The above-named activity participant or facility user (“Participant”) fully and forever discharges and releases the Diocese of Fort Worth, the above-named parish (“Parish”), and their bishop, successor bishops, officers, employees, and volunteers (collectively, the “Releasees”), from any claims, causes of action, losses, liabilities, damages, or costs of any kind arising out of or attributable to the Participant engaging in the above named activity or usage (“Activity”) at the Parish, whether arising from the ordinary negligence of the Releasees or otherwise.
Participant agrees to protect, defend, hold harmless, and fully indemnify the Releasees from and against any claims, causes of action, losses, liabilities, damages, or costs of any kind, including attorneys fees and costs of enforcing this agreement, arising out of or resulting from any claim of Participant or a third party related to Participant engaging in the Activity.
If any portion of this agreement is held invalid, it is agreed that the balance thereof shall continue in full legal force and effect.
