  • PLEASE READ CAREFULLY THE CONTENTS OF THIS FORM BEFORE SIGNING. 

    In consideration for being allowed to use the swimming pool and other facilities, and for other good and valuable consideration, the sufficiency of which is hereby
    acknowledged:

    I understand that during my stay and in the event that there is no lifeguard on duty, I shall be responsible for my guests and relatives using the pool;

    I understand that there are risks involved in the use of the pool facilities such as injury or death.

    The following persons are my guests and/relatives who shall be under my care: 

  • Further, I hereby acknowledge and declare that:

    I agree to indemnify, release, and hold harmless the Swimming Pool from any cost, liability, claim, damages, demand arising from injury, loss, illness, or death to me, my immediate family, guests, invitees related to the use of the pool. Likewise, any damage or loss to personal property caused by or related to the use of the Swimming Pool, its facilities, and its use.

    Further, I hereby indemnify, release, and hold harmless the Swimming Pool from any claims, demands, damages, and costs arising out of negligence resulting to loss, injuries, illnesses, or death.

    Finally, I recognize and fully understand and acknowledge the information above. By signing this form, I expressly declare that I am of legal age and that I am aware of the full contents of this waiver and I am legally accountable to any effects of this Release.

  • Pool - HOMEOWNER IS NOT LIABLE FOR INCLEMENT WEATHER, COLD WATER CONDITIONS OR OTHER SITUATIONS WHICH RENDER THE POOL UNUSABLE DURING YOUR STAY. Please be aware that because of access to the pool, children must never be left unsupervised in the outside yard.The property may not be suitable for young children because the pool area is not completely fenced. There is a ladder to the above ground pull that must be removed when pool is not in use. Adult supervision is always recommended. The pool is shallow (48"), and guests should never dive or jump from the pool deck.

    SWIM AT YOUR OWN RISK - No Life Guard on Duty at the pool or beach. It is a swim at your own risk.
    Bring your own Life Jackets.
    No Running or Horseplay
    No Throwing or Shoving Other Swimmers
    No Glass in the Pool Area - Plastic cups are provided in the kitchen of your unit for outdoor beverages. This rule is very important! If a drinking glass or beer bottle breaks and glass gets into the pool, the pool will have to be drained and professionally cleaned, the cost of which will result in a substantial charge to the renter.
    Children and Infants Must be Supervised by an Adult at All Times
    No Jumping or Diving Off the Pool Deck
    Pick Up Your Trash
    Don’t Remove Any Furniture from the Patio or Pool Deck
    Infants and Toddlers Must wear Swim Diapers When Using the Pool

    - Swimming Pool Waiver and Release of Liability- PLEASE READ THE FOLLOWING CAREFULLY. BY USING THE POOL AT THIS PROPERTY, YOU CHOOSE TO WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. By swimming or using the pool area, Renters recognize and fully understand certain things, including:
    • At no time is there a lifeguard on duty, you (the renter) are responsible for the safe use of the pool and you (the renter) are responsible for all persons using the pool during your stay.
    • Use of the pool facilities during your stay involves certain risks, including but not limited to: 1. The risk of injury resulting from possible malfunction of the pool equipment; 2. The risk of injuries resulting from tripping or falling over obstacles in the pool area; 3. The risk of injuries resulting from unsupervised swimmers, from people jumping or diving into the pool or from divers and swimmers colliding; 4. The risk of other injuries resulting from participating in any action in the pool. • By renting this property, Renters recognize and fully understand that the above list is not a complete or exhaustive list of all possible risks; the list above only provides examples of types of risks that renters are assuming. In exchange for the Homeowner allowing renters and their guests to utilize the pool and the pool area during their stay, Renters hereby fully intend and choose to give up the legal rights, as stated below: 1. TO WAIVE ANY AND ALL CLAIMS that Renters have or may have in the future against the Homeowner, its employees, or representatives relating to the Renter's use of the pool and pool area; 2. TO RELEASE THE HOMEOWNER, its employees, or representatives from any and all liability for any loss, damage, injury, expense, or other cost that Renters and their guests may suffer in connection with their use of the pool or pool area. 3. TO HOLD HARMLESS AND INDEMNIFY THE HOMEOWNER, its employees, or representatives from any and all liability to property, or personal injury to, any third party, resulting from the use of the pool or pool area. 4. The Renter acknowledges that they are over the age of 18, and that they are responsible, and will adhere to ALL the rules of the property. 5. By renting this property, the Renter acknowledges that this Waiver, Release, and Agreement is fully effective and shall be effective and binding upon the Renters, and their heirs, next of kin, executors, administrators, and assigns, or anyone else authorized to act on their behalf or on behalf of their estate.

    -Owner is not responsible for any effects chlorine may have on hair dye discoloration.
