For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, I hereby authorize my child or ward identified above (my “Child”) to participate in the “Barbie PhotoBooth Activity” (the “Activity”) being held on the date indicated above.
I acknowledge and agree that neither I nor my Child shall have any claim (including, without limitation, claims based upon invasion of privacy, defamation or right of publicity) arising out of my or my Child’s participating in the Activity.
I hereby assume all risk for any injury that my Child may sustain during the Activity, unless any such injury is sustained as a result of the gross negligence of Mattel or any of its agents or employees. I hereby indemnify, release, discharge and agree to defend and hold harmless Mattel Inc. and its affiliates, related entities, representatives, assigns, sub-contractors and employees and any other person or corporation acting on its or their behalf or under its or their instruction, from and against any and all liability in connection with the Activity or the use of the photos that are taken in connection therewith.
I hereby warrant and declare that: (a) I have reached the age of majority in the province/territory/state in which I reside; (b) I have the requisite capacity to execute this Consent Form on behalf of my Child; and (c) I have read and understood the contents of this Consent Form and my signature hereunder indicates my agreement to be bound by the terms and conditions hereof.
