**1. Program Participation**
1.1 By signing this Agreement, the Member agrees to participate in the RMS Elite Squash Program, subject to the terms and conditions set forth herein. The Agreement shall commence on the date of enrollment and continue on a month-to-month basis until terminated in accordance with the provisions set forth herein.
1.2 The Member acknowledges and understands that participation in the RMS Elite Squash Program requires a monthly commitment.
**2. Monthly Commitment and Billing**
2.1 The monthly commitment includes the payment for the selected tier(s) as indicated by the Member at the time of enrollment. Members participating in the RMS Elite Squash Program are required to make monthly payments based on their selected tiers. These payments grant access to specific lessons or clinics within the month they are billed.
2.2 Ox Ridge Club shall bill the Member on a monthly basis, and the billing cycle shall commence on the 1st of each month.
2.3 Proration for mid-enrollment: If a Member joins the RMS Elite Squash Program after the billing cycle has commenced, the program fee shall be prorated for the remaining days in the current billing cycle. The prorated amount will be calculated based on the number of days remaining from the enrollment date until the end of the billing cycle.
2.4 All payments, lessons, or clinics included in the monthly commitment are non-transferable and non-cumulative. This means that any unused portion of payment, lessons, or clinics at the end of the billing cycle shall not be carried forward or accumulated for use in the subsequent month. Members are encouraged to fully utilize their monthly commitment to maximize the benefits of the RMS Elite Squash Program. However, no unused portion of payment, lessons, or clinics will be carried over to the next billing cycle.
**3. Cancellation/Termination Policy & Refunds**
3.1 The Member may cancel their participation in the RMS Elite Squash Program at any time before the next billing cycle. In order to cancel, the Member must provide written notice to RMS through email at [ryan@oxridge.com]. Upon cancellation, the Member shall remain liable for any outstanding payments due for the current billing cycle.
3.2 In the event that a Member chooses to cancel their participation in the RMS Elite Squash Program during the current billing cycle, no refund shall be issued for the current month, regardless of the cancellation date. Additionally, any unused portion of payment, lessons, or clinics at the end of the billing cycle, whether due to cancellation or underutilization, shall not be eligible for a refund or carried forward to the following month.
3.3 The Member acknowledges and accepts that the monthly commitment provides access to specific services and resources for the duration of the billing cycle, and any termination or underutilization of these resources during that period will not result in a refund or credit.
3.4 By enrolling in the RMS Elite Squash Program, the Member acknowledges and agrees to the no refund policy for mid-month cancellations and unused portions as described above.
3.5 In the event of any violation of the terms of this Agreement or any misconduct by the Member, RMS & Ox Ridge Club reserves the right to terminate the Member's participation in the RMS Elite Squash Program immediately without any prior notice.
**4. Amendments**
4.1 RMS reserves the right to amend this Agreement, including but not limited to changes in the monthly commitment and billing terms. Any amendments shall be communicated to the Member in writing, and the Member's continued participation after receiving such notice shall constitute acceptance of the amended terms.
**5. Miscellaneous**
5.1 This Agreement represents the entire understanding between the parties concerning the RMS Elite Squash Program and supersedes all prior negotiations, representations, or agreements, whether oral or written.
**6. Exceptions:**
6.1 There may be instances where RMS, at its sole discretion, may offer a credit or make exceptions to this policy for special circumstances, such as prolonged illness or extenuating circumstances beyond the Member's control. Such exceptions shall be considered on a case-by-case basis and require prior written approval from RMS.
**7. Policy Review:**
7.1 This policy shall be reviewed periodically to ensure its effectiveness and relevance. Any necessary updates or modifications will be communicated to all Members in a timely manner.
