LIABILITY RELEASE:

Please read this liability release in full prior to signing as this is a legal binding agreement in the province of Alberta, Canada and effects your legal rights. By signing this release you hereby agree to and accept all as set forth in this release.

For the purpose of this Liability Release, Horse Care Plus/Michelle Martin and any pet sitters under contract by them are the provider and referenced here within as "Horse Care Plus". "Pet(s)" refers to all horses/indoor pets in the care of Horse Care Plus. "Client" refers to the person(s) with legal ownership and/or guardianship of the "Pet(s)" as stated/agreed to on this Liability Release.

This Liability Release remains in effect in perpetuity from the date stated on this release and can only be terminiated by written request from the Client to Horse Care Plus via email. Written confirmation of termination will be provided to Client from Horse Care Plus by email correspondence. Written termination requests must be emailed to info@horsecareplus.ca and have the Client's full name, address, phone#, email address and pet(s) names included in the request.

I authorize Horse Care Plus to perform pet sitting service as requested on the Horse Care Plus pet sitting app under the Client account and as selected by the Client or by direct request via email to Horse Care Plus.
Horse Care Plus agrees to provide care as outlined on their Code of Conduct & Animal Care Duties policy which is available for viewing on their website.
I understand it is my responsibility to provide the items required for visits such as; food for each animal, feeders (i.e. hay nets), halters, leashes, grooming tools, fly spray, ointments/medication for minor wound care, blankets, buckets, bowls, shovel, pitch fork, wheel barrel, litter boxes, poop bags, garbage bags and other miscellaneous items needed. In the event that these items are not readily available I authorize Horse Care Plus to provided the necessary item and agree to reimburse the cost of the said item immediately to Horse Care Plus. Horse Care Plus will communicate what item is required and obtain consent from client prior to providing the necessary item.
Client must disclose to Horse Care Plus all other persons having access to the home and property during the duration of the scheduled services contracted. Horse Care Plus accepts no responsibility for security of the premises other than to shut gates, pens, and cages, as instructed by the Client. Horse Care Plus neither accepts responsibility for loss or stolen property, or animals.
Horse Care Plus reserves the right to assign/designate a pet sitter contracted by them to perform care of pet(s) for the duration of this liability release.
In the event Horse Care Plus is unable to perform the care of pet(s) due to unforeseeable special circumstances and/or emergency/medical situation on their behalf, Horse Care Plus will ensure the client is advised in a timely manner and a replacement pet sitter contracted by them is assigned/designated to perform all remaining scheduled pet visits.
I agree to reimburse Horse Care Plus for any additional expenses and/or fees for providing care to pet(s), including but not limited to: additional visits not previously scheduled to provide emergency follow up care, extra time incurred for handling of pet during emergency and/or vet care, transportation of pet, housing, food or supplies.
I authorize Horse Care Plus to obtain any emergency veterinary care that may be necessary during the time spent with my pet(s). I accept responsibility for any charges related to this emergency care. I also authorize Horse Care Plus to utilize an alternative veterinarian in the event my primary veterinarian is unavailable. Horse Care Plus will make every effort to contact the Client prior to obtaining any emergency care for pet(s).
I agree, should I or my emergency contacts authorized to act on my behalf, be unreachable during an emergency situation requiring a veterinarian I authorized Horse Care Plus to seek the appropriate vet care up to the maximum amount as stated on this release without my prior consent being required.
Horse Care Plus agrees to provide the services requested and confirmed either from within the Horse Care Plus pet sitting app under the Client's account or confirmed by email with the Client, as stated in the Horse Care Plus Code of Conduct and Animal Care Duties policy. Pets(s) are unpredictable animals, as such, Horse Care Plus will not be liable for the injury, illness, medical condition(s), disappearance, or death of Pet(s) anytime during the scheduled dates/time care is provided. In consideration of these services and as an express condition thereof, the Client waives and relinquishes any and all claims against Horse Care Plus, spouse, family, extended family, heirs, administrators, executors, contracted pet sitters or assignees.
Horse Care Plus will not be liable for the injury, disappearance, death, or fines of any pet with unsupervised access to the outdoors/indoors. This includes death and/or injury to or from livestock due to damaged fences, barns, sheds, broken or ill repaired equipment/feeders/automatic or manual waterers or other faulty livestock enclosures.
Horse Care Plus reserves the right to terminate the confirmed service(s) at its sole discretion; likewise, client may terminate the service(s) at any time subject to the following conditions: services cancelled 3 or more days prior no charges are applicable. Services cancelled less than 2 days prior to service date are subject to a 50% charge of the total services(s) fees that were scheduled and confirmed. Same day cancellation of service(s) are non-refundable.
I am aware and agree to additional surcharges discussed that are applicable as outlined on Horse Care Plus website and online pet sitting app. I understand that these surcharges are subject to change with or without written notice.
It is expressly understood that Horse Care Plus shall not be held responsible for any damage to client's property, or that of others, caused by client's pet(s) during the period in which they are in its care.
I attest to the fact that all licenses, and vaccinations required by the province of Alberta, in the city in which I reside and/or county are current and/or have been met according to the law.
I authorize this release to be valid approval permitting Horse Care Plus to enter my premises during specified confirmed service dates without additional signed contracts or written authorization in order to perform pet sitting services agreed to and as covered under this Liability Release agreement.
I understand it is solely my responsibility to ensure I have met and continue to meet all necessary requirements/regulations relating to the care and keeping of animals to which I own or have guardianship of, Federally, provincially, and locally as defined under the Alberta Animal Protection Act prior to the hiring of Horse Care Plus for their service and release Horse Care Plus from any and all liability of this responsibility.

GOVERING LAW

This Liability Release agreement will be governed by and construed in accordance with the laws of the Province of Alberta.

I have read, signed and agree to the documents and information that are a part of this Liability Release agreement and any confirmed services with Horse Care Plus through their online Horse Care Plus pet sitting app or as confirmed by Horse Care Plus via email for the duration this Liability Release agreement is in affect. I am aware that by signing this agreement I am waiving certain legal rights, including the right to sue, which I, or my heirs, next of kin, executors,administrators and assignees, may have against the provider Horse Care Plus and/or their releases (contracted pet sitters).
