You, the Buyer, may cancel this agreement at any time prior to midnight of the third business day of the martial arts studio after the date of this agreement excluding Sundays and holidays. To cancel this agreement, mail and deliver a signed and dated notice, or submit by online form (Jotforms), the Buyer are canceling this agreement, or words to similar effect. Such notice shall be sent to 10TH PLANET: DARK ARTS at 3817 Pacific Coast Highway, Torrance, CA 90505.
Buyer may also cancel this agreement if a student moves further than 55 miles from KIRSTEN KUHAR LLC (sometimes referred to as the “10TH PLANET: DARK ARTS” or 10th Planet Jiu Jitsu: Torrance) and the student is unable to transfer the contract to a comparable facility. Upon such cancellation, Buyer shall be relieved from the obligation of making payment for services other than those received before the move. In the event that Buyer cancels this agreement pursuant to this paragraph and Buyer had prepaid any sum for services from 10TH PLANET: DARK ARTS so much of such sum as is allocable to services student has not received shall be promptly refunded. However, if Buyer so cancels the agreement. 10TH PLANET: DARK ARTS reserves the right to charge Buyer a predetermined fee.
The Buyer with the Monthly Membership with one year commitment must PAY TWO MONTHS OF THEIR MEMBERSHIP RATE and the Stripe $5 transfer fee., if their reason for cancellation is not the terms deemed below. If the reason for cancellation is within the terms. The Buyer will pay the following month's membership.
- If a student becomes disabled or has a health condition during the membership term and his/her disability is verified by a physician, and if he/she is unable to receive all services for which he/she has contracted because of his/her disability, then he/she shall be relieved from the obligation of making payment for services other than those received before the onset of his/her disability. - If the Buyer or Participant were to relocate beyond a distance of 55 miles from 10th Planet Jiu Jitsu: Dark Arts Academy's physical location at 3817 Pacific Coast Hwy, Torrance, CA 90505, or move out of the state of California, certain conditions would be applicable. To effectively cancel, you must furnish evidence of your updated address via the address change protocol to ensure validation. If the information is not provided, it will not be acknowledged due to past instances of former students providing false information.
- If the school is closed for a month or more, the student shall be entitled to his/her choice of either extension of this agreement or prorated refund, except if the closing is not the fault of the school, in which case the choice of remedy is the school’s.
It is understood that the student may adjust the program provided that a 30-day written notice is submitted in writing to 10TH PLANET: DARK ARTS ()and subject to the above hourly rate.
