Ballon Artist Service Contract Agreement

Agreement Terms and Conditions

The contract is in effect as of the date of signing by the above- mentioned client. Munchkin Explorers, LLC agree to provide THE

ABOVE-NAMED CLIENT with the contracted services listed on the

separate invoice. The client agrees to pay a non-refundable deposit and pay the remaining balance 3 days before the event. The booking arrangement cannot be changed once Munchkin Explorers, LLC workers arrive at the event.

Payments/ Deposits can be made via Zelle or Venmo to MunchkinExplorersBilling@gmail.com. Total remaining balance will be due 3 days before the event. 

The decorating fee is based upon the type of services desired, and decorating materials requested. Location fees will be charged if the decorating session is outside from 90240 limits, the Decorator will inform the Client of this fee. The Client is responsible for paying all fees associated with renting items from outside vendors, purchased items not included in the Decorator's inventory. The client also agrees to pay for costs incurred by Munchkin Explorers, LLC. This may include, but is not limited to: airfare, hotels, parking, valet, tolls, transportation tickets, etc.

Decorating Arrangements It is Client's responsibility to contact the venue and schedule a minimum of 2 hours for Decorator to perform the work. Just as it takes many hours to set up and decorate, it will also take time to break down all decorations. For this reason, the Client agrees to

schedule a minimum of 1 hour for breakdown.

A one-time free site consultation is available for Clients (Upon Request) Any additional trips to the site after initial consultation will be charged a 

consultation fee and a travel fee per visit.

Damaged or Missing Property The client will be responsible for any loss or damage to property from Munchkin Explorers, LLC. Munchkin Explorers will set up the decorations and leave. Once decorations are set up, all equipment brought in and set up will be under the client's liability. All damage and or missing property will be charged at full replacement cost. Balloon Colors/Materials Munchkin Explorers offers many balloon color options and textures. It is the Clients responsibility to pick items that match the event theme. A Client may request colors, and Munchkin Explorers, LLC will do its best match the color requested. However, the Client understands and agrees that colors may differ based on material and choice of manufacturer. If a supplier discontinues a product or a manufacturer changes the type of material, Munchkin Explorers, LLC reserves the right to make last minute changes, including but not limited to replacement of goods of a similar type and quality.

Ownership of Decorations It is agreed that all decorations that are included in the Decorator's inventory shall remain the property of the Decorator. However, if the Client purchases decorations, the client has full ownership of the property at the completion of the event. There are instances that the client transfers ownership of their purchased decorations to the Decorator. Once the Client transfers ownership of decorations to the Decorator, then the items become the property of the Decorator and the Client can no longer take possession or transfer ownership of decorations to another party. In some instances, written consent must be presented to the Decorator from the Client granting full ownership.

Agreement Terms and Conditions

In the event the Client must cancel the contracted services for

decorating on this Contract, all payments, including the initial non- refundable deposit, paid to date will be forfeited. The Client may receive a credit minus the cost of already ordered items towards an available future date as agreed upon by Munchkin Explorers and Client. All cancellations should be put in writing and emailed at: munchkinexplorersrentals@gmail.com. Any cancellation or rescheduling will require a minimum of a 7-day notice (except due to weather conditions. You may change your reservation date to another date if available, up to one year of your original event date. After the final payment has been made, there will be no refund. We are not responsible for inclusion of weather, fate or other circumstances that may cancel or postpone your event.

We reserve the right to cancel any reservations due to severe or imminent deterioration of weather conditions. Munchkin Explorers, LLC is not responsible if weather conditions do not allow to provide decoration services as described in the agreement. This includes, but is not limited to high winds, rain, etc. However, if inclement weather prevents delivery of the agreed decorations, a full refund minus deposit

Hot Weather/Heat: We use only the highest quality products and techniques to create your balloon decorations. However, due to the general nature of balloons, we cannot guarantee that they will remain perfect and intact when used outdoors. If inclement weather conditions make it difficult or impossible to produce as specified, we will do our best to be flexible with alternative decorations. The Client agrees that there will be no refunds or discounts for loss, damage or production failure due to factors beyond the control of Munchkin Explorers, LLC.

Making Changes During the initial consultation, the Client will be given an invoice with the price of decoration services and a breakdown of additional rentals based on guest count and other factors. It is the Client's responsibility to check the invoice for accuracy. Decoration packages are priced as-is and can only be customized during initial consultation and enlistment of services. Once a package price has been agreed upon, and Decorator has purchased items Client may not ask for a reduction in price due to no longer needing items or needing fewer items.

In the event that the Decorator deems the event to be unsafe, the

Decorator reserves the right to halt all services rendered if the event has begun. If the event has not begun, then the Decorator will provide

the same services on a different date. If the client or the client's

guests cause the event to become unsafe, then the client will pay any fees (travel, rentals, staff, ect associated with changing the

date of the services. In some instances, the Decorator will ask if the

venue will be providing proper security.

Accidents: We are not responsible for any accidents or injuries related to our decorations caused by mischief or mishandling by clients, guests or site staff. Please, do not allow guests to put latex balloons in their mouths as some Children and Adults have allergic reactions to latex. This group of people should refrain from coming

into contact with latex balloons.

Disclaimer: We use professional equipment and materials as intended for their specific purposes in all designs. To limit your risk of damage, we recommend that all decorations and items remain in the position and location ordered, installed or placed. Any decorations designed for indoor use, shall not be used or templated for outdoors or outdoors in a 4 (four) wall framed structure. Vice versa, decorations designed for outdoor use should not be used/placed indoors.

Video and Photography: It is agreed that Munchkin Explorers, LLC has the right to use all photos of Artist work for advertising and promotional purposes on websites, portfolios, social media, brochures and other non-commercial purposes as deemed appropriate by Munchkin Explorers, LLC. All videos or photos can be posted on all social networking sites for promotional purposes only. It is the client's responsibility to notify Munchkin Explorers, LLC in writing about any photos or videos that do not wish to be published. Munchkin Explorers, LLC has full ownership of all videos and photos of Artist work and the final setup photographed by Munchkin Explorers, LLC. Therefore, Munchkin Explorers, LLC has permission to put their name and logo on every photo taken by Munchkin Explorers, LLC. You agree with us taking and using the images as described and waive any and all claims regarding use. This signed agreement serves as the release authorization for the

Confidentiality: All information provided by the Client will always be kept strictly confidential by Munchkin Explorers, LLC and will only be available to the Artist, and their decorating staff. Your personal details will not be made available to any other party at any time without your written consent.

By signing this document, "CLIENT NAME" agree to this Contract and Payment Terms. It cannot be changed without written approval from Munchkin Explorers, LLC and "CLIENT NAME", and the Parties will to the best of their ability, fulfill all aspects of this contract.
