Nova Labs Makerspace Waiver & Release

As a makerspace and also a community of makers, Nova Labs, Inc. ("Nova Labs"), provides its facilities, equipment, classes, and activities with the intention of creating an environment that supports collaboration, creation, and community among its participants ("Makers"). To this end, Nova Labs takes reasonable precautions to maintain safety of its space and equipment but cannot guarantee the safety of the Makers at all times.

I acknowledge that these risks cannot be eliminated without jeopardizing the essential and/or fundamental qualities of Nova Labs and its activities and events. I agree and promise to accept and assume personal responsibility for all potential risks that exist from my participation in Nova Labs, including but not limited to risks that are known and unknown, anticipated and unanticipated, despite Nova Labs' reasonable efforts toward safety, despite perceived negligence by Nova Labs, and other faults.

My participation is purely voluntary, and I agree that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the activity. I also accept and agree to abide by any and all safety procedures established in Nova Labs (especially as relevant to my participation) and to exercise rationality and sound judgment. I agree to utilize only the equipment and areas in Nova Labs, and participate only in the activities and events, that are within the scope of my training and knowledge. Furthermore, I agree to report any accident, malfunction, or breakdown of equipment or facilities to the appropriate member of Nova Labs.

I further acknowledge that inherent risks, dangers and hazards and such exist when using power tools commonly used in electronics construction, fabrication, software design and other technology-related activities. Participation in such activities and/or the use of equipment associated with technology design, fabrication or manufacture and experimentation may result in injury, illness, death or damage to personal property.

I fully assume all risks associated with participation in events and exempts and release Nova Labs, its members, officers, agents and board members, from action whatsoever arising out of any damage, loss or injury to me or my property while upon the premises or using any equipment of Nova Labs or while participating in any of the activities contemplated by this agreement whether such loss, damage, or injury results from the negligence of Nova Labs, its members, agents, or from some other cause.

I will indemnify, save and hold harmless Nova Labs, its members, officers, board members, and agents from any and all losses, claims, actions, or proceedings of every kind and character which may be presented or initiated by any other persons or organizations and which arise directly or indirectly from my actions while engaged in the activities contemplated by this agreement.

I hereby acknowledge that I have CAREFULLY read all of the provisions above, fully understand the terms and conditions expressed there, and I intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law. Should any portion of this agreement be held to be invalid, its remainders shall continue to be in effect.

MEDIA RELEASE

I hereby grant to Nova Labs, its affiliates, legal representatives, and assigns, and those acting with Nova Labs makerschool’ authority and permission, the irrevocable and unrestricted right and permission to create, use, re-use, publish and re-publish video recordings, audio recordings, photographs, or other media that contain or capture the likeness or voice of myself, the named participant, or family members or siblings in which mine and the named participant' or family members or siblings' likeness or voice may be included (the “Recordings”) in connection with any publication or materials relating to or serving the mission and goals of Nova Labs , including advertisements, brochures, or other promotional materials. The Recordings may be used with or without my name, and in any and all media now or hereafter known. I acknowledge and agree that Nova Labs owns all right, title, and interest in and to the Recordings, including all copyrights therein and the full and unrestricted right to edit and modify the Recordings, and I hereby assign and agree to assign any such interest that I may own or control to Nova Labs. I also consent to the use of any printed matter in conjunction with the Recordings. I hereby waive any right I may have to inspect or approve the Recordings or any finished product or products incorporating the Recordings and any written or other print material that may be used in connection therewith, including print material containing my name. I acknowledge that nothing in this Agreement obligates Nova Labs or any third party to make any use of the Recordings.
Nova Labs Waiver and Media Release Acknowledgement*

Nova Labs Youth Robotics Program Consent and Release
I understand that participation in Nova Labs Youth Robotics activities involves the risk of personal injury due to the physical, mental, and emotional challenges in the activities offered. I also understand that participation in these activities is entirely voluntary and requires participants to follow instructions and abide by all applicable rules and the standards of conduct.

In case of an emergency involving me or my child, I understand that efforts will be made to contact the individual listed as the emergency contact person by the medical provider and/or staff member. In the event that this person cannot be reached, permission is hereby given to the medical provider selected by the adult leader in charge to secure proper treatment, including hospitalization, anesthesia, surgery, or injections of medication for me or my child. Medical providers are authorized to disclose protected health information to the adult in charge, makerschool staff, and/or any physician or health-care provider involved in providing medical care to the participant. Protected Health Information/ Confidential Health Information (PHI/CHI) under the Standards for Privacy of Individually Identifiable Health Information, 45 C.F.R. §§160.103, 164.501, etc. seq., as amended from time to time, includes examination findings, test results, and treatment provided for purposes of medical evaluation of the participant, follow-up and communication with the participant’s parents or guardian, and/or determination of the participant’s ability to continue in the program activities.

(If applicable) I have carefully considered the risk involved and hereby give my informed consent for my child to participate in all activities offered in the program. I further authorize the sharing of the information on this form with any makerspace volunteers or professionals who need to know of medical conditions that may require special consideration in conducting activities.

With appreciation of the dangers and risks associated with programs and activities, on my own behalf and/or on behalf of my child, I hereby fully and completely release and waive any and all claims for personal injury or loss that may arise against Nova Labs, all employees, volunteers, related parties, or other organizations associated with any program or activity.

NOTE: Due to the nature of programs and activities, Nova Labs cannot continually monitor compliance of program participants or any limitations imposed upon them by parents or medical providers. However, so that leaders can be as familiar as possible with any limitations, list any restrictions imposed on a student participant in connection with programs or activities below.
