Small Engine Repair Agreement and Release Form

I hereby acknowledge that I understand the inherent risks and potential liabilities on having my small engine repair(s) undertaken. I likewise declare that I have full and legally binding authority to provide consent for the repair of my small engine on my premises or at SB's Small Engine Repair per mechanics' discretion.

I acknowledge the risk of any possible damage that may be incurred during the repair of my small engine and by which I assume the liability and responsibility of such damage.

I hereby authorize the SB's Small Engine Repair to perform all necessary and authorized repairs to my small engine. In this regard, I understand that they may bring heavy equipment for the purpose of the repairs, as quoted and discussed with me.

I hereby express my permission for the SB's Small Engine Repair to use my premises, if they so choose, to park their vehicle and heavy equipment, and assume the potential risks and liabilities associated with such activity on my premises, including any damage to the property whether real or personal.

The following has been explained to me and I acknowledge with full understanding:

For and in consideration of the mutual covenants contained in this Agreement and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows:

The undersigned Customer requests that SB's Small Engine Repair, repair the following described small engine:

A written estimate for charges for the repair services will be provided to the owner after initial diagnostics are performed.  Diagnostic fee is mandatory and is set at $40.  If repairs are approved, diagnostic fee will be waived.

 

Pick up and delivery are available at mechanics discretion and availability.  Pick up and delivery fee is $1/mile within 20 miles and $1.50/mile outside of 20 miles (radius from Wellston, Oklahoma).  

 

Diagnostic fee and pick up (if applicable) will be due upon receipt of small engine by SB's Small Engine Repair.  

 

Shop repair fees are $60/hour plus parts.

 

SB's Small Engine Repair will claim a lien on the small engine for actuial charges incurred and repairs approved / performed.  Payment of said charges shall be due upon receipt by Customer of the of the invoice for said charges from SB's Small Engine Repair.  SB's Small Engine Repair will keep posession of the small engine until said invoice is paid in full.  

 

Customer, as the owner of the small engine left for repair, is to pay all expenses incurred in the repairing of the small engine.  If customer fails to pay all charges for repairing the Vehicle upon receipt of the invoice from SB's Small Engine Repair, SB's will have a right to claim a lien on the described item as described in previous paragraph.  If the amount owing to SB's Small Engine Repair is not paid by Customer within 30 days after Customer receives invoice, SB's Small Engine Repair retains the right to sell the small engine at auction to the highest bidder, or by private sale.  If SB's Small Engine Repair receives more for the small engine than the charges for labor and materials (final invoice to customer), including any storage fees, auction fees, listing fees, shipping fees, etc and a service charge of $25.00 for sending notice to Customer, any excess funds will be remitted to Customer in the form of a check to the address listed above.  If SB's Small Engine Repair receives less for the small engine than the charges for labor and material as dictated in previous sentence, SB's Small Engine Repair retains the right to pursue legal action for collection of remaing amounts due.  Additional fees may be included such as court filing fees, attorneys fees, etc.  

I hereby waive my right to sue the SB's Small Engine Reapair for any and all damages, injuries, or death that I or my family might incur during and in connection with the repair of my small engine when repairs are made on my property.

Further, I hereby defend, indemnify, release, discharge, and hold harmless, SB's Small Engine Repair, its owners, affiliates, employees, agents, and representatives from any liability, injury, loss, damages whether personal or real, expenses, whether tangible or intangible, litigation costs by which they may incur in relation to the repair of my small engine.

I hereby declare that I am at least Eighteen (18) years of age and the legal and registered owner of the Premises or have the full authority to sign this agreement.
