday event bookings.
NOISE
All levels of music and noise must comply with City of Stirling council standards.
Music and noise levels must be turned off at 12 am (midnight). The Hirer must ensure that any street activity is minimal to ensure disturbance to neighbours is limited. In the instance of complaints or fines, the costs will be passed onto the Hirer.
NO SMOKING VENUE
Cigarettes, tobacco products and Vaping are strictly prohibited, both inside the Venue and within the grounds of the site. Any activities involving any of the above-mentioned products must be undertaken outside the boundaries of the site as directed by staff and security.
PARKING AND TRANSPORT
Free Parking: There is free street parking directly in front of the Venue on Edward Street.
Public Transport: The Venue is a 10-minute walk from Glendalough Train Station.
VENUE ACCESS
The Hirer and Guests must arrive and depart at the agreed times, or the agreed bump-in time/Event start time and Event end time. Failure to adhere to the agreed times may incur additional charges.
Guests are requested to remain inside the Venue for the duration of the Event. Please respect all other tenants within the property by remaining within the boundaries of The Little Bar Cart HQ.
Access is restricted to only the ground floor space at the Venue, and no access is permitted to the first floor for any reason. Attempts to enter the first floor of the Venue by any Guest may result in termination of the Event at the sole discretion of TLBC and its staff.
The booking agreement does not create any lease or tenancy of The Little Bar Cart HQ but is merely a license to occupy the premises for the agreed period.
TLBC reserves the right to remove any agents, employees, invitees, or contractors of the Hirer from the premises if those persons break any obligations of the Hirer or engage in any conduct deemed objectionable by TLBC and its staff.
THE EVENT
The times of the Event are set by the Hirer.
The Hirer will not invite or permit more than the agreed number of Guests to attend the Event. (75-person capacity). The Little Bar Cart HQ its representatives, employees or agents reserve the right to;
a) refuse entry to any persons in the opinion of The Little Bar Cart HQ posing a safety or security risk or in the vicinity of the Property during, immediately prior to or immediately following the Event.
b) request proof of invitation or identification from each or any Guest, without which entry to the property may be refused.
At the time of booking, the Hirer must appoint a person organised to be the sole point of contact for the staff on duty “Duty Manager”. The Hirer must remain in the Venue throughout the Event to liaise with the Duty Manager in monitoring the Event and to accomplish orderly departure of Guests.
The Hirer will ensure that all Guests leave the Venue quietly and that no disturbance is caused to residents or business as result of the departure of Guests from the Event at any time; and that all Guests leave the Venue no later than 15 minutes after the scheduled end of the Event.
RIGHT OF GOOD ENTRY AND GOOD ORDER
The right of entry to all parts of the Venue is always reserved to TLBC and its officials and employees and any other persons authorised by it. The Hirer shall be responsible that good order is kept in the Venue and TLBC reserves the right to terminate any Event not properly conducted. The assessment of the conduct of an Event rest with the Duty Manager and s/he has full authority to act on behalf of TLBC.
The Hirer must conduct themselves in a responsible manner with due consideration to any other Guest, Venue staff or their agents, visitors, or members of the public. The Hirer and their Guests must refrain from any behaviour, which would bring the Venue into disrepute or cause discomfort/risks to others.
The Hirer has an obligation to tell all Guests about these terms and conditions, to give them details to ensure that they comply with them. It is a condition of the Booking that the Hirer accepts the terms and conditions and has made all Guests who are party to the Event aware of them. Each Guest must individually comply with the terms and conditions. The Venue will enforce the terms and conditions against Guests individually where relevant.
BEVERAGE SERVICE
The Little Bar Cart HQ can be a BYO Venue, or TLBC in conjunction with its supply partner Universal Bar Off-Site Events “(UBOSE)”, can supply alcoholic and non-alcoholic beverages to the Hirer for consumption on the premises only. No Drinks supplied by UBOSE at The Little Bar Cart HQ can be taken away from the premises.
TLBC reserves the right to enact its obligations under The Liquor Control Act 1988, which includes but not limited to refusing service to any Guest, and the ability at its discretion, to ask any patron to leave the premises.
EVENT AMENDMENTS
Any changes to the times of the Event must be requested before a booking is confirmed. Extensions to hire times incur additional charges. No variation in times will be permitted once an Event has started. TLBC reserves the right to refuse any request to increase the party size or time length; if this results in a cancellation, the cancellation policy still applies. Any additional goods or services provided by TLBC will incur the relevant fees.
FOOD SERVICE
TLBC does not provide cooking or warming facilities at The Little Bar Cart HQ. Food service must be provided via the following methods;
a) Bought in by the Hirer and ready to eat.
b) Prepared and Served via a food vendor organised by the Hirer, where all preparation is to be done in the allocated area at the Venue, which is parking bay #11 outside the Venue. Details of the food vendor must be provided to TLBC 7 days prior to the Event.
c) Prepared and Served via a food vendor organised by TLBC.
In the Event the Hirer organises Food Service by TLBC, final numbers and food order is required 14 days prior to the Event, at which time full payment is required for this service.
PURPOSE OF THE EVENT
The Hirer must fully and fairly represent the purpose for which the Venue is required. Any misrepresentation may result in cancellation of the Event at any time by TLBC. Under no circumstance may the Hirer sub-let further offer for hire any of the Venue booked. Planned sponsorship of the Event must be fully disclosed prior to the booking and will be allowed only with the full agreement by TLBC.
No ticketed public Events are permitted at the Venue.
PUBLICITY AND MEDIA
The Hirer will not disclose to any third party the existence of any contract into which it enters with TLBC, and will not authorise the use of the name The Little Bar Cart, or The Little Bar Cart HQ.” or any of its intellectual property in any publication whether electronic or in hard copy other than in connection with the production, circulation or distribution of advertising or publicity material for the Event which shall for the avoidance of doubt require TLBC’s consent.
INSURANCE
TLBC holds Public Liability Insurance to the value of $20,000,000.
HIRER'S RESPONSIBILITY
To the fullest extent permitted by law TLBC shall not be liable for;
a) Any damage to property of the Hirer and their Guests.
b) Any inconvenience or loss caused to any party of the Hirer or their Guests.
c) Any inconvenience or loss caused to any party because of cancellation or termination of the Event.
The Hirer and their Guests are responsible for wilful or negligent loss and/ or damage to Venue furniture and equipment. Any costs of making good any damage will be charged to the Hirer. Any costs incurred by TLBC due to failure by the Hirer to adhere to the Terms and Conditions - including but not limited to: time overrunning of the Event, requirement for extra staff, requirement of additional glassware, furniture etc - will be invoiced to the Hirer.
All furniture and equipment including glassware and furniture has been inventoried and may not be transferred to any other area other than the area hired under the Booking. Rules, regulations, technical advice, or other requests reasonably made during the running of an Event by the Duty Manager of Venue staff should be adhered to.
All personal items bought onto the premises, shall be removed by the Hirer immediately after the Event.
SAFETY AND EMERGENCY PROCEDURES
The Hirer must comply with all laws relating to public buildings and overcrowding and obstruction of passages, corridors, and emergency entry/exit points. The Hirer must keep all exits and exit paths clear during the function and know where emergency equipment is located.
The Hirer accepts full responsibility for activities undertaken at the Event and for ensuring acceptable risk management techniques are practiced so as not to cause injury or damage to any persons.
A copy of the emergency evacuation procedure is displayed at the Venue in conspicuous locations.
DAMAGE MAKE GOOD
The responsibility of care remains with the Hirer for the duration of the hire period which includes the setup and pack down of the Event. This includes damage to floors, walls, doors, and ceilings, chipped or scratched paint, bathroom facilities, existing furniture and equipment, and other general damages.
Where these conditions have been breached, the Hirer will pay the full replacement or repair cost of damages, materials, cleaning, rubbish removal, repairs and restoration of the Venue and its fittings, equipment, furniture, floorboards, and any other property which has been removed or damaged.
Any costs will be outlined by the Venue to the Hirer in writing. The Venue reserves the right to make arrangements for the make good and charged to the Hirer.
CLEANING
General cleaning including, sweeping of the floors, mopping of the floors, and wiping down of the furniture, fixtures, or fittings, is included in the hire fees.
BYO Food/grazing station is the responsibility of the Hirer to clean, or a cleaning fee may be charged.
Cleaning of vomit will incur additional costs.
The engagement of a plumber to clear any toilets or drains due to use at the Event will incur additional costs.
OBSERVANCE OF LAWS AND PROPER LAW
The Hirer shall comply with all rules, regulations, and policies of TLBC, and with provisions of all other acts and regulations applicable to the Hirer and shall indemnify and keep indemnified TLBC against all losses, expenses, liabilities, claims, and damages incurred because of the Hirer’s breach of any such Act, Statutes, Rules or Regulations.
The Hirer agrees to indemnify TLBC against loss or damage it suffers if the Hirer, or a person admitted to the premises during the period of hire;
a) Damages or destroys any property.
b) Injures any person.
c) Fails to observe any of the Hirer’s obligations under this agreement.
This agreement is subject to the law of the state or territory of Australia in which this document is issued.
