  • 3. The NDIS and this Service Agreement


    This Service Agreement is made for the purpose of providing supports under the clients NDIS plan.

    The parties agree that this Service Agreement is made in the context of the NDIS.
    NDIS plan is to be provided to MOBILE DIETITIAN.

  • 4. SCHEDULE OF SUPPORTS

    MOBILE DIETITIAN agrees to provide the client dietetic services. The supports and their prices are set out in the attached Schedule of Supports. All prices are GST inclusive (if applicable) and include the cost of providing the supports. Additional expenses (i.e. things that are not included as part of a client NDIS supports) are the responsibility of the participant / participants representative and are not included in the cost of the supports.

  • 5. MOBILE DIETITIAN RESPONSIBILITIES

    MOBILE DIETITIAN agrees to:

    1. Provide an annual review of the service agreement for the participant;
    2. Provide nutrition advice, education and training where applicable, that meets the needs of the participant at a time suitable to the participant;
    3. Ensure that all communication is clear and honest; 
    4. Be respectful and courteous to the participant;
    5. Openly consult with the participant on any decisions that are to be made regarding how the the supports are provided;
    6. Provide a cancellation policy and a means to report complaints or disagreements;
    7. Take heed of participant feedback and promptly resolve any issues; 
    8. Give sufficient notice to the participant or the relevant parties if MOBILE DIETITIAN is unable to keep a scheduled appointment;
    9. Give sufficient notice to the participant or the relevant parties if MOBILE DIETITIAN needs to cancel this Service Agreement (see "Ending this Service Agreement" below for more information);
    10. Keep the participant's privacy and confidentiality information secure;
    11. Provide services that comply with all relevant laws, including the NDIS Act 2013 and Rules, and the Australian Consumer Law;
    12. Keep up to date records on the advice provided to the participant;
    13. Will issue invoices and statements of the advice delivered to the participant as needed.
  • 6. CLIENT AND/OR THE CLIENT REPRESENTATIVE RESPONSIBILITIES

    The participant and their representives will agree to:

    1. Provide MOBILE DIETITIAN with accurate information to enable informed dietetic advice;
    2. Treat MOBILE DIETITIAN staff with courtesy and respect;
    3. Inform MOBILE DIETITIAN staff if they have any concerns over the service given;
    4. Give 24 hours notice to MOBILE DIETITIAN if they are unable to keep a scheduled appointment and noting the cancellation policy will apply;
    5. Give 24 hours notice to MOBILE DIETITIAN if they need to cancel this Service Agreement (see "Ending this Service Agreement" below for more information);
    6. Inform MOBILE DIETITIAN as soon as possible if the client NDIS plan is suspended or replaced by a new NDIS plan, or the client stops being a participant in the NDIS.
  • 7. PAYMENT

    MOBILE DIETITIAN will invoice the relevant parties after the services have been provided.

    Please note: MOBILE DIETITIAN is not NDIS registered and cannot invoice for NDIA Managed participants. If the client is NDIA Mangaged and uses MOBILE DIETITIAN services the client will be responsible for paying for services.

    For self managed and Plan Managed participants, MOBILE DIETITIAN will forward an invoice to be paid within 7 days of the service. This can be paid by direct debit.

  • 8. SERVICE AGREEMENT CHANGES

    If any changes to this agreement are needed, all relevant parties agree to engage in discussions to review it. The relevant parties agree that any changes to this Service Agreement will be in writing, signed and dated by all the relevant parties.

    9. SERVICE AGREEMENT TERMINATION

    Two weeks notice will be required to end the Service Agreement.  If either party seriously breaches this Service Agreement the requirement of notice will be waived.

    10. COMPLAINTS, DISPUTES & FEEDBACK

    If the client wishes to give MOBILE DIETITIAN is always learning and any feedback is welcome but must be provided in a respectful manner. If the participant is not happy with the way the services are provided and would like to make a suggestion, or complaint they or their representative can email MOBILE DIETITIAN at Michelle@MobileDietitian.com.au and the relevant staff member will review the email and determine the relevant response. 

    If the participant or their representative is not satisfied with the response they can make a complaint to the NDIS Commission at:

    11. GOODS & SERVICES TAX (GST)

    GST is not currently being charged by MOBILE DIETITIAN, but if this changes  the participant and/or their representative confirm that:

    1. A supply of dietetic supports under this Service Agreement is a supply of one or more of the reasonable and necessary supports specified in the statement included, under subsection 33(2) of the NDIS Act, in the client's NDIS Plan currently in effect under section 37 of the NDIS Act;
    2. The client's NDIS Plan is expected to remain in effect during the period the supports are provided; and
    3. The participant or their representative will notify MOBILE DIETITIAN as soon as possible, if the participants NDIS Plan is substituted by a new plan or the participant is no longer supported by the NDIS.

    12. CANCELLATION POLICY

    Cancellations made by 5pm the day before the appointment date will receive a 100% refund any paid fees and not incur any charges.  Cancellations made after this will be charged 50% of the service fee and the opportunity to reschedule. Missed appointments will be charged the full fee at the discretion of MOBILE DIETITIAN. If MOBILE DIETITIAN staff arrive for a home visit and no one is home, the participant will be charged for travel time and the full cost of the service. MOBILE DIETITIAN reserves the right to end a service agreement if a client or participant continue to miss or cancel appointments.

     

  • 13. SUPPORTS SCHEDULE

    I/we agree to pay for Medical Nutrition Therapy sessions provided by MOBILE DIETITIAN through claiming against the National Disability Insurance Scheme (NDIS) service plan. Working with the NDIS we have been allocated dietetic funding for the service year (enter service dates):

  • The Provider agrees to provide the client with dietetic services for the duration of the agreement at the agreed upon rate. These include:

    1. Nutritition assessment and care plan, to manage or treat the condition presented;
    2. Follow-up visists to provide support for behavioural, lifestyle and environmental determinants;
    3. Communication with other relevant health providers when required;
    4. Reports required or requested;
    5. Attendance at any team meetings when requested;
    6. Email communication;
    7. Cancellation charges for a late notice or not being available at the appointed time;

    MOBILE DIETITIAN reserves the right to bill for time spent on any of the above tasks, outside of face to face contact with the client when the time spent exceeds 10 minutes. This will be billed at the agreed upon rate stated below.

    MOBILE DIETITIAN reserves the right to NOT provide services or to cancel any future appointments for a participant if they do not have sufficient funds in their plan or the plan expires. Any service fees not met by NDIS will be covered by the participant / participant representative.

     

  • 13. FEES FOR SERVICE

    MOBILE DIETITIAN currently charges $190 per hour for all services related to the participants dietetic care. This includes travel time beyond 10 minutes from Strathalbyn, SA, report writing, and email communication (over 10 minutes).

    An invoice will be provided after the service is completed.

    MOBILE DIETITIAN will notify current clients with any changes in fees, but will honour the fee structure that the client signed up with.

  • 14. AGREEMENT SIGNATURE

    The aforementioned parties agree to the details of this service agreement with MOBILE DIETITIAN.
