Session Agreement
This Agreement (the "Contract") outlines the terms and conditions for the maternity shoot ("Session") conducted by Move Mountains Co. (the "Photographer") and {name} (the "Client").
Session Details: The Session will take place at an agreed-upon location on the specified date and time. The Client is responsible for arriving on time and being prepared for the Session, including any necessary hair, makeup, and wardrobe arrangements. The Photographer is not liable for any issues resulting from the Client's failure to arrive on time or be properly prepared.
Image Use: The Photographer retains copyright ownership of all images taken during the Session. However, the Client is granted non-exclusive, perpetual, and worldwide rights to use the images for personal, non-commercial purposes. The Client may print and share the images for personal use but may not sell or distribute them for profit or use them in advertising or promotional materials without prior written consent from the Photographer. The Photographer reserves the right to use the images for their own portfolio, marketing, and promotional purposes.
Privacy and Objection: The Client may object to the Photographer using any images from the maternity session for promotional purposes. If the Client objects, the Photographer will refrain from using those specific images for promotional purposes. The Client also has the option to keep the images private and not share them outside of their immediate circle. The Photographer will respect the Client's wishes and will not share the images without the Client's written consent.
Payment: The Client agrees to pay the full Session price, including image usage rights, upon booking. Any additional fees for extra services or products requested by the Client shall be paid as agreed.
Cancellation: The Client may cancel the Session at any time but will forfeit the full payment made. The Photographer may also cancel the Session due to unforeseen circumstances and will issue a full refund to the Client.
Release: The Client releases the Photographer and affiliates from any claims arising from the Session, including defamation, invasion of privacy, and copyright infringement.
Governing Law: This Agreement shall be governed by the laws of the State of Rhode Island. Any legal actions relating to this Agreement shall be brought in the courts of the State of Rhode Island.
By signing below, the Client acknowledges reading and understanding this Agreement and agrees to be bound by its terms.
