Coaching Via Session by Session Basis

Online Coaching Terms and Fees:

The client and/or trainee understand that the going rate for online coaching is $120 per month before any applicable discounts or rate adjustments. 

 

The client and/or trainee will receive a 60% discounted rate on in-person training sessions when purchased in combination with online coaching. The responsibility will lie with the client and/or trainee to contact Yasad Powell for scheduling or to schedule sessions through Bitebackfit.com. 

 

In-Person Training Terms and Fees:

The client and/or trainee understand that the going rate for one-on-one in-person training is $50 per session, before any applicable discounts or rate adjustments.

 

The client(s) and/or trainee(s) understand that the going rate for in-person group training is scaled to meet the needs created by group size and training specifications. Additional sessions booked or paid for in advance after the 6th scheduled in-person training session will be provided at a discounted rate. 

 

The client and/or trainee understand that training materials and supplies will be provided by Bite Back Fitness if needed. This will be determined while communicating and organizing training sessions before booking. 

 

Cancellation Terms and Fees:

If a cancellation is needed, the client understands that a notice of at minimum 24 hours is necessary. The client understands that if a notice of cancellation is not provided, a cancellation fee of $25 will be incurred. The same fee will be incurred for instances of no-call no-shows. 

 

Self-Elected Termination of Service:

The client(s) and/or trainee(s) understand that if they opt to terminate services early they must make contact via e-mail and submit a Termination of Services form received after making contact. 

The client(s) and/or trainee(s) understand that if services are terminated before the agreed-upon service length, there will be no refunds. 

 

Forced Termination of Service

Bite Back Fitness and Yasad Powell may terminate the trainer/trainee relationship at any time for reasons of misconduct, abuse, or other disqualifying factors. On the occasion of such an event, the client affirms that they understand that a $100 fee will be assessed.

Abuse is defined as:

• No call no showing more than once 
• Racist, sexist, or otherwise inappropriate conduct or remarks
• Abuse of training equipment
• Threats of physical violence and/or enacting physical violence
• Failure to pay on time more than once 
• Failure to pay in full more than once

 

I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.

Liability Waiver Terms and Conditions 

I am voluntarily participating in physical exercise that can be strenuous and subject to risk of serious injury during TRAINING PROGRAMS, ONE-ON-ONE OR GROUP TRAINING. Bite Back Fitness and Yasad Powell urges you to obtain a physical examination from a doctor before beginning any exercise or training program. You agree that participating in these physical exercise sessions or preprogrammed personal training activities is at your own risk. I recognize that exercise is not without some risk to the musculoskeletal system (e.g. sprain, strain) and cardiorespiratory system (e.g. dizziness, fainting, abnormal heartbeat, discomfort in breathing, abnormal blood pressure response, and in rare instances, heart attack or stroke).  I acknowledge that not all risks can be known in advance.

 

I HEREBY, for myself, my heirs, executors, administrators, assigns, or personal representatives (hereinafter collectively, “Releasor,” “I” or “me”, which terms shall also include Releasor’s parents or guardian if Releasor is under 18 years of age), knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation in the Activity.

 

I HEREBY release and forever discharge Bite Back Fitness and Coach Powell, from any physical or psychological injury that I may suffer as a direct result of my participation in the aforementioned Activity.

 

I FURTHER AGREE to indemnify, defend and hold harmless the Releasees against any and all claims, suits, or actions of any kind whatsoever for liability, damages, compensation, or otherwise brought by me or anyone on my behalf, including attorney fees and any related costs.

 

I FURTHER ACKNOWLEDGE that Releasees are not responsible for errors, omissions, acts, or failures to act of any party or entity conducting a specific event or activity on behalf of Releasees. In the event that I should require medical care or treatment, I authorize The Company to provide all emergency medical care deemed necessary, including but not limited to, first aid, CPR, the use of AEDs, emergency medical transport, and sharing of medical information with medical personnel. 

 

I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance. In the event that any damage to equipment, field, or facilities occurs as a result of my or my family’s or my agent’s willful actions, neglect, or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any such activities of neglect or recklessness. The participant, Bite Back Fitness and Yasad Powell agree that this agreement is clear and unambiguous as to its terms, and that no other evidence shall be used or admitted altering or explain the terms of this agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered into.

 

I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.

I certify that I am physically fit, have sufficiently prepared or trained for participation in this activity, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this activity.
