WAIVER OR LIABILITY AND ASSUMPTION OF RISK
In consideration of being allowed to participate in Adult Literacy Volunteer Tutor Activities, the undersigned acknowledges, appreciates and agrees that:
- The risk of injury from the activities involved in this activity is significant, including the potential for permanent paralysis and death, and while particular rules, equpiment and personal discipline may reduce this risk, the risk of serious injury does exist.
- I knowingly and freely assume all such risks, both known and unknown, even if arising from negligence (as defined below) and assume full responsibility for my participation,
- I willingly agree to comply with any rules and regulations of this activity. If however, I observe any unusual significant hazard in participation, I will bring such hazard to the attention of the nearest official immediately.
- I, for myself, and on behalf of my heirs, assigns, personal representatives and next-of-kin, hereby release and hold harmless the City of Azusa, their members, managers, officers and employees, from any and all liability, claims, demands, or causes of action of any nature, whether known or unknown, for any harm, loss, damage, injury, disabiliity or death, due to negligence or any other cause, resulting from, arising out of, or in any way related to the City of Azusa, its employees, facilities, equipment, or an other connection to the City of Azusa. I agree to indemnify, hold harmless, and discharge forever the City of Azusa, its affiliates and successors, partners, employees, and agents, for any injury, damage, or loss, to the Participant or property.
- ASSUMPTION OF RISKS. I understand that while the City of Azusa has undertaken reasonable steps to lessen the risk of transmission of COVID-19 in connection with the services, the City of Azusa is not reponsible in any manner for any risks related to COVID-19 in connection with the assigned activity. I understand that the World Health Organization and Centers for Disease Control and Prevention have classified the COVID-19 outbreak as a pandemic. I further understand that COVID-19 is a highly contagious and dangerous disease, and that contact with the virus that causes COVID-19 may result in significant personal injury or death.
I have read this release of liability and assumption of risk agreement, fully understand its terms without any inducement.
